Box 757 Yelm, WA 98597 Proposal: The applicant is applying for a Special Use Permit to construct a 6,000 square foot Senior Multipurpose Center within the city limits of Yelm. The project will occur in two phases, with approximately 3,000 square feet being built at this time. The project is being reviewed in its entirety to assure that when the Senior Center is ready to complete their second phase of construction, all approvals shall be in place. Public Notice of the date and time of the Public Nearing was posted on the project site, mailed to property owners within 300 feet of the project site on September 16, 2003, and advertised in the local newspaper on September 19, 2003. The City has performed an environmental review, to include SEPA and NEPA, and issued a Finding of No Significant Impact on August 22, 2003, with a comment deadline of September 5, 2003, and an appeal deadline of September 12, 2003. Summary: Staff recommends approval of the proposal, subject to the conditions listed in this report. DEPARTiY1ENT ANALYSIS AND FINDINGS: 1. Public Notice: Notice of the public hearing was published in the Nisqually Valley Ne~r~s on Friday, September 19, 2003, and posted in public areas on Wednesday. September 17, 2003. The notice was mailed to adjacent property owners, and the applicant on September 17, 2003. The City of Ye6n is nn Equnl Opportunity Providn~ 2. Existing Land Use and Zoning. Finding: The site is zoned Moderate Density Residential, (R-6), YMC Chapter 17.15. In the R-6 zone, Special Uses are allowed as provided for in Chapter 17.66, Special Uses. Conclusion: A Senior citizen center is classified as a special use and is allowed in any zoning district provided any unique impacts resulting from the proposal can be mitigated. 3. Lot Size and Setbacks: Finding: This property was used residential in the past, however at this time, the property is vacant. There is located on site an uninhabitable mobile home, and a dilapidated water tower. In April 2003 the Washington State Office of Archaeology and Historic Preservation deemed that the water tower was not eligible for the National Register of Historic Places, and the City does not have the water tower listed as an historic site. Both the mobile home and water tower will be demolished and removed from the site. The R-6 zone does not have a minimum lot size requirement, however all buildings must meet required setbacks. The setbacks for the R-6 zone are; a minimum of 5-feet on side yards with a minimum total of both sides 12-feet, 25-feet on rear yards, and front yards 15-feet with a minimum of 20-foot driveway approach. The maximum height of buildings shall be 35 feet. Conclusion: The proposal meets current minimum setbacks and lot size requirements. 4. Adjacent Land Uses and Zoning. Finding: The property to the north is zoned OS, Open Space/Institutional District, and is developed as an elementary School. The properties to the east, and southeast are zoned RR 1/5, are in residential use, and are not within City Limits. The properties to the southwest are zoned C-2, Heavy Commercial to include residential apartments, and a plumbing business. The property to the west is zoned C-1 Commercial, and is improved as a church site. Conclusion: There is a mixture of uses of the surrounding properties. Where there are residential uses, a 15-foot dense landscape buffer will be required. This is reflected in the landscaping section. Perimeter site landscaping, Yelm Creek, or 103rd Avenue will separate the other commercial uses. 5. Environmental and Shoreline. Finding: The applicant is constructing this facility and site improvements with funds received through a Community Development Block Grant. This funding source requires projects to perform both a State Environmental Policy Act (SEPA) environmental review and a R.,Pmjccl Pilcs'CUP CnnditinnUl Usc PermitAR3}o Scninr Ccntcr,l Hearin, Pxnm incr Staff Rcpnrt.doc Page 2 of 9 National Environmental Policy Act (NEPA) environmental review. Findin The project site is bisected in the southwest corner by Yelm Creek, which is listed as a Shoreline of the State. Findin All of the site improvements are situated outside of the Shoreline Jurisdiction area, and the shoreline jurisdiction area will be left undisturbed and in its natural state. Finding: All of the site improvements are situated outside of wetland buffers and flood zones. Wetland and wetland buffer areas will be left undisturbed in and their natural state. No construction or fill will be placed in flood zone areas. Finding: The applicant is required to extend a City sewer service line along the frontage of their property, which requires a conduit crossing under an existing bridge over Yelm Creek. Conclusion: The City has performed an environmental review, issuing a Finding of No Significant Impact. The project is outside of the Shoreline Jurisdiction area, and does not require a shoreline substantial development permit. The project meets wetland buffer requirements. The project will not construct or place any fill in flood zone areas. The sewer line bridge conduit crossing was reviewed in the SEPA/NEPA environmental review, and deemed to create no impact. The sewer line bridge conduit crossing is exempt from Hydraulic Project Approval, Section 220-110-100 WAC. The sewer line bridge conduit crossing is exempt from Shoreline Management, Section 173-27- 040(2)(b) WAC. 6. Transportation and Site Access. Findin Yelm is a small compact community most directly affected by two state highways which bisect the community. The two state highways are used by local residents for transportation throughout the city and for access to commercial and residential areas throughout the community. New developments do in fact burden the city's central streets, and unless the bypass alternatives are accomplished, the City would have to