mentioned matter, in the amount of $1,332.50 from rvlr Ed Dobbs of Assisted Living
Communities, Inc. In addition, in May of 2001 , the City of Yelm was billed tor Building
Plan RevIew fees from Mr Joseph Butler, in the amount of $2,170 00, which have never
been billed to you, our customer Based on a letter from Mr Dobbs (copy attached), we
are forwarding these billings on to your for payment.
Therefore, total fees for costs incurred include

Dear Mr Dobbs
On September 27,2000, the Yelm City Council considered your application for the above referenced
project. After review of the Planning Commission's recommendation, public hearing comments and the
staff report dated September 7, 2000, the City Council finds that the project, as conditioned below, to be
consistent with the Yelm Comprehensive Plan and all applicable City policy and development standards
Pursuant to Chapter 1549, Integrated Project Review Process, a Conditional Use Permit is a Type IV
Permit and can be appealed in Superior Court as set forth in RCW 36 70C , JUDICIAL REVIEW OF
LAND USE DECISION
As a result of the approved land use for the parcel, the affected property owners may request a change
in property tax valuation from the Thurston County Tax Assessor's Office
The project is approved subject to the following conditions of approval
Sewer
1 The property is located within the Killion North LID District. This property has been assessed a total
of 4 ERU's for a total of $7,292.60 The ERU fee of $2,480 (fee subject to change) is payable at time
of building permit issuance This fee is in addition to the LID assessment of $1,823 15 which is paid
on an annual basis for 15 years The total number of sewer ERU's required for this project will be
dependent on the proposed consumption calculations provided with the civil plans The additional
ERU's required for this project are based on discharge of 240 gallon per day and are charged at a
current rate of $4,850/ERU
2 The S T E P System shall be designed to City standards The applicant shall submit final civil plans
to the Community Development Department for review and approval
3 The project site is in the Sewer Service Area but is currently not served by the City's STEP sewer
system There is an existing 6" line available on West Yelm Avenue There may be a latecomer's
agreement formed to re-capture some of the installation costs

loading is adequate
Stormwater
8 The applicant shall design and construct all storm water facilities in accordance with the DOE Storm
Water Manual, as adopted by the City of Yelm Best Management Practices (BMP's) are required
during construction The applicant shall compile a final storm water report along with construction
drawings
9 The applicant shall submit a storm water operation and maintenance plan to the Public Works
Department for approval prior to final plat approval
Transportation
10 The applicant shall be responsible for half-street improvements along the frontage of Killion Road
The frontage improvements include lane improvements, curb, 12' sidewalk, street trees and grates
and storm drainage
11 The applicant shall be responsible for the Transportation Facility Charge of $5, 1 00 00 and payable
at time of building permit.
Fire
12. The applicant shall submit fire flow calculations for existing hydrants All hydrants must meet
minimum City standards.
13 The applicant shall submit a fire hydrant plan to the Community Development Department for review
and approval
Landscaping
14 The landscape buffer along the northern property line shall be expanded to a minimum 15' in width
and landscaped with Type I landscaping

As Mr Dobbs explamed the phIlosophy behmd theIr aSSIsted lIvmg facIlItIes
to me, I belIeve that It IS Important to first understand that they are very
delIberately operated lIke a large reSIdence, rather than commerCial facIlIty
or mstItutIOn
Meal plannmg IS based on the deSIres of the reSIdents and IS very SImIlar to
the spontanoeus process of smgle-famIly reSIdentIal settmg For thIS
reason, It IS unnecessary for the kitchen to contam a vast amount of dry
storage or cold storage Food purchases are made at local grocery stores and
transported to the faCIlIty by way of employee vehIcle or the actIVIty van

