Staft Recommendation and Analysis
Staff recommends the City Council approve the vacation of Stevens Street, between Solberg Road
and Longmire Road subject to preliminary plat approval of Longmire Meadows SUB-00-8265-YL
as forwarded by the Planning Commission
At this location the Stevens Street unopened right-of-way is only one block and is bound on the
east end by School District property and on the west by a residence As shown on the enclosed
aerial map Stevens Street between Cullens Rd and Longmire Street is encumbered with buildings
and under current conditions could not be opened The portion of Stevens Street proposed to be
dedicated lies between Solberg Street and Longmire St. is unencumbered at this time
Because this area is constrained by adjacent uses and geography, if a street was constructed on
the one block of Stevens Street proposed for vacation, it would not increase the efficiency of
automobile movement in the immediate or surrounding neighborhoods now or in the future The
City s Transportation Plan does not identify the opening of this block of right-of-way as a short or
long term need
In accordance with RCW 35 79, the City Council can require that the abutting propetiy owners
compensate the city in an amount which does not exceed one-half the appraised value of the area
vacated Staff does not recommend compensation in this particular situation because of street
Improvements to Solberg, Longmire Coates and \/anTrump Streets that will be required by the
project developer as a condition of the preliminary plat currently in the City's review process
Planning Commission Review
The Planning Commission reviewed the petition and recommends the City Council approve the
petition to vacate the right-of-way contingent upon a preliminary plat approval of Longmire
Meadows, SUB-OO-8265- YL that incorporates the vacated right-of-way
There was significant discussion and concern by the Planning Commission Issues of concern
included

Vacating the right-of-way seems inconsistent with the City's policy on connecting
streets when possible,
The value of the vacation to the adjacent property owners, and
That the right-of-way dedication occur because of a project proposal verses simply
reverting back to adjacent property owners
City Council Action
The City Council may approved the petition to vacate as forwarded by the Planning Commission,
approve the petition as modified by the City Council, refer the petition back to the Planning
Commission for further review or deny the petition
After action by the Council staff will prepare an ordinance consistent with the Council's action

This letter is a request from the undersigned owners to the City of Yelm to vacate
an unimproved portion of Stevens Street in the City ofYelm that abuts their property
Attached to this request are the legal descriptions of the two parcels of property which
we own Also attached is a Thurston County Assessor's map of the two.parcels we
own and Stevens Street right of way that we are requesting to be vacated The
property we own abuts seventy five percent (75%) of the Stevens Street right of way
that we are requesting be vacated
We have entered into a purchase and Sale Agreement with Robert A. Bussey
and CarlOT eitge to purchase our parcels of property They are in the process of
preparing a Preliminary Plat Application for our two parcels of property In that process
it became c1pparent that Stevens Street dead ends at the middle school on the east and
on the west does not continue A house is constructed on Longmire Street in what
would be the westerly right of way extension of Stevens Street. We believe that the plat
can be served better by the existing right of ways of Coates, Solberg, Van Trump and
Longmire Streets These right of ways would be improved to city standards. The city
would not have the additional maintenance expense for a new Stevens Street.

Staff Recommendation
Staff recommends the City Council approve Resolution No 408 which sets a public hearing date
of January 10, 2001, to consider the petition to vacate the Stevens Street right-of-way between
Solberg Street and Longmire Street.
Background
The City received a petition, signed by 2/3 of the abutting property owners, to vacate the Stevens
Street right-of-way between Solberg Street and Longmire Street. RCW 35 79 requires the City
Council set a public hearing date, by Resolution, to consider the petition The attached Resolution
No 408, sets a public hearing date for January 10, 2001
Prior to the close of the public hearing, Chapter 16 14, requires the petition be referred to the
Planning Commission for review and comment. The petition is scheduled for their review on
December 18, 2000
If at the close of the public hearing, the City Council determines to grant said petition, the staff will
prepare an ordinance authorizing the vacation The Council may require the adjacent property
owners to compensate the City in an amount which does not exceed one-half the appraised value
of the area vacated

This letter IS a request from the undersigned owners to the City of Yelm to vacate
an unimproved portion of Stevens Street in the City of Yelm that abuts their property
Attached to this request are the legal descriptions of the two parcels of property which
we own Also attached is a Thurston County Assessor's map of the two.parcels we
own and Stevens Street right of way that we are requesting to be vacated The
property we own abuts seventy five percent (75%) of the Stevens Street right of way
that we are requesting be vacated
We have entered into a purchase and Sale Agreement with Robert A. Bussey
and Carl D Teltge to purchase our parcels of property They are in the process of
preparing a Preliminary Plat Application for our two parcels of property In that process
it became apparent that Stevens Street dead ends at the middle school on the east and
on the west does not continue A house IS constructed on Longmire Street In what
would be the westerly right of way extension of Stevens Street. We believe that the plat
can be served better by the existing right of ways of Coates, Solberg, Van Trump and
Longmire Streets These right of ways would be improved to City standards The City
would not have the additional maintenance expense for a new Stevens Street.