require developers to pay the cost of the internal street widening. The city plans show, and the City finds that adequate facilities will be accomplished better and in a timely fashion by bypass facilities as a substitute for the widening of existing facilities. As a result, the City finds that the regional plans benefit projects in all areas of the City and will accomplish the goal of providing adequate facilities to City standards within a reasonable time to serve the demands created by the proposed project. Finding: The project fronts on 103'd. Avenue, east of Creek Street. This portion of 103`d Avenue is listed as a Local Access Residential street in the City of Yelm Development Guidelines. Finding: The City of Yelm 2001 Comprehensive Transportation Plan Update lists Goals and Policies relating to transportation impacts. #30. Funding Sources Policy provides methods for financing transportation projects, and includes a policy that "requires impact mitigation payments, or seek voluntary contributions from developers". Finding: The City of Yelm Concurrency Management Code also describes mitigation measures for impacts to the City's transportation system by requiring the project to make a contribution to the facilities identified in off-site comprehensive transportation plan, in the form of a transportation facility charge. The ordinance lists new trip rates for land uses. If the ordinance does not list the proposed use, the City refers to the Institute of Transportation Engineers Manual, 5`h Edition, (ITE). The ITE manual also did not list a senior center. After researching this manual, it was determined that the closest use is a "Recreational Facility" (495). The ITE manual states that a recreational facility creates 1.75 new pm peak trips, per 1,000 square feet. To determine the projects impact and fee, the City uses a formula based on square footage for the use proposed. Using this formula, the number of new pm peak trips generated by a 6,000 square foot Senior Center is 10.5. The Transportation Facility Charge is currently $750.00 per new pm peak trip, and is payable at building permit issuance. The Transportation Facility Charge will be based on the square feet being constructed. Findin Chapter 15.40 Concurrency Management provides for mitigation measures for impacts to the City's transportation system. Chapter 15.40.020(5)(x) states that "The project makes on-site, and frontage improvements, consistent with City standard for utilities, curbs, gutters, sidewalks, bicycle lanes where appropriate, and roads necessary to serve the proposed project consistent with safety and public interest. Conclusion: The construction of this project will create impacts to the existing traffic system. The City of Yelm has created mitigation measures through its Municipal Code, Comprehensive Transportation Plan, and Development Guidelines. 7. Parking. Finding: Chapter 17.72, Off-Street Parking and Loading provide guidelines for parking requirements. Chapter 17.72 does not list a senior center as specific use; it does however provide guidelines for places of assembly without fixed seats. This use was determined to be the closest to a senior center. This type of occupancy requires 1 stall for each 10 occupants. Fora 6,000 square foot facility, a maximum occupancy is approximately 400, which requires forty (40) parking stalls. Findin Chapter 17.72, Off-Street Parking states; The requirements for off-street parking and loading facilities and their design shall be regarded as the minimum; however, the owner, developer, or operator of the premises for which the parking facilities are intended shall be responsible for providing adequate amounts and arrangement of space for the particular premises, even though such space is in excess of the minimum set forth in this chapter. Findin The facility has it's own transportation van to transport some seniors to and from the center. Chapter 17.72.090, Incentives for reducing the number of parking stalls, allows fora 25% reduction in parking stall requirements when a private vanpool operation is provided by the development. Conclusion: Off-street parking shall be provided on site. Number of stalls may be reduced by 25%. 8. Water Supply. Findin The City's Water Comprehensive Plan identifies a portion of the City area for service. The City is pursuing additional land areas for approval and the extension of facilities. Completion of such activities is dependent on grant and developer funding, as well as planned bonding and existing public funds. The status of such plans and funding sources must be considered in any review of concurrency. Developer extensions and or dedications, latecomer agreements, oversizing agreements, and the creation of local improvement districts may all be considered. One connection is based on a consumption rate of 240 gallons per day. This connection is referred to as an "ERU". Conclusion: The proposed development to this site creates an impact on the City's water system. 9. Uncontrolled and untreated stormwater runoff can create health and safety hazards. YMC requires all development to comply with the adopted City Stormwater Manual. 11. Fire Finding: Fire protection to the buildings must be provided per the Uniform Fire Code. Requirements for installation of fire hydrants, fire lanes, or sprinkler systems will be determined in civil plan, and building permit review. Findin Landscaping and screening are necessary to promote safety, to provide screening between compatible land uses, to safeguard privacy and to protect the aesthetic assets of the City. YMC, Chapter 17.80 requires all development to provide on site landscaping. Findin YMC 17.80.030(6) states; Whenever a nonresidential activity is proposed adjacent to a residential use, a minimum 15-foot buffer area of Type I landscaping shall be provided along the property boundary between the uses. Findin YMC, Development Guidelines, and Design Guidelines provide regulations regarding street trees, parking lot landscaping, perimeter and interior landscaping. YMC Chapter 17.80 describes the different landscaping regulations by "Type". 