Dear Mr. Birkland: This letter is in response to your request for clarification of the bonding requirements. In a letter dated November 19, 2001 it was stated that two bonds would be required for the above referenced project. Bond number 1 is to be for all improvements needed prior to certificate of occupancy being awarded for the larger building. The City of Yelm Development Guidelines page 3-22 states "Prior to commencement of the work under a permit granted pursuant to this chapter, the permittee or the contractor for the permittee shall post with the city a bond with surety qualified to do a bonding business in this state...". It is staff's interpretation of the city councils phasing decision that we will not require bond number 1 to be posted at this time. However all work will need to be completed for this phase prior to the Certificate of Occupancy being awarded for the use of the larger building. The second bond will be required to be posted before the Certificate of Occupancy will be awarded. This bond will be for the remainder of the deferral agreement and phasing plan as approved by the city council. These amounts correspond to the improvement phasing requested per your letter dated September 25, 2001 and the Notice of Final Decision from the City of Yelm dated October 31,2001. I will reference the numbered items from the City's letter dated October 31, 2001. This information is only in regards to the requirement of the bonds. These amounts do not reflect additional permits and approvals required by the city. 1. No bond required for this part of the phasing plan. 2. A bond in the amount of $113,850.00 is required for these improvements. When calculating this amount I included the complete storm drainage facility. It appears that you will need to construct the pond at this time to control the runoff from the two smaller parking lots. The construction amount is $75,900.00. The city is required to increase this amount by 150 percent. 3. A bond is required in the amount of $199,650.00 for the remaining improvements. The City Council approved the following phasing plan: The School District can use the smaller of the two existing buildings prior to any infrastructure improvements required in the Conditional Use Permit. This approval does not exempt you from any other City permits required prior to occupancy. 2. Prior to the use of the larger building for the extension school the School District is required to construct the parking area behind (west) of the smaller building and the parking area on the northwest corner of Jefferson Street and First Street.. These improvements will require the construction of associated storm water facilities and landscaping and any street improvements necessary to utilize the two parking areas. The number of parking spaces to be constructed is to be determined by the actual occupancy of the buildings. 3. All remaining infrastructure improvements required as conditions of the Conditional Use Permit shall be completed prior to October 1, 2004. 4. All improvements not completed must be bonded to guarantee the performance of the work. Approval of the phased plan will require the School District to bond for all street improvements. Background The City Council approved a Special Use Permit for school facilities located 103 and 107 First Street on September 12, 2001. Two conditions of approval for the permit required the School District to submit a 3 year phased schedule for improvements to the City Council for approval and to bond for any road improvements not completed prior to occupancy. City Council Action The City Council may approve the phased plan as submitted and require the applicant to bond for all street improvements, require the applicant to provide a revised phasing plan with a bond for street improvements not completed prior to occupancy or deny the phasing plan. After review of the Planning Commission's recommendation, public hearing comments and the staff report dated August 13, 2001, the City Council finds that the project, as conditioned below, to be consistent with the Yelrn Comprehensive Plan and all applicable City policy and development standards. Pursuant to Chapter 15.49, Integrated Project Review Process, a Conditional Use Permit is a Type IV Permit and can be appealed in Superior Court as set forth in RCW 36.70C JUDICIAL REVIEW OP LAND USE DECISION. As a result of the approved land use for the parcel, the affected property owners may request a change in property tax valuation from the Thurston County Tax Assessor's Office. Conditions of Approval. The project is approved for all customary school activities for a maxir7um of 181 full #ime students and 19 staff members. Enclosed is the approved site plan. The project 9s subject to the foilowirg conditions of approval: Sewer 1. The applicart shall submit sewer usage calculations to the Community Development Department. The required calculations shall be from a professional engineer licensed in the state of Washington. These calculations shall be submitted with the civil engineering plans to the Community Development Department for review and approval. 2. Currently this site has an existing connection of 240 gallons a day. If your use is greater than the current use the applicant will have to pay an additional sewer connection fee. Sewer connection fees are charged at the current rate of 54,850 per connection, (fee subject to change) payable at building permit issuance. Each connection is considered 240 gallons Mr. Erling Birkland September 17, 2001 Page 2 of 4 per day. All connections require an inspection, with a fee of $145.00 per a connection, also payable at building permit issuance. If required, these fees will be assessed at building permit issuance and will be based on the submitted sewer calculations. Water 3. The applicant shall submit water usage calculations to the Community Development Department. The required calculations shall be from a professional engineer licensed in the state of Washington. These calculations shall be submitted with the civil engineering plans to the Community Development Department for review and approval. 4. Currently this site has an existing connection of 240 gallons a day. If your use is greater than this use the applicant will have to pay an additional water connection fee. Water connection fees are charged at the current rate of $1,000 per 240 gallons of use (fee subject to change) payable at building permit issuance. If required, these fees will be assessed at building permit issuance and will be based on the submitted sewer calculations. 