Staff Analysis
At this location the Stevens Street unopened right-of-way is only one block and is bound on the
east end by School Distnct property and on the west by a residence As shown on the enclosed
aerial map Stevens Street between Cullens Rd and Longmire Street is encumbered with buildings
and under current conditions could not be opened The portion of Stevens Street proposed to be
dedicated lies between Solberg Street and Longmire St. is unencumbered at this time
If a street was constructed on the one block of Stevens Street proposed for vacation it would not
increase the efficiency of automobile movement in the immediate or surrounding neighborhoods
'rhe City s Transportation Plan does not Identify the opening of this block of right-of-way as a short
or long term need

Stevens Street right-of-way between Longmire Street and Solberg Street.

PROJECT LOCATION Unimprovement Stevens Street between Solberg Street and
Longmire Street.
The City Council will hold a public hearing to receive comments on the proposed right-of-way
vacation At the close of the hearing the City Council will likely act upon the petition.
Testimony may be given at the hearing or through any written comments on the proposal,
and must be received by the close of the public hearing on January 10, 2001 Such written

This letter is a request from the undersigned owners to the City of Yelm to vacate
an unimproved portion of Stevens Street in the City of Yelm that abuts their property
Attached to this request are the legal descriptions of the two parcels of property which
we own Also attached is a Thurston County Assessor's map of the two parcels we
own and Stevens Street right of way that we are requesting to be vacated The

on the west does not continue A house is constructed on Longmire Street in what
would be the westerly right of way extension of Stevens Street We believe that the plat
can be served better by the existing right of ways of Coates, Solberg, Van Trump and
Longmire Streets These right of ways would be improved to city standards The city
would not have the additional maintenance expense for a new Stevens Street.

This letter IS a request from the undersigned owners to the City of Yelm to vacate
an ummproved portion of Stevens Street In the City of Yelm that abuts their property
Attached to this request are the legal descnptlons of the two parcels of property which
we own Also attached IS a Thurston County Assessor's map of the two parcels we
own and Stevens Street right of way that we are requesting to be vacated The

AND NOTICE OF HEARING
A RESOLUTION IDENTIFYING PROPERTY AND ESTABLISHING A
PUBLIC HEARING DATE TO CONSIDER THE VACATION OF AN ALLEY
RUNNING NORTH AND SOUTH AND LOCATED ON THE WEST SIDE OF
FIRST STREET SOUTH BETWEEN YELM AVENUE AND WASHINGTON
STREET.
WHEREAS, the owners of the above described property have
petitioned the City to vacate the alley lying between Lots 1 and 2,
and the Northeasterly half of Lots 3 and 4 of McKenzie's First
Addition to Yelm, as recorded in volume 8 of Plats, Page 26; and
WHEREAS, a past City Council action indicates the intent of
the City to vacate this alley;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON,
DOES RESOLVE AS FOLLOWS:
Section 1. Vacation of the following describe property has been
requested:
That portion of the alley lying between Lots 1 and 2, and
the Northeasterly half of Lots 3 and 4 of block 2 in
McKenzie's First Addition to Yelm as recorded in Volume
8 of Plats, Page 26, in Thurston County, Washington and
lying between the westerly line of First Street and the
easterly line of the Northern Pacific Railroad Company
right-of-way.
Section 2. A public hearing to consider vacation of said alley
shall be held as part of the regular City Council meeting scheduled
for 7:30 pm, August 9, 1995, in Council Chambers at Yelm City Hall,
105 Yelm Avenue West, Yelm, Washington. written comments or
objections of any abutting property owners shall be addressed to
the City Clerk's Office, PO Box 479, Yelm, WA 98597.
ADOPTED by the City Council of the City of Yelm, Washington, and
APPROVED by its Mayor, at a regularly scheduled open public meeting
thereof this 27th day of June, 1992.

ORDINANCE NO ~
AN ORDINANCE VACATING THAT ALLEY IN BLOCK EIGHT OF McKENZIE'S
SECOND ADDITION TO YELM AND TRANSFERRING TITLE TO SUCH PROPERTY
ACCORDINGLY
\
WHEREAS, a petition has been filed bearing the signatures of the
owners of more than two-thirds of the property abutting on the
alley described below;
WHEREAS, the Yelm City Council has held a duly-noticed public
hearing regarding such request:
WHEREAS, the Yelm Planning Commission has recommended and the
Council finds that such vacation would be in the public interest
and therefore the request should be granted; and
WHEREAS, the Council has determined that it is in the public
interest to retain an easement for public and private utilities
along and over such alley
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM DOES ORDAIN
AS FOLLOWS:
Section 1 That the alley extending from Third Street to Fourth
Street as platted within Block 8 of McKenzie's Second Addition to
Yelm and dedicated on November 21, 1916, being ten-feet in width,
is hereby vacated; provided, however, that the City does hereby
retain a utility easement below, upon, and above said property
including the right to exercise and grant easements for the
construction, repair, and maintenance of public and private
utilities and services to the full extent heretofore possessed by
the City
Section 2 That title to said alley shall vest in the owners as
of this date of the abutting properties, one-half to each
Section 3 That a copy of this Ordinance shall be recorded by the
City Clerk with the Auditor of Thurston County
be effect ive on December 30, 1992,