The applicant is applying for a Special Use Permit to construct a 25,000 sq ft Assisted Living
Facility The facility consist of 40 living units and provides residents with meals, laundry
facilities/service, transportation and 24-hr nursing care The proposal includes provisions for
parking and stormwater treatment and infiltration
C. DEPARTMENT ANALYSIS AND FINDINGS,
1 Proponent. Edwards House Associates LLC
2 Location The project site is located on the west side of Killion Road just north of
Yelm Avenue and south of the Killion Court Apartments The project site is
approximately 27 acres Tax Parcel #21724120404
3 Public Notice Notice of the Public Hearing was published in the Nisqually Valley
News on September 8,2000, and posted in public areas on September 6,2000
The notice was mailed to adjacent property owners and the applicant on
September 7 2000
4 Existing Land Use and Zoning The site is zoned Commercial (C-1) and is
undeveloped Residential Care Facilities are classified as a Special Use in Chapter
17 66 and permitted in the C-1 Commercial District provided the facility can comply
with all applicable development standards and the intent of the C-1 Commercial
District.
5 Lots Size and Setbacks. The C-1 District has a minimum lot size of 5000 square
feet. As proposed all setbacks are in excess of minimum standards
6 Adiacent Land Uses and Zoninq Property adjacent to the north is developed and
zoned as High Density Residential (R-14) All other properties in the area are
zoned C-1 Commercial District. Uses in the vicinity are primarily residential and
undeveloped land
7 Transportation and Site Access. The property fronts on Killion Road which is the
only access to the site Killion Road is designated a pedestrian oriented street in
the Design Guidelines For pedestrian oriented streets the frontage improvements
are modified from a Commercial Collector so that the planter strip and sidewalk are
combined to create a 12' sidewalk with tree grates for the street trees
The completed project will increase traffic and impact the City's transportation
system Chapter 15 40, Concurrency Management, requires all development to
mitigate impacts to the City transportation system A residential care facility
generates 0 17 P m peak hour trips per dwelling unit. The Transportation Facility
Charge for the facility is $5,100 00 and payable at time of building permit.
8 Parkinq. Chapter 17 72, Off-Street Parking and Loading, requires minimum
parking facilities of 1 parking stall for each two beds and one parking stall per
employee based on the greatest number of care employees on a single shift. The
largest shift includes eight (8) employees
Chapter 17 72 provides incentives for reducing the parking stalls by 25%. Edwards
House provides a van to transport residents to and from activities, appointments,
etc which meets the intent for parking stall reduction
With a 25% reduction the project is required to provide a minimum of 21 stalls The
project proponent is proposing 22 stalls which include two (2) handicapped stalls
As shown on the site plan the loading area is proposed at the front of the building
This area would provide loading for residents, visitors and goods Loading areas
for commercial facilities that require regular delivery typically require a separate
loading area that does not conflict with the day to day functions of the facility
9 Wastewater The project site is in the Sewer Service Area but is currently not
served by the City's STEP sewer system There is an existing 6" line available on
West Yelm Avenue
The property is located within the Killion North LID District. This property has been
assessed a total of 4 ERU's within the LID for a total of $7,292.60

10 Water Supply The proposed site is in the City's water service area but is currently
not connected to the City's water system There is an existing 8" water line located
on the west side of Killion Road
An irrigation meter may be installed for the purpose of irrigation
11 Drainage/Stormwater The completed project will increase impervious surfaces on
the site and adjacent streets Impervious surfaces create storm water runoff
When uncontrolled and untreated storm water runoff can create health and safety
hazards YMC requires all development to comply with the Stormwater Manual for
the control and treatment of stormwater runoff
The applicant has submitted a Preliminary Stormwater Report that estimates the
impervious surface, infiltration rates of the runoff, and a conceptual design for
treatment and storage of the stormwater Following special use approval the City
Stormwater Manual requires the developer to submit a final plan consistent with the
final impervious calculations for the site
Stormwater facilities require continued maintenance to ensure they remain in
proper working condition
12 Fire Protection Fire protection is provided by the Thurston County Fire District #2..
As development occurs there will be additional demands for fire service
13 Police Protection Police protection is provided by the City of Yelm As
development occurs there will be additional demands for police service
14 Street Liqhtinq. Adequate street lighting will be required for this project. Street
lighting design must meet the City of Yelm's Development Guidelines and will be
submitted to Puget Sound Energy for review and approval
15 Landscaping. Landscaping and screening are necessary to promote safety, to
provide screening between compatible land uses, to safeguard privacy and to
protect the aesthetic assets of the City Chapter 17 80, Landscaping, requires the
applicant to provide on-site landscaping for all development proposals
The site is adjacent to properties that are compatibly zoned with the exception of
the property to the north Adjacent properties that are compatibly zoned require
that the perimeter of the site be landscaped with a Type II landscaping For the
property to the north that is zone R-14, High Density Residential, a 15' Type I
landscaping is require to provide a dense site barrier
Landscaping is also required in and around above ground stormwater facilities
A preliminary landscaping plan has been submitted that meets the intent of Chapter
17 80 A final landscape and irrigation plan must be submitted to the City for
review and approval Installation of landscaping IS required prior to occupancy

