Dear Mr Balascio
On July 26, 2000, the Yelm City Council considered your application for the above referenced project.
After review of the Planning Commission's recommendation, public hearing comments and the staff
report dated July 11, -2000, the City Council finds that the project, as conditioned below'
A. Adequately provides for the public health, safety and general welfare and for such open spaces,
drainage ways, streets, potable water supplies, sanitary wastes, parks and recreation, schools,
sidewalks,
B That the public use and interest will be served by the platting of such subdivision and dedications,
and
C The subdivision is in conformance with The Yelm-Thurston County Joint Comprehensive Plan,
the City Zoning Ordinance and the City's Development Guidelines
Preliminary Plat approval is valid for five (5) years from the date of City Council approval Upon failure to
submit a final plat prior to expiration of preliminary plat approval, no subdivision will be approved without
submission and review of a new preliminary plat.
Pursuant to Chapter 15 49, Integrated Project Review Process, a Preliminary Plat is a Type IV Permit
and can be appealed in Superior Court as set forth in RCW 36 70C , JUDICIAL REVIEW OF LAND USE
DECISION The affected property owners may request a change in property tax valuation from the
Thurston County Tax Assessor's Office
The preliminary plat is approved subject to the following conditions of approval
Sewer
1 The proponent shall connect to the City's STEP sewer system A 6" PVC collector line will be
required across the frontage on Middle Road The connection point will be at the property boundary
to the Prairie Creek Subdivision
Sewer ERU's (equivalent residential units) are based on discharge of 240 gallons per day and are
currently charged at a rate of $4,850 per ERU, as well as an inspection fee of $145 OO/ERU STEP

City for operation and maintenance

The property is subject to a latecomer's agreement between the City of Yelm and Springfield

payable at time of building permit issuance
5 The applicant shall abandon the on-site well in accordance with the Department of Ecology
standards.
6 If a valid (by Department of Ecology standards) water rights exists for the site, the City is interested
in a transfer of those rights to the municipal water system Details on the amount of water rights that
are eligible to transfer and the value of those to be determined
7 The property is subject to a latecomer's agreement between the City of Yelm and Springfield
Development Company, Inc., dated November 28, 1994, for a water main extension The applicant

$757 50 per unit which is payable at time of building permit.
b The proponent shall enter into an agreement with the Yelm School District to mitigate project
impacts to the school district.

John Knowles & Associates, Inc, has completed our initial review of the Middle Road Plat civil
engineering documents as prepared by Skillings Connolly The plans were dated July 25, 2000,
and included Sheets 1 through 20, together with a storm drainage analysis and report, dated April
21, 2000 We also reviewed the July 11, 2000, memorandum to the Planning Commission from
C Carlson
We have reviewed the documents for compliance with City of Yelm Development Guidelines,
DOE Stormwater Management Manual, and general standards of civil engineering practice
Our comments are described below and/or are noted in red on the enclosed mark-ups of the
plans and Drainage Report. (Please note that not all redline comments are discussed in this
letter).
General Conditions of Project Approval (per C. Carlson memo dated 7/11/2000)-
The project engineer and applicant should be reminded of the following conditions of approval, as
related to approval of the civil engineering documents:
3 A note should be placed on the drawings, stating that the existing drainfield associated
with the current residence must be abandoned according to Thurston County
Environmental Service Department standards. Appropriate documentation needs to be
provided to the City, confirming said abandonment.
8 An irrigation system with separate water meter(s) is required for the open-space and
planting strip areas of this plat. We could only find water meter call-outs for the lots, We
were not provided a copy of the landscape and irrigation plan

A "Waiver of Protest" must be executed and submitted to the City regarding deferment of
Middle Road "half-street improvements." This pertains to future curb, gutter, planter strip,
sidewalks, landscape, street lighting, etc. The current plans only present construction
information for sewer, water, and storm drainage improvements.

meeting.

meeting.

