02/12/92-~„~-~-- i ~ ' ~~ 1 ~ F_. ~~ MIN(]TES CITY OF YELM REGULAR COUNCIL,MEETING WEDNESDAY, FEBRUARY 12, 1992, 7:30 PM, YELM CITY HALL COUNCIL CH11M13ERS The Regular Meeting was called to order by Mayor Sanders at 7:30 PM. All present joined in the flag salute. Council present: Kathy Wolf, Amos Lawton, Arnold Drogseth and Martha Parsons. Staff: Shelly A. Badger, Tim Peterson, Todd Stamm, Gene Borges and Glenn Dunnam. Kathy Wolf moved to approve the agenda as circulated, second by Arnold Drogseth. Motion carried. Martha Parsons moved to approve the minutes of the January 22, 1992 Regular Council Meeting, second by Amos Lawton. Motion carried. The following vouchers numbered 11272 through 11380 were approved on a motion by Arnold Drogseth, second by Kathy Wolf. Motion carried. CURRENT: $20,256.32 POLICE: $20,432.43 STREET: $ 5,597.51 ARTERIAL STREET: $ 9,326.54 CDBG: $ 9,305.30 WATER: $15,124.60 GARBAGE: $10,551.90 90 WATER CONSTRUCTION: $ 48.57 74 GO BOND : $ 3.18.00 TOTAL $90,961.17 Martha Parsons moved approval to surplus miscellaneous city property consisting mainly of office equipment, second by Kathy Wolf. Motion carried. Kathy Wolf moved approval of the Thursto n County Economic Development Council's request for an additional $800.00 in funding for 1992, second by Martha Parsons. Motion carried. The Council approved the request due to the increased business interest in the Yel m area a nd the location of the Business Resource Center in Yelm. Council stated they did not want the 1992 increased funding to become the base amount for future increases. Arnold Drogseth moved to obtain prior acts insurance coverage for general ]_iability, police professional and public officials errors and ommission coverage beginning January 13, 1989 from the Association of Washington Cities Risk Management Service Agency for a total one-time premium of $8,7,94. Motion was seconded by Amos Lawton. Motion carried. The policy will cover any future claims made for occurrences between January 13, 1989 and January 13, 1992 (when the City transferred to the AWC "occurrence" policy). Kathy Wolf moved to approve Ordinance No. 425 amending On~inance No. 404 relating to the substance abuse prevention fund assessment, second by Amos Lawton. Motion carried. A letter of resignation was received from Councilman Rick Kolilis. Arnold Drogseth moved to approve the letter, effective immediately, second by Amos Lawton. Motion carried. There will be an "appreciation" hour on March 11, 1992, at 6:30 PM to honor Rick Kolilis for his years of service to the City of Yelm. At 7:47 PM, Council went into an Executive Session to discuss the qualifications of potential candidates to fill the vacant Council seat. They returned at 8:00 PM. Councilwoman Wolf stated that with the ever increasing growth management demands on the City of Yelm, the Council feels it is important that the vacancy be filled as soon as possible and they will make the decision on the appointment at the March 11, 1992 Regular Council Meeting. The person appointed by majority vote of the Council, will serve until the next general election. Martha Parsons moved approval to conduct a 1992 Census within the city limits of Yelm according to Washington State Office of Financial Management guidelines. Second by Arnold Drogseth. Motion carried. Students from the Yelm High School FFA (lead by Bob Gallagher) and a city staff person will conduct the actual census in mid March. The City feels that the 1990 Census results were low and feels it is important to re-count Yelm residents. Residents will be notified by mail of the dates of the count. Much of Washington State's revenue allocation is based on population. City Attorney, Todd Stamm, commented on the HUD Shelter Plus Rental Assistance Program grant that the UCBO would like to apply for with the City of Yelm serving as the lead agency. If the City received a grant award and prior to grant acceptance, Yelm would have to conduct a thorough analysis to insure that the UCBO was qualified to administer the program. When complete, the City could pass-through the grant dollars to the UCBO with very minimal liability to the City. Council concurred with their motion of January 22, 199?