16 Environmental Review: After review of the environmental checklist and supporting
documents, a Determination of NonSignificance (DNS) was issued on August 11,
2000 The comment period expired on August 24, 2000 The DNS is attached as
Exhibit III
17 Public Comment. No public comment was received
18 Findings and Conclusion. Based on the project as proposed by the applicant and
the conditions of approval below, the staff finds that the project
1 Adequately provides for the public health, safety and general welfare and
for drainage ways, streets, potable water supplies, sanitary wastes, and
2. The project is in conformance with The Yelm-Thurston County Joint
Comprehensive Plan, the City Zoning Ordinance and the City's
Development Guidelines
D. Staff Recommendation
Based on the Analysis and Findings in Section C and the Conditions of Approval below, staff
recommends that the Planning Commission forward CUP-00-8258-YL to the City Council for
approval
Conditions of Approval,
Sewer
1 The property is located within the Killion North LID District. This property has been assessed
a total of 4 ERU's for a total of $7,292.60 The ERU fee of $2,480 (fee subject to change) is
payable at time of building permit issuance This fee is in addition to the LID assessment of
$1,823 15 which is paid on an annual basis for 15 years The total number of sewer ERU's
required for this project will be dependent on the proposed consumption calculations provided
with the civil plans The additional ERU's required for this project are based on discharge of
240 gallon per day and are charged at a current rate of $4,850/ERU

The S T E P System shall be designed to City standards The applicant shall submit final civil
plans to the Community Development Department for review and approval

Department for approval prior to final plat approval
Transportation
10 The applicant shall be responsible for half-street improvements along the frontage of Killion
Road The frontage improvements include lane improvements, curb, 12' sidewalk, street trees
and grates and storm drainage
11 The applicant shall be responsible for the Transportation Facility Charge of $5,100 00 and
payable at time of building permit.
Fire
12. The applicant shall submit fire flow calculations for existing hydrants All hydrants must meet
minimum City standards
13 The applicant shall submit a fire hydrant plan to the Community Development Department for

Landscaping
14 The landscape buffer along the northern property line shall be expanded to a minimum 15' in

Erosion Control Manual (DOE), Uniform Building Code, State Environmental Policy Act (SEPA) Title (14),
Road Design Standards, Platting and Subdivision Title (16), and the Shoreline Master Program.

Determination, Notice of Public Hearing and Notice of Final Decision If the proposed project requires a City
Council decision, it will be mailed to all those who participate in the public hearing and to anyone else
requesting the decision in writing Additionally, there will be a 14-day public comment period when the

Following is a list of the design review requirements and standards which the Edwards
House Assisted Living FaCility is required to meet, together with statements as to how

LA (1) Relate development to pedestrian oriented street frontage
a) The building will present a "pedestrian-oriented fa<;;ade" to the street using
the following methods
. This facility is being built to a residential scale and will complement
the residential development to the north of the site Therefore, the
windows are smaller than standard commercial window areas, but still
, comprise approximately 50% of the length of the ground floor fa<;;ade
. The building entry has a pedestrian pathway to the public sidewalk on
Killion Road
. The driveway to the facility is from Killion Road No other parking or
vehicle access will be located along the street frontage

b) The following pedestrian amenities will be provided near the sidewalk
~ Substantial lawn arld landscaping will be provided between the
building and Killion Road
. Pede;strian furniture will be provided near the walkway from the
building to the sidewalk.