A. PUBLIC HEARING OBJECTIVE:
The Planning Commission must determine if the proposed project is consistent with the City of
Yelm's Comprehensive Plan and applicable Municipal Code(s) After consideration of the facts
and public testimony the Planning Commission must take one of the following actions request
additional information from the applicant and/or staff, continue the public hearing or make a
recommendation of action to the City Council
B. PROPOSAL.
The applicant proposes to subdivide 4 15 acres into 22 single family residential lots. The
proposed plat includes Tracts A, Band C for open space and/or stormwater retention, a new street
and the infrastructure necessary to support the new development.
C. DEPARTMENT ANALYSIS AND FINDINGS.
1 Proponent. Dennis Balascio
2. Location The project site is located on the north side of Middle Road just east of
the Prairie Creek Subdivision The project site includes 2 parcels The majority of
the project is on tax parcel 64303500504, lots 14 - 16 and Welch Street are located
on a portion of tax parcel 64303500400
3 Public Notice Notice of the Public Hearing was published in the Nisqually Valley
News on July 7,2000, and posted in public areas on July 6,2000 The notice was
mailed to adjacent property owners and the applicant on July 6, 2000
4 Subdivision Name. The applicant submitted the project application under the name
of Middle Road Plat. This name has not been approved by Thurston County
5 Existing Land Use. Zoning and Densitv There is currently one manufactured home
on the site that is proposed to be removed The site is zoned Moderate Density
Residential (R-6), Chapter 17 15 The applicant proposes to divide the 4 15 acres
into 22 single family residential lots In the R-6 District the minimum density is three
(3) units per acre with a maximum of six (6) units per acre As proposed the
subdivision density is five (5) units per acre and complies with the density
requirements within the district.
6 Lots Size and Setbacks. The R-6 District does not have a minimum or maximum
lot size but it does have standard yard setbacks The shape or size of Lot 5, 14, 16,
17, 18, and 22 may not accommodate typical foot prints for single story homes.
7 Adiacent Land Uses and Zoning Properties to the north and east of the site are in
Thurston County Properties to the east are zoned Rural Residential (1/5) and to
the north are industrial The property to the north is currently being considered for
a rezone to residential by Thurston County Commissioners. The property to the
west and south of the site are zoned Moderate Density Residential (R-6).
Developed densities in the immediate area range from rural (1 unit per five acres)
to moderate density of 6 units per acre
8 Open Space. Chapter 1614 requires a minimum of five percent of the gross area
be dedicated as open space, which is .21 of an acre The open space must provide
one or more of the following uses environmental interpretation or other education,
park, recreational land, or athletic fields, off-road footpaths or bicycle trails, or any
other use found by the City to further the purposes of the open space chapter The
ordinance suggests that open space should be dedicated to the City
The applicant has not indicated at this time which tract or combination of tracts will
serve as the open space
9 Schools New residential units create a demand for additional school services and
facilities. The Yelm School District requests that the developer enter into an
agreement with the school district for the payment of mitigation fees based on the
project's impact. This request became mitigation of the Environmental
Determ i nation
10 Transportation and Site Access, The property fronts on Middle Road which is the
only access to the site
The 1992 Yelm Comprehensive Transportation Plan provides policies in which the
Transportation Plan will be implemented The 1992 plan states
The city of Yelm recognizes that increasing connections throughout the City
not only reduces traffic congestion but also increases the sense of unity of
the community Therefore, the City will limit the use of cul-de-sacs, dead-
end streets, loops, and other designs that form barriers. The city will seek
to minimize impacts of through traffic upon residential neighborhoods by

employing narrow streets, curves, indirect access routes, and other
features The City will encourage the use of trails and other connections
that provide ease of travel between neighborhoods and community centers.
The Transportation Chapter of the Yelm Comprehensive Plan provides objectives
in which the Transportation Plan will be implemented The 1995 plan states.
The objective of the Transportation Plan is to provide a cost-effective
network to accommodate travel in and around the core area. To
accomplish this objective, Yelm will actively purse 1 A connected-streets
policy to promote the efficient flow of traffic within the community
The Design Guidelines implement the above objective through Section 48020 4,
Design Standards," the layout of streets shall provide for the continuation of
existing principal streets in adjoining subdivisions or for their proper project when
adjoining property is not subdivided "
The design of the internal street system is a local access residential street. Welch
Street which runs north and south on the eastern portion of the site is proposed as
the future access for development on the remaining portion of tax parcel
64303500400
The completed project will increase traffic and impact the City's transportation
system Chapter 15 40, Concurrency Management, requires all development to
mitigate impacts to the City transportation system A single family home generates
1 01 pm peak hour trips per unit. The Transportation Facility Charge per unit is
$757 50 and payable at time of building permit.
11 Parkina. Chapter 17 72, Off-Street Parking and Loading, requires minimum
parking ratio of two spaces per unit. The developer is proposing at a minimum to
provide a driveway approach that can accommodate two vehicles
12. Wastewater The project site is in the Sewer Service Area but is currently not
served by the City's STEP sewer system There is an existing line available to the
west of the site at the Prairie Creek Subdivision
The existing manufactured home is currently served with an on-site septic system
The applicant is proposing to remove the home and abandon the system
13 Water Supply The proposed site is in the City's water service area but is currently
not served by the city water system There is a service line located to the west of
the site at the Prairie Creek Subdivision
The existing manufactured home is currently served with an on-site well The
applicant is proposing to remove the home and abandon the system
14 Drainaae/Stormwater The completed project will increase impervious surfaces on

the site and adjacent streets Impervious surfaces create storm water runoff
When uncontrolled and untreated storm water runoff can create health and safety
hazards YMC requires all development to comply with the Stormwater Manual for
the control and treatment of stormwater runoff
The applicant has submitted a Preliminary Stormwater Report that estimates the
impervious surface, infiltration rates of the runoff, and a conceptual design for
treatment and storage of the stormwater Following preliminary plat approval the
City Stormwater Manual requires the developer to submit a final plan consistent
with the final impervious calculations for the site
Stormwater facilities require continued maintenance to ensure they remain in
proper working condition
15 Fire Protection Fire protection is provided by the Thurston County Fire District #2..
As development occurs there will be additional demands for fire service
16 Police Protection Police protection is provided by the City of Yelm As
development occurs there will be additional demands for police service
17 Street Lightinq. Adequate street lighting will be required for this project.
18 Landscaping. Landscaping and screening are necessary to promote safety, to
provide screening between compatible land uses, to safeguard privacy and to
protect the aesthetic assets of the City Chapter 17 80, Landscaping, requires the
applicant to provide on-site landscaping for all development proposals
The site is adjacent to properties that are compatibly zoned with the exception of
the property to the north. It is likely that by the end of the year the property to the
north will be rezoned to residential Assuming all adjacent properties are zoned
resiendital the code requires that the perimeter of the site be landscaped with a
Type II landscaping In residential subdivisions the city also allows fencing to meet
the landscaping requirement for the perimeter of the site
Landscaping is also required in the open space and above ground stormwater
facilities.
A preliminary landscaping plan has not been submitted at this time
Chapter 17 80 requires that at time of civil plan review and approval the applicant
provide the Community Development Department a final landscape and irrigation
plan for approval
19 Environmental Review: After review of the environmental checklist and supporting
documents, a Mitigated Determination of NonSignificance (MONS) was issued on
June 16,2000 The comment period expired on June 29, 2000 The MONS is
attached as Exhibit III

20 Public Comment. No public comment was received
21 Findings and Conclusion. Chapter 16 12.170 requires written findings prior to a
decision on a preliminary plat. Based on the project as proposed by the applicant
and the conditions of approval below, the staff finds that the subdivision
A. Adequately provides for the public health, safety and general welfare and
for such open spaces, drainage ways, streets, potable water supplies,
sanitary wastes, parks and recreation, schools, sidewalks,
B That the public use and interest will be served by the platting of such
subdivision and dedications,
C The subdivision is in conformance with The Yelm-Thurston County Joint
Comprehensive Plan, the City Zoning Ordinance and the City's
Development Guidelines
D. Staff Recommendation
Based on the Analysis and Findings in Section C and the Conditions of Approval below, staff
recommends that the Planning Commission forward SUB-00-8252- YL to the City Council for
approval
Conditions of Approval.
Sewer
1 The proponent shall connect to the City's STEP sewer system A 6" PVC collector line will be
required across the frontage on Middle Road The connection point will be at the property
boundary to the Prairie Creek Subdivision
Sewer ERU's (equivalent residential units) are based on discharge of 240 gallons per day and
are currently charged at a rate of $4,850 per ERU, as well as an inspection fee of
$145 OO/ERU STEP on-site collector tanks and pumps are to be installed by the owner, which
are then transferred to the City for operation and maintenance

The property is subject to a latecomer's agreement between the City of Yelm and Springfield
Development Company, Inc., dated November 28, 1994, for a sewer main extension The
applicant shall pay the latecomer in the amount of $2,704 00 prior to final plat approval

The on-site septic system and drainfield shall be abandoned to Thurston County Health
Department standards.
Water

