1. The meeting was called to order at 7:30 p.m. by Mayor Kathy
Wolf. All present joined in the flag salute.
Council present: Martha Parsons, Patty Forrester, Amos
Lawton, Don Miller and Bob Gallagher. Guests present:
Arnold Drogseth, Barbara Wood, James Legendre, Darryl
Grills, Russell Greff, John Thompson, Frances Andrews,
Kristin Blalack and Jim Blundell. Staff Present: Shelly
Badger, Gene Borges, Glen Dunnam, Tim Peterson and Agnes
Colombo.
93-165 2. MOTION BY AMOS LAWTON, SECONDED BY BOB GALLAGHER APPROVING
THE AGENDA WITH THE ADDITIONS OF 9.c., POST OFFICE TRAFFIC
LIGHT AS REQUESTED BY MARTHA PARSONS. MOTION CARRIED.
93-166 3. MOTION BY BOB GALLAGHER, SECONDED BY AMOS LAWTON APPROVING
THE AUGUST 11, 1993 MINUTES AS CORRECTED TO READ (MOTION
#93-154) MOTION BY BOB GALLAGHER. MOTION CARRIED.
93-167 4. MOTION BY MARTHA PARSONS, SECONDED BY BOB GALLAGHER
APPROVING THE AUGUST 1993 PAYROLL. MOTION CARRIED.
93-168 MOTION BY BOB GALLAGHER, SECONDED BY MARTHA PARSONS
APPROVING PAYMENT OF VOUCHERS 12964-12965~TOTALLING $999.00.
MOTION CARRIED.
5. Mayor Wolf closed the regular meeting and Council went into
executive session at 7:34 p.m. to discuss possible
litigation. The regular council meeting was reopened at
8:30 p.m. by Mayor Wolf.
93-169 MOTION BY BOB GALLAGHER, SECONDED BY MARTHA PARSONS THAT THE
MAYOR BE AUTHORIZED TO APPROVE A SETTLEMENT OF THE SHORELINE
PERMIT APPEAL UNLESS THERE IS ADEQUATE TIME FOR A SPECIAL
CITY COUNCIL MEETING. MOTION CARRIED.
6. Apple Tree removal - Mayor Wolf read a letter presented by
Darryl Grills and other Yelm Cove Apartment residents
requesting removal of the apple tree at McKenzie and
Solberg. Neighborhood children throw the apples at
passing/parked cars. Tim Peterson explained that the tree
is in City right-of-way and that ordinance requires Council
approval prior to removing any tree. In response to
comments concerning maintenance/upkeep of the Cove
Apartments, Mayor Wolf requested that Chief Dunnam stop by
to speak with the manager about the property owner's
responsibilities.

93-170 MOTION BY MARTHA PARSONS, SECONDED BY SECONDED BY DON MILLER
THAT THE APPLE TREE ON CITY RIGHT-OF-WAY AT MCKENZIE AND
SOLBERG BE REMOVED. MOTION CARRIED.
7. Cable TV Rate Regulation - Agnes Colombo explained that a
packet of information had been received today from AWC
concerning the City's powers as franchising authority. FCC
form 328 would be the first step in becoming a rate
regulator. The new baseline customer service standards
cover office hours, telephone availibility, installations,
outages, service calls, communications, billings and
refunds. As time did not permit a complete review of the
material staff recommended following through with the
application and required letter to Viacom while staff
continued to study the issue.

8. New Business:
a. Ordinance No. 477
93-172 MOTION BY AMOS LAWTON, SECONDED BY MARTHA PARSONS ADOPTING
ORDINANCE NO. 477 TRANSFERING FUNDS FROM CUMULATIVE RESERVE
TO CITY STREETS TO COVER THE STREET SWEEPER PURCHASE.
MOTION CARRIED.
b. Ordinance No. 478
93-173 MOTION BY BOB GALLAGHER, SECONDED BY DON MILLER ADOPTING
ORDINANCE NO. 478 ESTABLISHING A FUND (108) FOR DONATIONS TO
THE YELM TIMBERLAND LIBRARY. MOTION CARRIED.
c. Ordinance No. 479
93-174 MOTION BY DON MILLER, SECONDED BY AMOS LAWTON ADOPTING
ORDINANCE NO. 479 ESTABLISHING A HOTEL/MOTEL TAX FUND (107).
MOTION CARRIED.
d. Ordinance No. 480
93-175 MOTION BY DON MILLER, SECONDED BY MARTHA PARSONS ADOPTING
ORDINANCE NO. 480 ESTABLISHING A EMERGENCY/DISASTER FUND
(106). MOTION CARRIED.
9. Old Business:
a. Resolution No. 296 - Sewer Capacity. Shelly Badger
requested that this item be tabled to the next meeting.
93-176 MOTION BY BOB GALLAGHER, SECONDED BY AMOS LAWTON THAT SEWER
CAPACITY RESOLUTION NO. 296 BE TABLE TO THE SEPTEMBER 8,
1993. MOTION CARRIED.
b. Port of Olympia, FTZ Agreement. Shelly Badger
explained that an examination of the 1993 budget with
possible areas of savings in mind had allowed negotiations
allowing payment of $1,000 now, with the $6,500 balance to