This site is 2 7 acres and as such is not required to meet all guidelines for
developments over 5 acres However, convenient pedestrian circulation is'
provided, and a connection is made to the adjacent sidewalk - Once the

commercial site to the south develops, a pedestrian connection will be made to
that site At that time, the access from Killion Road may be closed and moved
so that access to the assisted living facility is from the commercial pite
Additionally, the drainage system will be incorporated into the landscaping to
create a park-like setting
I D (1) Reduce impact of service areas and mechanical equipment.
The dumpster will be screened and located away from the street and adjacent

handicapped access, and the Americans with Disabilities Act.

Adequate lighting, as required by the Non-Residential Energy Code, will be
provided at the building entries and all walkways
II A (3) Develop an on-site pedestrian circulation concept.
Safe internal pedestrian access is provided around the building, from the,
parking lot and to the sidewalk on Killion Road When thecomm~rcial site to
the south is developed, a walkway will be constructed to tie into that

neighboring property
II B (1) Provide a pedestriar: path at least 60" wide (preferably 96" wide) from the
street sidewalk to the main entry
A 60" pedestrian path from the street sidewalk to the main entry is provided
It will be raised above the vehicular pavement
II B (3) Provide pathways through parking lots.
The parking lot is not greater than 1S0-feet long' (measured parallel to the
street front) or more than 2 bays deep A pathway is therefore not required-
II C (1) Where street ROW is insufficient to provide adequate sidewalks, building and
other site features must be set back from the' public ROW to achieve at least
minimum sidewalk widths.

Street ROW for Killion Road is sufficientto provide adequate sidewalks This
project will construct frontage improvements along Killion Road, including a 12-
foot sidewalk consistent with City of Yelm "typical pedestrian-oriented street
section" Also, 10-foot additional ROW will be dedicated along Killion Road in
the northern portion of the property
'II C (2)' Where new streets are developed, provide sidewalks according to minimum
standards.
No new streets are being developed with this project However, a sidelll(alk will
be provided consistent with City of Yelm "typical pedestrian-oriented street

Intercity Transit serves the are(3 on Yelm Avenue, approximately 500 feet south
of the site A pedestrian walkway will be provided from the building to the
sidewalk on Killion Road A walkway will not be provided to the adjacent
multifamily use to the north, but when the commercial site to the south
develops, a connection will be made between the two properties

II D (2) Integrate nearby transit stops into the planning of adjacent site improvements.

Intercity Transit travels on Yelm Avenue, and is not expected to travel into the
site at this time A walkway is provided from the building's entrance to the
public sidewalk on Killion Road
II D (3) Encourage pedestrian paths from all transit stops through commercial areas to
re~idential areas within 1200 feet.
This facility will construct a sidewalk along Killion Road, which will provide
pedestrian access for the residents of the multifamily complex to the north of
the site
II E (1) Enhance building entry access.