5. All landscape and planting strips shall have an irrigation system with a separate water meter. The applicant shall submit final civil plans to the Community Development Department for review and approval. stormwater 6. The applicant shall design and construct all storm water facilities in accordance with the DOE Storm Water Manual, as adopted by the City of Yelm. Best Management Practices (BMP=s) are required during construction. The applicant shall compile a final storm water report along with construction drawings. 7. The applicant shall submit a storm water operation and maintenance plan to the Community Development Department for approval prior to final plat approval. 8. The stormwater system shall be maintained by the building owner. The Agreement shall include provisions for the assessment of fees against the owner for the maintenance and repair of the stormwater facilities. Transportation 9. The applicant shall be responsible for full-street improvements along Jefferson Street, between First Street and Second Street and half-street improvements along Second Street. The frontage improvements shall be consistent with a Neighborhood Commercial Collector. School District financing and budget cycle may prohibit the completed road improvements prior to occupancy. If this should occur the school district shall bond for said improvements. 10. The applicant shall establish a schedule with the City for the 3-year phased completion of improvements for streets, parking, stormwater facilities and associated landscaping with these improvements. This schedule shall be submitted to City Council for approval prior to October 23, 2001. 11. The vacant lots on the northwest corner of Jefferson Street and Second Street will be Page 2 of 4 Mr. Erling Birkland September 17, 2001 Page 3 of 4 utilized as the above ground stormwater facilities. The City will not require full frontage improvements along this area, but will require the construction of adequate shoulders. 12. The applicant shall be responsible for the Transportation Facility Charge of $5,430.00, payable at time of building permit. 13. If the future, the School District provides bus service to the site, they shall submit plans for approval by the City. Said plans may include but are not limited to, circulation, drop off and pick up areas, access and parking. Parking 14. The applicant shall improve the existing parking areas to include access control, landscaping and stormwater management. 15. Tami Merriman presented an overview of the staff report, noting that the Yelm Planning Commission (YPC) conducted a public hearing on the project in August. Discussion at that meeting concerned the applicants request for a variance from "road continuation" requirements. The applicant did agree to and provided a revision showing one of the two cul-de-sacs extending to the north. Signs identifying this as a future extension will be posted. That proposal was accepted by staff and the YPC. A second discussion item concerned the applicants request to channel stormwater runoff from roofs directly to the stormwater facility instead of to City Council Minutes Page 1 of 6 ab/cc/2001 Minutes/9-12-01 individual drywells. The YPC deferred this decision to staff. Another condition of approval for this project required that the required open space border Vancil Road. This allows the City to acquire an area identified as part of the identified Y-2 Corridor. Council discussion followed concerning swales vs. drywells, comparing costs, benefits and criteria for determining the best option, and past and current City practices. Councilmember Isom indicated that he had a problem with the YPC deferring the decision to staff instead of providing direction. Discussion continued concerning stormwater manual options, methodology for selecting the best option for an individual area, and examples of requirements in various subdivisions. The applicant provided information concerning functional characteristics of the options and explained that he did not object to the requirement. CARRIED. Opposed: Bob Isom. 8. Yelm Community Schools (YCS) Alternative High School, CUP-01-8286-YL - Permit to convert two commercial buildings on First Street to School Facilities. Cathie Carlson provided an overview of the staff report and explained that the Alternative School has 30 students, who attend at various time during the day. The project has been prepared based upon- maximum occupancy, eliminating the need for additional evaluations as enrollment fluctuates or other uses are added. The YPC conducted a public hearing on the proposal in August. Discussion items at that meeting included a request to allow completion of parking and storm drain improvements within five years and creating a schedule allowing street /frontage improvements to be completed over a three year period. YCS has agreed to phasing parking availability reductions by removing parking from general use as the needs of the school for parking increase. At some point however, YCS will need to use all 60 of the stalls, eliminating the availability of this parking for use by downtown businesses. There was also discussion concerning sales/use of alcohol with YCS agreeing to not oppose the issuance of liquor licenses for any location in the surrounding commercial districts. City Council Minutes Page 2 of 6 ab/cc/2001 Minutes/9-12-01 Erling Birkland added that it is possible that a fire hydrant may need to be moved to meet insurance requirements. In response to Council questions, Alan Burke explained that due to the number of students at the high school, it may become necessary to shift some programs to the First Street location. He does not believe that these would be full day programs. Additional council discussion followed concerning the lack of participation in parking improvements by the businesses that have/will benefit from those improvements, the number of trips (4/per hour) generated at the previous location, crosswalk safety options, school property weapons/alcohol restriction enforcement challenges in a shared parking lot, stormwater drainage problems and its impacts on Yelm Creek, state requirements to meet parking standards, and other possible parking options. Steve Craig identified parking as a critical issue for downtown revitalization and urged the City to investigate a joint City and WSDOT venture to acquire the parking lot for use as a transit center and supplemental downtown parking. Cathie Carlson pointed out that if the parking area was sold, it would be impossible to sell that property at some point in the future. Craig urged Council to commit to investigating options to provide downtown parking. Steve Craig also requested that Council address problems encounter by trucks attempting to turn right onto First Street. Trucks frequently drive over the curb while making this turn damaging property and creating a hazard to pedestrians. A solution is even more important as the number of students in the downtown area increases. He stressed that communication between the City and WSDOT is needed to address this issue. Tim Peterson pointed out some crosswalk and parking problems on First Street that contribute to this situation. 