_ to allow the UCBO to prepare the HUD Shelter Plus Rental Assistance Program grant application, with the City of Yelm as the lead agency. Council confirmed the following statement written in the adendum to Real Estate Purchase & Sale Agreement for the Meek property purchase, Parcel #64300900400 (Purchased 7-11-90): As part of the purchase price for Parcel #64300900400, the City of Yelm agrees to grant to seller, if and when purchaser has a sewer system available to Parcel #64300900300 & #64300900200, a hookup to said sewer system without a hookup charge. All facilities and lines from parcels to City's lines and or trunks to be provided by seller at his expense. In regards to the LeMay, Inc. request for a contract amendment which would automatically extend the contract for five additional terms of three years each, with a termination condition that notice be given not less than 180 days prior to the end of the contractual period; Todd Stamm stated that the City can accept the amendment request, but asked what benefit it is to Yelm. Kathy Wolf moved to deny the request by LeMay, Inc. as stated above, second by Martha Parsons. Motion carried. At 8:20 PM, Council went into an Executive Session to discuss a real estate contract. They returned at 8:30 PM. Martha Parsons moved approval authorizing Mayor Sanders to sign an earnest money agreement, not exceeding $5000, for Parcel #22719240500, for the Community Development Block Grant iJCBO Community Center project. City offering price of property either the list price or the appraised value, whichever is less. Amos Lawton. seconded the motion. Kathy Wolf abstained. Motion carried. Todd Stamm briefed the City Council on the Yelm Interim Critical Areas Resource Lands Ordinance and explained the two versions of the ordinance. The first being a generic draft prepared by the South County Towns Task Force, the second a Yelm staff alternative. The ordinance provides for designation and protective regulations for "natural resource lands" and critical areas" as mandated by the State in the 1990 Growth Management Act. The Department of Community Development granted cites and counties a 180-day extension to February 28, 1992 from the September 1, 1991 deadline imposed by the Act'. No further extensions are available. Failure to timely adopt such regulations could subject the City to citizen lawsuits or revenue sanctions by the State. The interim ordinance sets minimum standards until a final version (if necessary) is adopted by July 1, 1994 (as required by the Act). The Yelm Planning Commission dedicated a workshop on February 11, 1992 to study the ordinance in great detail and will complete a Public Hearing on the Ordinance February 18, 1992 and forward a recommendation to the City Council. Council will hold a Public Bearing on the Ordinance February 26, 1992. Yelm Historic Preservation Commission meeting of February 5, 1992: Shelly Badger reported that the Commission is continuing work on the Masonic Temple and Senior Citizen's Historic Register nominations. Also, the Commission asked Council for suggestions on potential Commission members as three members terms will expire December 31, 1992 and can not be re-appointed. Yelm Parks Advisory Committee Meeting of February 11, 1992: Martha Parsons moved approval of the following park use requests, second by Arnold Drogseth. Motion carried: 1. Nisqually Basin Little League: April, May, June, M-F, 5-8PM, Sat, lOAM-2PM 2. Yelm High School Alumni picnic: July 11, 1992, lOAM, 75-100 people, kitchen use, restrooms 3. Lorraine Lilley family reunion: July 19, 1992, 8AM-SPM, 100-200 people, kitchen, restrooms Councilwoman Parsons informed the Council of the efforts of community members to erect flagpole type steel poles at the three entrances to Yelm to use 'for event banners and flags. Staff stated they would need to contact Department of Transportation for specifications on pole placement in DOT right-of-way. Sewer Report: Yelm will submit an application to the Department of Ecology by February 21, 1992 for a Centennial Clean Water Fund grant for ~: approximately $775,000 to complete the funding package for the sewer project: Yelm received a letter from Department of Ecology dated January 30, 1992 accepting the 1990 Wastewater Facilities Plan. Yelm Municipal Court report was received for December 1991 showing 245 tickets processed (63 criminal and 182 non-criminal). Fines and forfeitures collected in December - $19,286.23. The following correspondence was presented to City Council members: 1. Lacey Area Chamber of Commerce letter regarding impact fees 2. Thurston County EDC letter regarding impact fees 3. Letter re: Thurston County school recycling program and regional drop-off recycling program 4. Thurston County Community Youth Services' Youth of the Year Award 5. AWC Insurance Pool Line 6. Timberland Regional Library Board of Trustees Annual Meeting 7. Thurston Council on Cultural Diversity and Human Rights 8.