The Proponent shall connect to the City's water system A 10" PVC water line extension will
be required along across the property frontage on Middle Road The connection point will be
at the property boundary to the Prairie Creek Subdivision This connection is at the cost of the
developer, however, a latecomer's agreement could be formed to recapture a portion of the
initial cost of connecting to the water system

day and are currently charged at a rate of $1 ,OOO/ERU (subject to change) inside city limits
This fee is payable at time of building permit issuance
5 The applicant shall abandon the on-site well in accordance with the Department of Ecology
standards
6 If a valid (by Department of Ecology standards) water rights exists for the site, the City is
interested in a transfer of those rights to the municipal water system Details on the amount
of water rights that are eligible to transfer and the value of those to be determined
7 The property is subject to a latecomer's agreement between the City of Yelm and Springfield

with construction drawings
10 The applicant shall submit a storm water operation and maintenance plan to the Public Works
Department for approval prior to final plat approval
11 The stormwater system shall be held in common by the Homeowners The Homeowners
Agreement shall include provisions for the assessment of fees against individual lots for the
maintenance and repair of the stormwater facilities
Transportation
12. The street design for the project is a local access residential and shall be included on civil
plans. The applicant shall submit final civil plans to the Community Development Department
for review and approval
13 The applicant shall be responsible for half-street improvements along the frontage of Middle
Road The frontage improvements include lane improvements, curb, planter strip, sidewalk,
landscape and storm drainage The Crystal Springs Road street section is "neighborhood
collector" A "waiver of protest" may be signed deferring these improvements until Phase II
14 Welch Street shall be shown on the face of the plat as a future street connection to the
adjacent property to the north and south

15 The applicant shall submit fire flow calculations for existing hydrants All hydrants must meet

SEWER MAIN EXTENSION AGREEMENT
THIS AGREEMENT, entered into this

1994, between the City of Yelm, a municipal corporation, herein-
after referred to as the "City", and The Springfield Development
Company, Inc., a Washington Corporation, hereinafter referred to as
the "Developer",
WITNESSETH:
WHEREAS, the Developer has extended the City's sewer system to
property owned by the Developer by the construction of a six inch
(6") sewer line, which said sewer line will pass by properties
which will benefit directly from said construction, as shown by
Exhibit "A", and the Owners of which may wish to use said sewer
line 1n the future; and
WHEREAS, the City has accepted said sewer line as part of the
City's sewer system and in return is willing to collect from future
users of said sewer line their pro rata share of the cost of said
lines to be reimbursed to the Developer.
NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES AS
FOLLOWS:
1. The developer has supplied all materials and performed all
labor for the construction in accordance with the stand-
ards of the City of Yelm a six inch (6") sewer line, to-
gether with all valves, fittings, and other necessary ap-
purtances over the following described route.
Beginning on a point on the previously constructed sewer
main on Railway Road SE, said point being approximately at
the intersection of Railway Road SE and Rhoton Rd., Thurs-
ton County, Washington, running thence East along Railway
Road to its intersection with Middle Street SE, thence
Southwesterly along Middle Street, a distance of approxi-
mately 1865.56 feet.

2. Said sewer line extensions have been completed to the City
of Yelm standards, and in accordance with the plans re-
ferred to herein and approved by the City and the City has
accepted ownership of said sewer line and facilities, and
the Developer has executed the documents necessary to
place complete ownership of said lines in the City. From
the time of acceptance by the City, the facilities have
belonged to the City and the City has been and will be re-
sponsible for their maintenance and operation, and shall
be entitled to all revenues derived from the transmission
of sewage through said lines.
3. There is attached to this contract, designated as Exhibit
"B", a listing of the cost of construction of said lines,
including all direct benefits of said sewer main construc-
tion and a determination of all applicable sales taxes, a
listing of parcel numbers of all properties along said
line which can be directly connected thereto, said proper-
ty parcel numbers being also shown on Exhibit "A", and
which properties have not paid their full pro rata share
of the cost of construction of said sewer facilities. For
a period of fifteen (15) years from the date of final ac-
ceptance of said sewer main by the City of Yelm said date