be paid at the beginning of the 1994 fiscal year.
93-177 MOTION BY MARTHA PARSONS, SECONDED BY AMOS LAWTON THAT THE
CITY ACCEPT THE FOREIGN TRADE_ ZONE AGREEMENT WITH THE PORT
OF OLYMPIA. MOT-ION CARRIED.
c. Post Office Traffic Light - A citizen request had been
received concerning the feasibility of a traffic light at
the Third St. and Yelm Ave. intersection. Shelly Badger
explained that the Yelm Transportation Plan set acceptable
levels of service for ,each intersection within the City and
that new development would be required to bring traffic back
to accepted levels. Shelly offered to check and see how
close we are to maximum levels and explained that the Y-2
alternative will alsoimpact traffic at that intersection.
Shelly indicated that it was no_t as simple as requesting a
light. She will speak with DOT and ask Mark Cook for input.
Martha Parsons felt that we must not allow a solution to
drag on, like the Reservation Road bridge replacement did.
Don Miller told Councilmembers that the Post Office had just
signed a five year. contract for this site. Glenn Dunnam
pointed out that this is the second most used area in the
City. Shelly Badger felt that the traffic light planned for
Nisqually Plaza may halp by creating traffic breaks.

SHELLY BADGER INVESTIGATE THE POSSIBILITY OF A TRAFFIC LIGHT
AT YELM AVENUE AND THRID STREET AND INSTIGATE APPROPRIATE
ACTION. MOTION CARRIED.
10. Reports:
a. Planning Commision, 8/16/93 meeting - Martha Parsons
reported that the Gramor/McAlexander driveway issue had been
moved to the September 14 meeting. Shelly Badger reported
that the site plan for~the fire district project had been
approved.
b. Library Report - Kristin Blalack reported that the
final circulation for July was 9, 634 items, up 36$ over July
of 1992. Councilmembers received copies of the Librarian's
Report in their packets.
c. Council Liaison Reports
1. City Hall/Court - Bob Gallagher reported that
Daisy Lawton was home from the hospital and
recovering nicely. Kathy Wolf expressed her
appreciation to Dana Morgan for her efforts in
coordinating the first annual picnic. Everyone
had a wonderful time.
2. Police - Amos Lawton explained that the PD was
keeping busy but that he had not had the
opportunity to spend much time with them. Kathy

Wolf pointed out a letter of appreciation to the
YPD and thanked Glen to for the good job he
continues to do. Amos thanked Glen, Shelly and
.Barb for their support during Daisy's surgery and
recovery.
3. Public Works - Amos Lawton asked Tim Peterson to
speak as Amos had not been in contact recently.
Tim explained that all was going well ... between
water line breaks. Chief Dunnam pointed out that
Tim Peterson continues to pull double duty acting
as animal control officer as well as his Public
Works duties.
4. Sewer - Shelly Badger indicated that work
continues on the project.
5. Intercity Transit Service Report - Don Miller
explained that $5 people had turned out for the
public gathering staged for distribution of
information. A public celebration is planned for
August 30 at 3:45 at Yelm Middle School. Yelm
Prairie Christian Center has agreed to use of
their lot as a park and ride lot. The route
takes 510 to the Wye, then the Yelm-Tumwater
Highway to College. then to South Sound Center.
The last bus of the day arrives in Yelm at 7:30
p.m.
Mark Cook and Tim Peterson looked at the
suggested stops. Tim Peterson explained that
stops are marked on the street in white paint and
asked that comments be passed along to staff.
11. Correspondence was reviewed. Mayor Wolf pointed out
information received suggesting possible ways to celebrate
Children's Day and requested that as many suggestions be
followed as possible.
12. Meeting adjourned at 9:15 p.m.