A roof ~verhang at the main entrance will provide weather protection and
create a covered pedestrian open space of 384 square feet Landscaping will' be
provided on either side of the entry and in. the center of the traffic circle
III B (1) Minimize driveway impacts.
One driveway from Killion Road will serve the site. A traffic circle at the main
entrance to the building will allow one-way traffi<;., which will provide additional
safety for pedestrians
III C (1) Meet requirements for location of parking lots on pedestria'n-oriented streets.
The parking lot is located to the side of the building and does not occupy any of
the street frontage The parking lot will be designed with curbs and gutters to'
direct stormwater in accordance with City of Yelm Development Regulations

b) The parking lot will. be lighted to aJevel of at least 0 5 foot candle average
as measured on the ground Parking lot light fixtures will be non-glare
and mounted no more than 20 feet above the ground to minimize the
impact onto adjacent properties
c) Landscaped and pedestrian 'areas will be protected from encroachment by
parked cars by curbing on the pe'rimeter of the parking area
d) Markings and signs to meet ADA requirements will be installed
e) the parking lot is not greater than 150 feet long (measured parallel to the
street front) or more than two bays deep A pathway through the parking
lot is tnerefore not required

The building wHI employ the following elements or techniques toward achieving

Dear Cathie
Edwards House LLC is proposing to construct a 25,000 square foot assisted 'Iiving facility
on the west side of Killion Road (tax parcel 21724020494) Edwards House provides \
assisted living for people who need such a facility, including meals, lawndry, 24-hour
nursing care, etc It is anticipated that 16 people will work in the completed project split
amorig three shifts, andAO residential units will be provided The Yelm Municipal C?de
requires a minimum of 28 parking spaces (one for each two beds and one per employee
on a single shift) This is significantly above what Edwards House believes to be
adequate for their nee'ds, based on experience at similar facilities Section 17 72 090 of
the Yelm Municipal Code establishes guidelines for reducing the number of parking stalls
by a maximum of 25 percent In accor9ance with ~Iternative programs included in this
Section, we are requesting a reduction in required parking Granting. a 25% 'reduction
would decrea~e the number of requir~d parking stalls on site from 28 to 21 Edwards
House Assisted Living Facility is proposing 22 parking spaces, including two handicapped
stalls
Because th'is is an assisted living facility, it is not expected that any of the residents will
own automobiles or,,.therefore, require any parking spaces Staff will be on duty 24
hours a day, with a maximum of 8 employees scheduled at anyone time Intercity
Transit does not travel along Killion Road, but it serves a site on Yelm Avenue,
approximately 500 feet to the south It is anticipated that some staff and' visitors will
use this method of transportation to and from the site
Also, Edwards House provides vans to transport residents to and from activities,
appointments, etc This eliminates the need for residents to have their o~n vehicles, or
for others to drive to the site to take them on errands Most resideRts are able to get
out and about, but unable to drive A private vanpool operation is one of the alternative
programs listed that may be considered by the approval authority _
Edwards House LLC, has built several assisted Iivin9 projects, and based on that
experience fe~ls that 22 parking stalls are more than adequate to serve the residents,

Chapter 17 72. One stall for each two beds, plus one per employee based on the greatest
number of care employees on a single shift.
Two loading areas for buildings of 5,000 sq. ft. to 25,000 sq. ft. Loading areas shall be of
adequate size to accommodate a vehicle forty-five feet in length, twelve feet in width and
fourteen feet in height. This may be reduced to one loading area by City Staff after further
review of a complete site plan application.

Type I Landscaping - Property boundaries which are adjacent to residential zoning (north) require a 15'
Type I buffer (15').
Type II landscaping is used to provide visual separation of compatible uses. Type II landscaping is
required around the perimeter of a site, which has compatible zoning and adjacent to buildings to
provide visual separation of compatible use and soften the appearance of streets, parking areas and
building elevation.
Type III landscaping provides visual relief where clear sight is desired This landscaping includes street
trees and vegetation required with frontage improvements and landscaping to provide an attractive
setting and overstory canopy
Type IV landscaping is needed to provide visual relief and shade in parking areas.
Type V landscaping is required for all stormwater facilities.