01-110 MOTION BY JW FOSTER, SECONDED BY JOHN THOMPSON APPROVING CUP-01-8286-YL CONVERTING TWO COMMERCIAL BUILDINGS ON FIRST STREET TO SCHOOL FACILITIES AS RECOMMENDED BY THE YELM PLANNING COMMISSION. Abstained: Bob Isom and Don Miller. 01-111 Yelm Prairie Historical Society (YPHS) Museum Project -Shelly Badger provided background on past Council action dividing Hotel/Motel tax revenue between Museum and Park uses. The YPHS is proposing using this funding for ongoing operational expenses such as staffing, marketing materials, and displays. Staff has been working with Municipal Research and Services and the state Auditor to determine eligibility. Generally, the use of funds on a contractually basis with private organizations to operate tourism related activity is allowed, but use of the funding for capital improvements on a non City owned facility would not be allowed. Staff's requested approval of the overall concept presented allowing staff to begin the negotiations on services contract detailing product/services expectations. AI Laskowski, YPHS President, explained the YPHS lacks funding to operate a museum without assistance. The YPHS currently has $18,000 in their museum and operating funds. The building space is new and should be ready to occupy eliminating the need for capital improvements. Council consensus supported staff proceeding with negotiations and contract development. REPORTS 10. Library Report -Kristin Blalack reported on the success of the Summer Reading Program. A written report was provided. 11. Mayor Rivas -Meetings/Events Attended: Thurston Regional Planning Council, Chamber Breakfast, Mayors' Forum, Representative Smith, IT Awards, Water Workshop and meetings with Councilmembers and the City Administrator. Mayor Rivas reported on discussions concerning support for acounty-wide or multi jurisdictional fireworks ban at the Mayors' Forum. Council discussion concerned the inability of law enforcement to respond to the volume of complaint received, difficulty in making a determination of which fireworks are/are not legal, creating unenforceable laws, and the number of illegal fireworks readily available, 12. Council Report -Councilmember Miller attended the Water Work Session, and met with staff. Councilmember Isom attended a Transportation Policy Board Meeting and the Water Work Session. Councilmember Foster attended the Water Work Session and reported that the AWC Water Summit has been rescheduled. He submitted articles to the Nisqually Valley News, announced a new SWAC member from the Yelm area, and encouraged support of Yelm Senior Center fundraising activities. Councilmember Thompson requested a work session to have Mike Bailey (Lynnwood Finance Director) do a presentation for staff and Council on how to move towards a more user friendly narrative budget format. Tumwater has been changing to this format over the past six years and it is still a work in progress. Although the task seems monumental, it is possible to phase it in over a number of years. Mike Bailey can present some ideas on ways to plan the transition and mitigate workload impacts. Councilmember Thompson and Mayor Rivas feel that this format is a good public relations tool allowing the public to better equate dollars spent to services, programs, and staffing levels. The process also involves Council's input pining down a mission statement for the City, set long and short term goals, an annual examination of progress in attaining goals, and an annual goal reevaluation. In the long term this process might help staff, if they are feeling overwhelmed by identifying Council's priorities. City Council Minutes Page 4 of 6 ab/cc/2001 Minutes/9-12-01 Agnes Bennick requested that Councilmembers check their individual December schedules and select a couple of optional dates that can be forward to Mike Bailey for consideration. Councilmember Cunningham reported dates and times for several upcoming meetings. He also reported that City entry signs are going to be more ornate than the original sketches. They will be completed at the work area and trucked to Yelm to be placed on the pedestals. He also plans to check with Thurston Co. to see if one can be placed at the trail head. 13. Shelly Badger reported on the September 10, 2001 Yelm Parks Advisory Board meeting. Ongoing damage to the outer walls, rafters and roofs of the pavilion and booth building closest to the kitchen is threatening the integrity of the structures. Glen Blando provided asupply/materials estimate for repairs to enclose rafter areas, replace existing shingled roof materials with metal, repair and replace damaged outside walls, and add inside walls to booth buildings. Repairs would be performed by a group of volunteers organized by Mr. Blando. The YPAB requested Council approval to use approximately $4,000 of Park Reserve Fund money to add to regular park maintenance dollars for repairs to the booth building closest to the kitchen. Council discussion followed concerning the possible use of Hotel/Motel funds to accomplish all of the improvements, estimated at $12,462.76. Tax Parcel # 21724120404 (The Wolf Building) The applicant is applying for a Special Use Permit to convert two commercial buildings (20,000 sq ft and 1000 sq ft), and associated parking into the Yelm Extension School. At this time the Extension School has approximately 30 students. The students do not attend traditional classes and are not on fixed schedules. The proposed use does not require the entire square footage of the buildings be utilized to house the Extension School. At this time it is unknown what other types of activities or uses will occur in the remainder of the buildings. The City's review of the use at this location is based on maximum student population of 181 students and approximately 19 people as various staff. The Districts' standard for a high school is 110 square feet per student. By analyzing the property for its maximum occupancy this will allow for the School District to use the building based on District needs and will not require the applicant to modify its conditional use permit every time they need to use the building for additional activities. STAFF REPORT -SUMMARY STATEMENT AND DEPARTMENT RECOMMENDATION: Staff recommends the City Council approve the above referenced project as forwarded by the Yelm Planning Commission which is based on the following: The Planning Commission held a public hearing on August 20, 2001. At the hearing, the School district asked the Commission to allow them to defer the improvements to parking and stormdrain, allowing 5-years for completion. The Planning Commission made a motion to recommend approval of the project as conditioned, with a change in Condition of Approval #10. The Commission directed staff to work with the School district to create a schedule for completion of parking and storm drainage improvements, based on a 3-year phased completion schedule. Staff is to forward this agreement to City Council within 60 days. Based on the analysis and findings presented in the Planning Commission staff report dated August 13, 2001, the public testimony received at the Public Hearing, August 20, 2001, and as conditioned below, the Planning Commission has determined the proposal meets all land use codes and development requirements of the City of Yelm and is consistent with the Yelm Comprehensive Plan. Conditions of Approval. Sewer 1. The applicant shall submit sewer usage calculations to the Community Development Department. The required calculations shall be from a professional engineer licensed in the state of Washington. These calculations shall be submitted with the civil engineering plans to the Community Development Department for review and approval. 2. Currently this site has an existing connection of 240 gallons a day. If your use is greater than the current use the applicant will have to pay an additional sewer connection fee. Sewer connection fees are charged at the current rate of $4,850 per connection, (fee subject to change) payable at building permit issuance. Each connection is considered 240 gallons per day. All connections require an inspection, with a fee of $145.00 per a connection, also payable at building permit issuance. If required, these fees will be assessed at building permit issuance and will be based on the submitted sewer calculations. Water 3. The applicant shall submit a storm water operation and maintenance plan to the Community Development Department for approval prior to final plat approval. 8. The stormwater system shall be maintained by the building owner. The Agreement shall include provisions for the assessment of fees against the owner for the maintenance and repair of the stormwater facilities. Transportation 9. The applicant shall be responsible for full-street improvements along Jefferson Street, between First Street and Second Street and half-street improvements along Second Street. The frontage improvements shall be consistent with a Neighborhood Commercial Collector. School District financing and budget cycle may prohibit the completed road improvements prior to occupancy. If this should occur the school district shall bond for said improvements. 10. The applicant shall establish a schedule with the City for the 3-year phased completion of improvements for streets, parking, stormwater facilities and associated landscaping with these improvements. This schedule shall be submitted to City Council for approval prior to October 23, 2001. 11. The vacant lots on the northwest corner of Jefferson Street and Second Street will be utilized as the above ground stormwater facilities. Location of the Yelm Extension School located at the First Street location has the potential of becoming a very positive factor in a down town revitalization effort. 2. Hopefully, renovation of the Old Wolf Building will include some exterior facade improvements that perhaps could include design elements reminiscent of the 1920s or 30s, thus making the building more consistent with the older downtown architecture. I understand the school district has a limited budget and what is being suggested need not be expensive. I am hopeful that the building, after renovation, doesn't look like a converted grocery store, but rather a building the school district, students and the community can take pride in. 3. If the school district and the city are open to discussing it, it is suggested that the City investigate acquisition of the parking lot portion of the proposed project across the street from the Old Wolf Building. This parking lot has been a defacto public lot for many decades and is vital to downtown commerce. If the city was to purchase the lot, it would, of course, significantly lessen the overall cost to the district, and could still serve the school district needs in an arrangement that could be worked out with the city. It would also ensure that there would be parking to serve downtown needs on a permanent basis. Also, a consideration, relative to the parking lot, is the possibility of using a portion of it for a park & ride lot that could in small measure help alle:~iate traffic congestion. The State Department of Transportation has informally indicated that they would be open to discussing the matter. DOT's involvement could also help defray the acquisition cost. Associated with this could be a modest bus shelter to serve intercity transit. Looking to the future. this ]ot may also be critical to development of commuter train passenger service in Yelm. I believe some creati~~c opportunities may exist that could benefit all parties and the community and 1 am hopeful that there «~ill he opportunities to ha~~c thoughtful discussion on this. I am hopeful in that event, that the city and the school district would not oppose issuance of a liquor license, particularly since there are three other businesses in the downtown core that do currently serve liquor. C. DEPARTMENT ANALYSIS AND FINDINGS: Proponent. Yelm School District 2. Location. 103 and 107 First Street. Tax Parcel # 21724120404 School District has requested a delayed schedule for the frontage and parking improvements (Exhibit VI.) This proposal does not include any school bus service to the site now or in the future. The completed project will increase traffic and impact the City's transportation system. Chapter 15.40, Concurrency Management ,requires all development to mitigate impacts to the City transportation system. A high school generates 0.04 p.m. peak hour trips per student. For maximum use of the site with 181 students the Transportation Facility Charge is $5,430.00 and payable at time of building permit. 8. Parking. Chapter 17.72, Off-Street Parking and Loading, requires minimum parking facilities of 1 parking stall for each four students that are normally enrolled and are of legal driving age, plus one parking stall per classroom and office. Assuming a maximum occupancy of 181 high school students, 10 classrooms and 5 office spaces, 75 parking spaces are required. This assumes that approximately 1 out of every 3 students will have a drivers license. The existing parking area has adequate space to provide the minimum parking stalls. However, there is currently no access control, landscaping or stormwater management in the parking areas. Historically the parking areas have been used by customers of many other downtown businesses. The School District has agreed to number and reserve the stalls as they need them. As the school expands to its full occupancy the District will continue to reserve and number additional stalls. In the future the majority, if not all, of the parking will be needed for the School (downtown businesses that do not provide on-site parking will need to determine how to provide parking for their customers in the future.) Loading areas for uses that require regular delivery typically require a separate loading area that does not conflict with the day to day functions of the facility. On the south end of the building there is an existing loading area that is adequate. 9. Wastewater. The project site is in the Sewer Service Area and is currently connected to the City's STEP sewer system. There is an existing 3,000-gallon S.T. E.P. tank located at the northeast corner of the property. Sewer connection fees are charged at the rate of $4,850.00 per 240 gallons of use. One connection currently exists at the site. However, if the intended use is greater than the previous use, the new building tenant will be required to pay for any additional connections. All connections require an inspection with a fee of $145.00 per connection, also payable at building permit issuance if required. 10. Water Supply. The proposed site is in the City's water service area and is currently connected to the City's Water system. There is an existing 6" watermain located in First St. Water connection fees are charged at the rate of $1,000.00 per 240 gallons of use. One connection currently exists at the site. However, if the intended use is greater than Page 3 of 7 standards. Landscaping is also required in and around above ground stormwater facilities. A preliminary landscaping plan has not been submitted. A final landscape and irrigation plan must be submitted to the City for review and approval. Installation of landscaping is typically required prior to occupancy. 16. Environmental Review: After review of the environmental checklist and supporting documents, a Determination of NonSignificance (DNS) was issued on July 26, 2001 The comment period expired on August 8, 2001. The DNS is attached as Exhibit III. 17. Public Comment. One letter was received by an adjacent property owner (see Exhibit IV.} 18. Findings and Conclusion. Based on the project as proposed by the applicant and the conditions of approval below, the staff finds that the project 1. Adequately provides for the public health, safety and general welfare and for drainage ways, streets, potable water supplies, sanitary wastes; and 2. The project is in conformance with The Yelm-Thurston County Joint Comprehensive Plan, the City Zoning Ordinance and the City's Development Guidelines. D. Staff Recommendation Based on the Analysis and Findings in Section C and the Conditions of Approval below, staff recommends that the Planning Commission forward CUP-01-8286-YL to the City Council for approval. Conditions of Approval. Sewer 1. The applicant shall submit sewer usage calculations to the Community Development Department. The required calculations shall be from a professional engineer licensed in the state of Washington. These calculations shall be submitted with the civil engineering plans to the Community Development Department for review and approval. 2. Currently this site has an existing connection of 240 gallons a day. If your use is greater than the current use the applicant will have to pay an additional sewer connection fee. Sewer connection fees are charged at the current rate of $4,850 per connection, (fee subject to change) payable at building permit issuance. Each connection is considered 240 gallons per day. All connections require an inspection, with a fee of $145.00 per a connection, also payable at building permit issuance. If required, these fees will be assessed at building permit issuance and will be based on the submitted sewer calculations. Water 3. The applicant shall submit water usage calculations to the Community Development Department. The required calculations shall be from a professional engineer licensed in the state of Washington. The applicant shall submit fire flow calculations for existing hydrants. All hydrants must meet minimum City standards. 18. The applicant shall submit a fire hydrant plan to the Community Development Department for review and approval. Landscaping 19. The applicant shall provide a Type II landscape buffer along the northern property line adjacent to both parking areas. 20. Properties adjacent to the site on the easterly boundary are zoned C-1 and developed as residential. All other adjacent properties are commercial zoned and developed as commercial. In the CBD liquor stores are prohibited within 500 feet from the exterior boundary of any public school grounds and in the C-1 and C-2 Districts, taverns, liquor stores, billiard halls and pool halls are prohibited within 500 feet from the exterior boundary of any public school grounds. The restriction of limiting liqueur stores in the CBD would have very little if any impact to current or future business in the CBD. However there are a number of parcels in the C- 1and C-2 Districts that would not be permitted to site a tavern, liquor store, billiard hall and pool hall. Exhibit V illustrates the approximate 500' radius from the school property in which those uses would be prohibited. To eliminate the restriction of siting these uses, the zoning code would require an amendment. However an amendment would have to be district wide, creating situations in where a tavern would be allowed to site adjacent to schools. Also, the Washington State Liquor Control Board controls the issuing of a liquor license. When an applicant applies for a liquor license, the Board notifies the surrounding property owners. The board can reject an applicant if requested by a surrounding property owner. 7. Transportation and Site Access. The buildings front on First Street, with the parking areas fronting on Second Street and Jefferson Street. First Street is classified as a Pedestrian Oriented Street. This frontage along First Street is already improved and will not require any upgrades or improvements. Yelm Development Guidelines classify Second Street and Jefferson as local access commercial. These streets currently consist of approximately 22' of driving surface only. The School District's financing and budget cycle may limit the District's ability to complete the street, stormwater and parking lot improvements prior to occupancy. The Page 2 of 7 School District has requested a delayed schedule for the frontage and parking improvements (Exhibit VI.) This proposal does not include any school bus service to the site now or in the future. The completed project will increase traffic and impact the City's transportation system. Chapter 15.40, Concurrency Management ,requires all development to mitigate impacts to the City transportation system. A high school generates 0.04 p.m. peak hour trips per student. For maximum use of the site with 181 students the Transportation Facility Charge is $5,430.00 and payable at time of building permit. 8. Parking. Chapter 17.72, Off-Street Parking and Loading, requires minimum parking facilities of 1 parking stall for each four students that are normally enrolled and are of legal driving age, plus one parking stall per classroom and office. Assuming a maximum occupancy of 181 high school students, 10 classrooms and 5 office spaces, 75 parking spaces are required. This assumes that approximately 1 out of every 3 students will have a drivers license. The existing parking area has adequate space to provide the minimum parking stalls. However, there is currently no access control, landscaping or stormwater management in the parking areas. Historically the parking areas have been used by customers of many other downtown businesses. The School District has agreed to number and reserve the stalls as they need them. As the school expands to its full occupancy the District will continue to reserve and number additional stalls. In the future the majority, if not all, of the parking will be needed for the School (downtown businesses that do not provide on-site parking will need to determine how to provide parking for their customers in the future.) Loading areas for uses that require regular delivery typically require a separate loading area that does not conflict with the day to day functions of the facility. On the south end of the building there is an existing loading area that is adequate. 9. Wastewater. The project site is in the Sewer Service Area and is currently connected to the City's STEP sewer system. There is an existing 3,000-gallon S.T. E.P. tank located at the northeast corner of the property. Sewer connection fees are charged at the rate of $4,850.00 per 240 gallons of use. One connection currently exists at the site. However, if the intended use is greater than the previous use, the new building tenant will be required to pay for any additional connections. All connections require an inspection with a fee of $145.00 per connection, also payable at building permit issuance if required. 10. Water Supply. The proposed site is in the City's water service area and is currently connected to the City's Water system. There is an existing 6" watermain located in First St. Water connection fees are charged at the rate of $1,000.00 per 240 gallons of use. One connection currently exists at the site. However, if the intended use is greater than Page 3 of 7 the previous use, the new building tenant will be required to pay for any additional connections. If required, these fees are payable at building permit issuance. 11. Drainage/Stormwater. The completed project will increase impervious surfaces on the site, and adjacent streets. Impervious surfaces create storm water runoff. Uncontrolled and untreated storm water runoff can create health and safety hazards. YMC requires all development to comply with the Department of Ecology Stormwater Manual, for the control and treatment of stormwater runoff. Currently this site has some existing stormwater drainage problems. The existing system cannot contain or infiltrate the required stormwater volume. The site is sloping to the southeast toward Jefferson St. The water flows to the intersection of Jefferson St and Second St. and overflows into the front yard of a private residence on Jefferson St. The applicant has submitted a Preliminary Stormwater Report that estimates the impervious surface, infiltration rates of the runoff, and a conceptual design for treatment and storage of the stormwater. Following Special Use Approval, the Stormwater Manual requires the developer to submit a final plan consistent with the final impervious calculations for the site. Stormwater facilities require continued maintenance to ensure they remain in proper working condition. 12. Fire Protection. Fire protection is provided by the Thurston County Fire District #2. As development occurs there will be additional demands for fire service. 13. Police Protection. Police protection is provided by the City of Yelm. As development occurs there will be additional demands for police service. 14. Street Lighting_ Adequate street lighting will be required for this project. Street lighting design must meet the City of Yelm's Development Guidelines and will be submitted to the City for review and approval. 15. Landscaping,_ Landscaping and screening are necessary to promote safety, to provide screening between compatible land uses, to safeguard privacy and to protect the aesthetic assets of the City. Chapter 17.80, Landscaping, requires the applicant to provide on-site landscaping for all development proposals. In particular school sites require a Type III landscaping along the street frontage and through the required front yard area and Type II landscaping between the required front yard area and improvements on the property and along interior property lines. The existing building locations restrict the areas available for landscaping. There is not a front yard setback and the rear yard setback is approximately 15' which is used as a vehicle access to the rear of the building. The south side is developed to the property line. There is an area along the northwest and northern property line that will be utilized for parking and can accommodate the required landscaping. The parking area located on the northeast corner of First Street and Jefferson Street is adjacent to residential development. A landscape buffer could be provided here. The parking areas will be improved and landscaping will be provided per City development Page 4 of 7 standards. Landscaping is also required in and around above ground stormwater facilities. A preliminary landscaping plan has not been submitted. A final landscape and irrigation plan must be submitted to the City for review and approval. Installation of landscaping is typically required prior to occupancy. 16. Environmental Review: After review of the environmental checklist and supporting documents, a Determination of NonSignificance (DNS) was issued on July 26, 2001 The comment period expired on August 8, 2001. The DNS is attached as Exhibit III. 17. Public Comment. One letter was received by an adjacent property owner (see Exhibit IV.) 18. Findings and Conclusion. Based on the project as proposed by the applicant and the conditions of approval below, the staff finds that the project Adequately provides for the public health, safety and general welfare and for drainage ways, streets, potable water supplies, sanitary wastes; and 2. The project is in conformance with The Yelm-Thurston County Joint Comprehensive Plan, the City Zoning Ordinance and the City's Development Guidelines. D. Staff Recommendation Based on the Analysis and Findings in Section C and the Conditions of Approval below, staff recommends that the Planning Commission forward CUP-01-8286-YL to the City Council for approval. All landscape and planting strips shall have an irrigation system with a separate water meter. The applicant shall submit final civil plans to the Community Development Department for review and approval. stormwater 6. The applicant shall design and construct all storm water facilities in accordance with the DOE Storm Water Manual, as adopted by the City of Yelm. Best Management Practices (BMP's) are required during construction. The applicant shall compile a final storm water report along with construction drawings. 7. The applicant shall submit a storm water operation and maintenance plan to the Community Development Department for approval prior to final plat approval. 8. The stormwater system shall be maintained by the building owner. The Agreement shall include provisions for the assessment of fees against the owner for the maintenance and repair of the stormwater facilities. Transportation 9. The applicant shall be responsible for full-street improvements along Jefferson Street, between First Street and Second Street and half-street improvements along Second Street. The frontage improvements shall be consistent with a Neighborhood Commercial Collector. School District financing and budget cycle may prohibit the completed road improvements prior to occupancy. If this should occur the school district shall bond for said improvements. 10. The applicant shall establish a schedule with the City for the completion of improvements for streets, parking, stormwater facilities and associated landscaping with these improvements. All improvements shall be scheduled for completion within 18 months of occupancy and the School District shall bond for said improvements. 11. The vacant lots on the northwest corner of Jefferson Street and Second Street will be utilized as the above ground stormwater facilities. The City will not require full frontage improvements along this area, but will require the construction of adequate shoulders. 12. The applicant shall be responsible for the Transportation Facility Charge of $5,430.00, payable at time of building permit. 13. If the future, the School District provides bus service to the site, they shall submit plans for approval by the City. The applicant shall provide a Type II landscape buffer along the northern property line adjacent to both parking areas. 20. Location of the Yelm Extension School located at the First Street location has the potential of becoming a very positive factor in a down town revitalization effort. Hopefully, renovation of the Old Wolf Building will include some exterior facade improvements that perhaps could include design elements reminiscent of the 1920s or 30s, thus making the building more consistent with the older downtown architecture. I understand the school district has a limited budget and what is being suggested need not be expensive. I am hopeful that the building, after renovation, doesn't look like a converted grocery store, but rather a building the school district, students and the community can take pride in. 3. If the school district and the city are open to discussing it, it is suggested that the City investigate acquisition of the parking lot portion of the proposed project across the street from the Old Wolf Bui]dinQ. This parking lot has been a defacto public lot for many decades and is vital to downtown commerce. If the city was to purchase the lot, it would, of course, significantly lessen the overall cost to the district, and could still serve the school district needs in an arrangement that could be worked out with the city. It would also ensure that there would be parking to serve downtown needs on a permanent basis. Also, a consideration, relative to the parking lot, is the possibility of using a portion of it For a park & ride lot that could in small measure help alleviate traffic congestion. The State Department of Transportation has informally indicated that they: ~~~ould b: open to discussing the matter. DOT's in~~ol~ement could also help defray the acquit ition cost. Dear Ms. Carlson: Yelm Community Schools is requesting, upon issuance of a Special Uses Permit, the immediate use of the "Wolf' buildings located at 103 1St St. and 107 1St St. Yelm Schools is requesting the use of these buildings prior to completion of street, parking and drainage improvements. Yelm Schools believes that this request is reasonable based on the fact that no other development is scheduled or planned for the surrounding area. The immediate upgrading of the subject street frontage would be of little benefit as it would create widened streets joining narrow existing streets and sidewalks ending in the middle of the block. Another item of consideration is the funding of the "Wolf' project. This project is funded through Impact and Mitigation funds which are received as building permits are issued in Pierce and Thurston Counties and the City of Yelm. It is apparent that funds will not be readily available to fund the construction of classrooms and street improvements simultaneously. In our earlier discussion regarding the High School landscape requirements we discussed placing slates in the existing cyclone fencing. In addition to the slates it was suggested that we plant a barrier to block or soften the change from one land use to another. Follow-up discussions with Brian Asmus of the Yelm Police and Alan Burke, Yelm Schools Superintendent, raised concerns regarding the placement of any device or shrub which provides an opportunity to conceal activities. Location of the Yelm Extension School located at the First Street location has the potential of becoming a very positive factor in a down town revitalization effort. 2. Hopefully, renovation of the Old Wolf Building will include some exterior facade improvements that perhaps could include design elements reminiscent of the 1920s or 30s, thus making the building more consistent with the older downtown architecture. I understand the school district has a limited budget and what is being suggested need not be expensive. I am hopeful that the building, after renovation, doesn't look like a converted grocery store, but rather a building the school district, students and the community can take pride in. 3. If the school district and the city are open to discussing it, it is suggested that the City investigate acquisition of the parking lot portion of the proposed project across the street from the Old Wolf Building. This parking lot has been a defacto public lot for many decades and is vital to downtown commerce. If the city was to purchase the lot, it would, of course, significantly lessen the overall cost to the district, and could still serve the school district needs in an arrangement that could be worked out with the city. It would also ensure that there would be parking to serve downtown needs on a permanent basis. Also, a consideration, relative to the parking lot, is the possibility of using a portion of it for a park & ride lot that could in small measure help alleviate traffic congestion. The State Department of Transportation has informally indicated that they would be open to discussing the matter. DOT's involvement could also help defray the acquisition cost. Associated with this could be a modest bus shelter to serve intercity transit. Looking to the future, this lot may also be critical to development of commuter train passenger service in Yelm. I believe some creative opportunities may exist that could benefit all parties and the community and I am hopeful that there will be opportunities to have thoughtful discussion on this. 4. In the future the Historic Wolf Building may be converted to a restaurant, where wine and beer would be served. I am hopeful in that event, that the city and the school district would not oppose issuance of a liquor license, particularly since there are three other businesses in the downtown core that do currently serve liquor. I n conclusion, I believe Yelm Community Schools will be a positive influence and partner in Yelm's old town business community and I, as an adjacent property owner, look forward to them being our new neighbor. This site is served by a 4" STEP sewer main located in Jefferson St. On the proposed site is a 3,000-gallon sewer STEP tank behind the building. It appears that this tank will be large enough to support your intended building use, however, must be verified by your licensed civil engineer. (200 students) Sewer hook-up fees are based on a consumption rate of 240 gallons per day and are charged at a rate of $4,850/240gpd (fee subject to change) inside city limits. At the time of application submittal you will be required to submit water usage calculations provided by a licensed civil engineer. The sewer fees will be calculated using the calculations provided. Fire: Fire protection to the buildings must be provided per the Uniform Building Code. There may be existing fire hydrants on this site, however, additional hydrants will be required to meet current standards. This will be determined upon further review of the civil plans. The existing fire hydrants are located at the intersections of Van trump/First St. and Yelm Ave/Hwy 507. Stormwater: Developments with over 5,000 sq ft of impervious surtace are required to provide stormwater facilities per the DOE Stormwater Manual. Preliminary Stormwater Report and conceptual plan must be submitted with land use application. The existing site has had stormwater flooding problems in the past. It appears the current stormwater control structures and underground galleries do not control the stormwater runoff. This site is contributing to adjacent downstream flooding along Jefferson St. and will have to be brought up to current standards. The current standards are based on the Department of Ecology Stormwater manual. Street Improvements: There are frontage improvements required for this project. Frontage improvements shall be consistent with Yelm's Development Guidelines. Half street improvements will be required on Second St and shall be consistent with the section "Local Access Commercial." Full Roadway improvements will be required on Jefferson St. an shall be consistent with the section "Local Access Commercial." Street improvements are not limited to the roadway sections shown in the Development Guidelines. Additional improvements identified in the TIA maybe necessary to mitigate the impacts of the development. Street Lighting: As required per the City of Yelm Development Guidelines. ADA Requirements: The American Disabilities Act required that facilities are ADA accessible. Facility improvements will have to meet current code. INVENTORY OF EXISTING FACILITIES In .order to calculate the total student capacity of Yelm Community Schools District facilities, the existing school buildings were categorized by type of school: elementary schools (grades K-4), intermediate schools (grades 5-6), middle schools (grades 7-8), and high schools (grades 9-12). The total student capacity was determined for each building, subtotaled by building type and, finally, totaled for the entire District. The capacity of each school, the capacity for each type of school, and the total district wide capacity figures are set forth in Table A. The capacity for each elementary facility is based on the number of classrooms and the maximum number of .students allowed for each grade span, or the "class size." Class size is defined as the ratio between the total number of full-time equivalent (FTE) students in a classroom and the number of teachers in that class. The District has elected to measure the standard of service for the K-~ grade span based on class size rather than square footage per student because the needs of elementary students differ more substantially between grade levels, and the square footage calculations do not accurately capture the needs of K-4 students. Capacities by school are attached as Appendix A. The total capacity of each building is determined by multiplying the number of classrooms for each grade level by the maximum class size. The calculated capacities are for permanent structures only. Student capacities for portable classrooms have been excluded because these facilities are temporary in nature and may readily be relocated to other sites to meet increased enrollment needs on a short term basis. The breakdown of portable use by school is attached as Appendix B. For intermediate facilities, capacity is also based on classroom and student size. The figures also take into account the reduced capacity of special education classrooms due to state and federal standards and reauirements_ Capacities for the middle school and the high school are determined by calculating the total square footage of the building and dividing by the square foot per student standard. The District's standard for middle school is 110 square feet per student and the standard for the high school is 120 square feet per student. Table B identifies the District's schools, the building addresses, and the jurisdictions in which the facilities are located.