13. Refuse: Finding: The City of Yelm Design Guidelines provides guidance for the placement and screening of service areas. Design Guidelines I.D.(1)(b) states; When service elements are visible from the sidewalk, or adjacent properties, the elements must be screened. A six-foot wall or fence shall enclose any outdoor refuse collection point. The fence shall be a solid material such as wood or masonry. Staff Analvsis and Conclusion. Based on the conceptual plan as proposed by the applicant, the analysis and findings above, and the conditions described below, staff finds that the project: Adequately provides for the public health, safety and general welfare, and for drainage ways, streets, potable water supplies, sanitary wastes; and The project is in conformance with The Yelm-Thurston County Joint Comprehensive Plan, the City Zoning Ordinance, the City's Development and Design Guidelines, and the Shoreline Management Act. The legal effect of the certification is that upon its approval, City of Yelm may use the Block Grant funds, and CTED will have satisfied its responsibilities under the National Environmental Policy Act of 1969. CTED will accept an objection to its approval only if it is on one of the following issues: a) that the certification was not in fact executed by the certifying officer or other officer of applicant approved by CTED; or b) that applicant's environmental review record for the project indicates omission of a required decision-finding or step applicable to the project in the environmental review process. There is an existing 6" water line located on 103`d Ave SE. Water ERU's (equivalent residential units) are based on a consumption rate of 240 gallons per day and are charged at a rate of $1,500/ERU (fee subject to change) inside city limits. The project civil engineer will need to submit water usage calculations to the Community Development Department. These calculations will be used to determine the fees and ERU's required for the project. It is the project civil engineer's responsibility to verify that this existing 6" watermain will supply adequate flow to meet the fire flow requirement and domestic water use. Irrigation Meter: An irrigation meter may be installed for the purpose of irrigation. A backflow prevention device will be required for all landscape irrigation connections. The proposed site will be required to connect to the City's sewer system. There is a 4" line available at the intersection of 103`d Ave and Creek St. Your project will be required to extend the sewer line from the intersection a crossed your parcels frontage. This project will be required to install a step sewer tank and possibly a pump tank. This system will be designed and submitted to the City of Yelm for approval by a civil engineer licensed in the state of Washington. Sewer hook-ups are based on a consumption rate of 240 gallons per day (ERU) and are charged at a rate of $4,986 per 240 gpd (fee subject to change) inside city limits. This is a one-time connection fee. A sewer installation inspection fee is also required. The inspection fee is $145.00 per an ERU. At the time of application submittal you will be required to submit sewer usage calculations provided by a licensed civil engineer or the City may consider another method for the calculations. The sewer connection fee will be assessed using the calculations provided. There will be requirements for installation of fire hydrants, fire truck access and fire truck turn-around. These will be determined upon further review of the architectural and civil plans. If the proposed improvement is over 5,000 square feet of impervious surface there are Stormwater treatment requirements per the D.O.E. Stormwater Manual. At the time of Site Plan Review submittal a Preliminary Stormwater Plan and report will be required. Street Improvements: Frontage improvements shall be consistent with Yelm's Development Guidelines. Your project will be required to improve the frontage alone 103rtl Ave. This section shall be designed as a Commercial Collector as adopted by the City of Yelm's Development Guidelines. This will require widening the roadway, curb and~qutters, planter islands, street trees and street lighting. ~~r~ The interior drive isle and parking shall be consistent with the city's parking details located in the development guidelines. Street Lighting: Street lighting shall be installed as required in the City of Yelm's "Development Guidelines". The street lighting plans shall be submitted to the City of Yelm for review and approval. The on-site parking lot lighting will be reviewed at the time of civil engineering plan review. ADA Requirements: The American Disabilities Act requires the facilities are ADA accessible. Facility improvements will have to meet current code. Proponent: Yelm Senior Center Representative: Fran Sherrill Project Proposal: Demolish existing buildings and construct a new 12,480 sq. ft. senior center Project Location: 103rd Street -Pratt Property Zoning: Moderate Density Residential, R-6 with Special Use overlay Senior Center is considered a special use in this district. Minimum Lot Size -none Setbacks: Front yard - 15' from R-O-W for the building and 20' for the garage Rear Yard - 25' Side yard - 5'/7' (special use may require a larger setback) Parking/ Loading: Chapter 17.72. One stall for each ten occupants, based on the maximum occupant load per the Uniform Building Code. Two loading areas for buildings of 5,000 sq. ft. to 25,000 sq. ft. Loading areas shall be of adequate size to accommodate a vehicle forty-five feet