Traffic: The City has recently adopted a Transportation Facility Charge (TFC) of $75000 per pm peak trip The
Ordinance provides a default table that the applicant can use to determine new pm trips generated
Assisted Care Facilities generates 0 17 new pm peak trips per dwelling
A Transportation Impact Analysis (TIA) is required if the project generates more than 20 vehicles in the
peak direction of the peak hour on the adjacent streets and intersections.
If the applicant feels the proposed use would not generate the default number of trips as designated in
the TFC Ordinance an analysis prepared by a licensed Transportation Engineer and can be submitted
to the City for review and consideration

Environmental checklist required for all buildings in excess of 4,000 sq ft. or more than 20
parking stalls associated with the building.

In addition the application packet should include building elevations and drawings which depict
the techniques used to satisfy guidelines from the Design Guidelines Manual (see page 54,
Design Guidelines)
A project of this size can expect completed review in approximately 10 - 12 weeks. Land use
approval is valid for 18 months and typically contains conditions of approval that the applicant
must complete prior to receiving a building permit.
Following land use approval the applicant is required to submit final civil drawings to the Public
Works Department for review and approval and satisfy all conditions of approval Upon
satisfactory completion of all conditions the applicant can submit building plans for approval
Optional Process
Binding Site Plan Review - Type III permit requires a public hearing and Planning Commission
approval
A project of this size can expect completed review in approximately 14 -16 weeks. The
advantage of using this approval process is that the approval is valid for 5 years.

The PublIc Works Department has the following comments relative to the
proposed SIte development located on KillIon Road.
WATER:
The proposed SIte would have to connect to the CIty'S water system. There
IS an eXIstmg 8" water lIne located on the west SIde of KIllIon Road. The
CIty would reqUIre running the existmg utilItIes up KillIon Road to the
north edge of the property lIne, There would also be reqUIrements to loop
the waterlIne, A latecomer's agreement may be establIshed to re-capture
some of the costs for mstallation of the waterlme.
Water ERU's (eqUIvalent reSIdential umts) are based on a consumption
rate of 240 gallons per day and are charged at a current rate of
$l,OOO/ERU (fee subject to change) inSIde city lImIts. Water calculatIOns
of proposed consumptIOn would need to be prOVIded to determme the
number of ERU's. Consumption will be momtored for six months to
determine If the correct number of ERU's were assessed, ThIS fee is
payable at tIme of bUIldmg permit Issuance.
IRRIGA nON METER.
An addItIonal water meter may be Installed for the purpose of ImgatIOn.
SEWER:
The proposed sIte IS currently not servIced by the CIty'S STEP sewer
system and would need to connect to the CIty'S system. There is a 6"
connection line available on West Yelm Avenue, There may be a
latecomer's agreement formed to re-capture some of these costs.
The proposed development is located within the Killion North LID
DIStriCt. Tlus property (3.91 acres) has been assessed a total of 4 ERU's
for a total of $7,292,60 The ERU fee of $2,480 (fee subject to change) IS
payable at time of buildmg permIt issuance, Tlus fee is m additIOn to the
LID assessment of $2,000, wluch is paId on an annual basIS for 15 years.
The total number of sewer ERU's required for this project would be
dependent on the proposed consumptIOn calculations provIded above.
DIscharge would be momtored for SIX months to determine if the correct
number of ERU's had been assessed, The addItional sewer ERU's
(eqUivalent resIdential umts) not related to the LID are based on dIscharge
of 240 gallons per day and are charged at a current rate of $4,850IERU
FIRE:
Fire protection to the bUIldmgs must be provided per the Umform Fire
Code. Review of CIVIl plans Will determine appropnate placement of
hydrants.
STORM DRAINAGE:
If the proposed development IS over 5,000 square feet of impervIous
surface there are stormwater treatment requirements per the D O.E.
Stormwater Manual.
STREET FRONTAGE:
Frontage improvements are reqUired for thIS project. Frontage
Improvements shall be consIstent With the section "typical pedestrian
oriented street section" as well as "commercial collector" per the City of
Yelm's Development Guidelmes (attached).
STREET LIGHTING:
Per the City of Yelm' s "Development Guidelmes"
ADA REQUIREMENTS:
ReqUIrements will be determined upon review of civil plans.
OTHER:
