RESOLUTION NUMBER 589
APPROVING AN INVESTMENT GRADE AUDIT REPORT AND ENERGY
PERFORMANCE CONTRACTING PROJECT PROPOSAL CONTRACT BETWEEN
THE CITY OF YELM AND JOHNSON CONTROLS, INC
The City Council of the City of Yelm finds as follows:
WHEREAS, on May 1, 2018 the Yelm City Council directed staff to pursue an
Investment Grade Audit (IGA) contract with Johnson Controls Incorporated as a
Washington state pre -qualified Energy Service Company ("ESCO"); and
WHEREAS, the Washington State Department of Enterprise Services (DES)
regularly issues solicitations for qualifications from firms desiring to be pre -qualified and
identified as approved ESCO's as authorized under RCW 39.35A, 39.35C.010, and
39.04; and
WHEREAS, the authorization allowed under the Revised Code of Washington is
design to establish a process for selecting Individual ESCO's where a client agency
may want to select a specific ESCO for projects developed in their facilities or for
expertise in specific energy, water, and solid waste related areas; and
WHEREAS, the City in partnership with JCI has completed a preliminary
efficiency analysis & energy assessment and determined that preliminary indications
show a series of viable energy saving projects; and
WHEREAS, the City is interested in contracting for the IGA under the DES
oversight program for Energy Performance Contracting; and
WHEREAS, the City has determined that JCI's reputation and references from
other jurisdictions make for a strong fit for our community; and
WHEREAS, the City and the ESCO can enter into an agreement whereby the
ESCO identifies potential facility improvement measures and fixes these improvements,
funded through the City's energy and operational cost savings. If the ESCO finds that
there is no project that's cash flow neutral, the City would not incur the cost of the audit.
If there is a project then the cost of the audit would be transferred to the overall project;
and
WHEREAS, the City Council finds the adoption of this resolution to be in the
public's interest;
NOW THEREFORE, BE IT RESOLVED; that the City Council of the City of Yelm
hereby authorizes the Mayor to sign an Interagency Agreement with the Department of
Enterprise Services and accompanying Funding Approval to hire JCI to complete an
Investment Grade Audit; and
BE IT FURTHER RESOLVED; by the City Council of the City of Yelm that the
Mayor of Yelm is authorized to execute the proposed contract and that City staff are
authorized to execute any other documents in furtherance of this Resolution.
Approved and adopted this 8th day of May 2018, by a majority of the Yelm City Council.