from all owners of such listed properties in Exhibit "B"
or their heirs, successors or assigns, except the Develop-
er who provided funds for the sewer main construction
prior to allowing connection of said properties to the
sewer facilities, the fair pro rata share of the cost of
construction of this subject line and shall pay said sums
to the Developer.
4. No person, firm or corporation shall be granted a permit
or be authorized by the City to connect to or use such
facilities during the period of time described in Para-
graph 3 of this Agreement without first paying to the
City for its own account for such connection or use, the
amount required to reimburse the Developer for the pro
rata share of cost of said construction of each of said
facilities in accordance with the schedule in Exhibit "B"
hereto. All sums so received by the City shall be re-
mitted to the Developer within sixty (60) days after the
receipt thereof.
5. Whenever any connection is made into the facilities cov-
ered by this Agreement without such payment having first
been made in accordance with Exhibit" B", the City may re-
move or cause to be removed such unauthorized connection
and all connecting lines or pipes located in the facility
right-of-way and dispose of such material removed with-
out any liability whatsoever.
6. The Developer, pursuant tot his Agreement, is an independ-
ent contractor, and not an agent or employee of the City.

7. The City hereby acknowledges that it had received from the
Developer the permit fee for said construction.
8. No assignment of this Agreement or any of the benefits
hereunder by the Developer shall be binding upon the City
unless or until written notice of such assignment shall be
given to the City and approval is given by the City.
9. All payments to be made by the City to the Developer under
this Contract shall be sent to the following address, to-
wit: The Springfield Development Company, Inc., 1313 East
Bay Drive, Olympia, Washington 98501, or such address as
the Developer may hereafter direct in writing.
IN WITNESS WHEREOF, the parties have hereunto set their hands
the day and date first written.

And the following conditions
1 The applicant shall mitigate transportation impacts based on the new pm peak hour trips generated
by the project. The Transportation Facility Charge (TFC) shall be based on 1 01 pm peak hour
trips per residential unit. The proponent will be responsible for a TFC of $757 50 per unit which is
payable at time of building permit.
2, The proponent shall enter into an agreement with the Yelm School District to mitigate project
impacts tQ the school district.

of the project site These recipients, and any others who submit a written request to be placed on the
mailing list, will also receive the following items when available or if applicable Environmental Threshold
Determination, Notice of Public Hearing and Notice of Final Decision If the proposed project requires a City
Council decision, it will be mailed to all those who participate in the public hearing and to anyone else
requesting the decision in writing Additionally, there will be a 14-day public comment period when the
environmental determination is issued Opportunities for appeal occur within twenty one (21) days after the
date the environmental determination is issued City Council decision can be appealed through Superior

Moderate Density Residential (R-6), Chapter 17 12, Minimum 3 units per acre and
maximum 6 units per acre
Minimum Lot Size - none
Lot 5 - the applicant will need to demonstrate that yard setbacks can be meet.
Setbacks Front yard - 15' for the house, 20' for the driveway
Rear Yard - 25'
Side yard - minimum 5', total both sides 12'
Traffic. The City has adopted a Transportation Facility Charge (TFC) of $75000 per new pm peak hour
trip generated by new development. The Ordinance provides a default table that the applicant
can use to determine new pm trips generated by the proposed use A single family unit
generates 1 02 trips during the pm peak hour
The TFC for each unit ($757 50) is payable at issuance of building permit.
Per Unit TFC
1 02 trips per single family unit x $750 00 = $757 50
If the applicant feels the proposed use would not generate the default number of trips as
designated in the TFC Ordinance an analysis prepared by a Traffic Engineer can be
submitted to the City for review and consideration

Type II - Open space and the perimeter of the site
Type V - Stormwater facilities
A conceptual landscaping plan is required with preliminary plat application Final
landscape and irrigation plans are required at the time of civil plan submittal

Off-road footpaths or bicycle trails, and
Any other use found by the City to(further the purposes of this chapter

An environmental checklist is required as a component of the land use application
Under SEPA the school district does require school mitigation The developer is
responsible for entering into an agreement with the School District. In the past the school
has require a mitigation fee of $650 00 per unit.

and septic systems that serve the adjacent properties and are within 100' of your property
lines

the Planning Commission with a final decision by the City Council The environmental

Preliminary subdivision approval typically contain conditions of approval that the applicant
must complete prior to receiving final subdivision approval or permits for construction
Following land use approval the applicant is required to submit civil construction drawings
to the Public Works Department for review and approval and satisfy all conditions of
preliminary subdivision approval Upon satisfactory completion the applicant submits the
final documentation for final plat approval The time elapse from preliminary approval to
final approval can vary significantly depending upon the conditions of approval and the
property owner Final approval can take between 3 months to 5 years