in length, twelve feet in width and fourteen feet in height. This may be reduced to one loading area by City Staff after further review of a complete special use application. Landscaping: Chapter 17.80, Type I, II, III, IV and V. Type (Landscaping -Property boundaries which are adjacent to residential zoning (north and east) require a 15' Type I buffer (15'). Type II landscaping is used to provide visual separation of compatible uses. Type II landscaping is required around the perimeter of a site, which has compatible zoning and adjacent to buildings to provide visual separation of compatible use and soften the appearance of streets, parking areas and building elevation. Type III landscaping provides visual relief where clear sight is desired. This landscaping includes street trees and vegetation required with frontage improvements and landscaping to provide an attractive setting and overstory canopy. Type IV landscaping is needed to provide visual relief and shade in parking areas. Type V landscaping is required for all stormwater facilities. A conceptual landscaping plan is required with application for Special Use Permit. Final landscaping and irrigation plan required as element of civil construction drawings. Traffic: The City has adopted a Transportation Facility Charge (TFC) of $750.00 per pm peak trip. The Ordinance determines the number of new traffic based on the ITE Manual. The closest category for the senior center is Recreational Community Center (495). The p.m peak hour trip generation is 2.31 new trips for every 1000 sq. tt. This may be high due to the nature of your members. # of new trips for every 1000 sq. ft. 2.31 Gross sq. ft. Divided by 1.000 x 12 New p.m. beak hour trios 28 (27.72) # of new p.m. Peak hour trips 28 TFC per trip x $750.00 Total TFC $21,000.00 A Transportation Impact Analysis (TIA) is required if the project generates more than 20 vehicles in the peak direction of the peak hour on the adjacent streets and intersections. If the applicant feels the proposed use would not generate the default number of trips as designated in the TFC Ordinance an analysis prepared by a licensed Transportation Engineer and can be submitted to the City for review and consideration. Critical Areas: The site contains Yelm Creek, a Shoreline of the State and designated flood plains. To retain the R-6 zone all development must occur outside of the 100 year flood plain and the shoreline of Yelm Creek. In addition there may be some wetlands associated with the flood plain and/or Yelm Creek. SEPA: Environmental checklist is required. The applicant will need to have the Shoreline, 100 year flood plain and any wetlands surveyed. This information will need to accompany the environmental checklist. Other: Tree and Vegetation Preservation Plan OAPCA and City require demolition permits Thurston County Health Department -review required if any wells or septic systems are on the site or located within 100 feet of the project site. Application and Process: Special Use, Chapter 17.66, with environmental checklist is aquasi-judicial processes and will require a public hearing with the Planning Commission with project approval by the City Council. Minimum application requirements are listed on the respective application form. Land use review for a special use takes approximately 12 - 14 weeks. Land use approval typically contains conditions of approval that the applicant must complete prior to receiving a building permit. Following land use approval the applicant is required to submit final civil drawings to the Community Development Department for review and approval and satisfy all conditions of approval. Upon satisfactory completion of all conditions the applicant can submit building plans for approval. -~ ~~ ~. The property is connected to the 8" water line located on 103rd Water ERU's (equivalent residential units) are based on a consumption rate of 240 gallons per day and are charged at a rate of $1,000/ERU (fee subject to change) inside city limits. Water calculations will need to be provided by the project engineer to determine how many ERU's would apply to this project. There will be a credit of one ERU to this project for the existing water connection. IRRIGATION METER: An irrigation meter maybe installed for the purpose of irrigation. SEWER: The proposed site is currently not served by the City's STEP sewer system and currently there is not a connection point available within a 200 foot radius that would require connecting to the City's system. However, per a letter dated April 5, 1999 from Ken Garmann, the owner may install a sewer force main down the same easement as the chlorine contact line and across the property frontage. Sewer ERU's (equivalent residential units) are based on discharge of 240 gallons per day, and are currently charged at rate of $4,850/ERU (fee subject to change). Additionally, there is an inspection fee in the amount of $145.00 / ERU. The improvement includes a chlorine contact line required by the State Department of Health and a 10-inch water main extension to connect with 103`a Street. The purpose of the line extension is to insure future water service capabilities and fire-flow to meet state standards. The City is asking For a easement (see attached map) to install the water system improvements of approximately 30 feet of which 20 of those feet will be on an existing Puget Sound Energy power line easement. The net result will be 10 feet of new easement, which will principally consist of future setbacks when the property is developed. The benefit to your property will be completed water utilities that will not have to be installed or upgraded at the time your property develops. Additionally, you may re-call, the City agreed you could run a sewer force main along this route for future sewer service when the property develops.
