All present joined in the flag salute. Council present: Don Miller, Martha Parsons, Patty Forrester, Amos Lawton and Bob Gallagher. Visitors: Delwynn Greene, Diane D'Acuti, Jeri DeLaPena and Lisa R. Thresse. Staff: Shelly Badger, Glenn Dunnam, and Agnes Colombo. 2. Agenda additions/deletions. 94-11 MOTION BY AMOS LAWTON, SECONDED MARTHA PARSONS APPROVING THE AGENDA AS AMENDED BY ADDITION OF FMHA PAYMENT TO VOUCHERS. MOTION CARRIED. 3. Minutes of January 12, 1994. 94-12 MOTION BY MARTHA PARSONS, SECONDED BY PATTY FORRESTER APPROVING MINUTES OF JANUARY 12, 1994 AS WRITTEN. MOTION CARRIED. 4. Approval of vouchers. 94-13 MOTION BY SOB GALLAGHER, SECONDED BY MARTHA PARSONS APPROVING PAYMENT OF $8,280.96 FOR VOUCHERS 16367~THROUGH 1637,. MOTION CARRIED. 94-14 MOTION BY MARTHA PARSONS, SECONDED BY PATTY FORRESTER APPROVI' JANUARY 1994 PAYROLL. MOTION CARRIED. 5. Council Poll of 1/25/94 concerning siting of prison in the community. 94-15 MOTION BY PATTY FORRESTER, SECONDED BY AMOS LAWTON THAT MINUTES REFLECT THE RESULTS OF TUESDAYS COUNCIL POLL THAT THE CITY NOT PURSUE A POSSIBLE PRISON SITING IN THE COMMUNITY. MOTION CARRIED. 6. Vacant 7. New Business: a. Park Ordinance No. 489, first reading. Questions were raised by Councilmember Parsons concerning the change from advisory to decision making board in some areas and about who would comprise the proposed Park and Recreation Department. Shelly Badger felt that additional clarification was needed and as Councilmember Forrester concurred that a delay at this point would not create difficulties a postponement was suggested. 94-16 MOTION BY MARTHA PARSONS, SECONDED BY DON MILLER POSTPONING ACTION ON PARK ORDINANCE NO. 489 TO THE FEBRUARY 23, 1994 MEETING. MOTION CARRIED. b. Resolution No. 309 nominating the Yelm Transportation Plan for the American Planning Association and Planning Association of Washington Joint 1994 Award. Bob Hazlett explained that the resolution was a nomination requirement. Hazlett said that Yelm Transportation Plan broke new ground, used an innovation approach a:. He also indicated that this nomination, along with the letters of endorsement could be helpful when applying for grants to fund projects. -17 MOTION BY MARTHA PARSONS, SECONDED BY SOB GALLAGHER ADOPTING RESOLUTION 309 NOMINATING YELM'S TRANSPORTATION PLAN FOR THE AMERICAN PLANNING ASSOCIATION AND PLANNING ASSOCIATION OF WASHINGTON JOINT 1994 AWARD. MOTION CARRIED. c. Cabaret License Application for Firehouse Tavern. Shelly Badger explained that the building official had visited the premises and that the owner has agreed to limit the number of events to no more than three per year. An agreement, as per the Yelm Municipal Code, for the owner to assume responsibility for costs of additional law enforcement, if needed, has been added to the application form. 94-18 MOTION BY DON MILLER, SECONDED BY AMOS LAWTON APPROVING A CABARET LICENSE FOR FIREHOUSE TAVERN. MOTION CARRIED. 9. Old Business: a. Park Use Request - Prairie Street Rod Car Show and Swap Meet. This is an annual event. 94-19 MOTION BY BOB GALLAGHER, SECONDED BY PATTY FORRESTER APPROVING THE REQUEST FOR THE ANNUAL PRAIRIE STREET ROD SHOW AND SHINE AND SWAP MEET, WITH THE USUAL CONDITIONS. MOTION CARRIED. 10. Reports: a. Planning - Shelly Badger told Councilmembers that a rezone recommendation would be before Council at the 2/9/94 meeting and that the Yelm Master Plan Ordinance would be before the Planning Commission on 2/7/94. The SW Yelm Annexation Master Plan will be based upon Yelm's. ^ A worksession preceding the regular council meeting was scheduled for 6:00 pm, Wednesday, February 9, 1994 to review the Yelm Master Plan. A copy of the Engineer's Report was included with tonight's handouts. Shelly Badger reported that the new alignment for 103rd was in place. And that the City had received a signed agreement from DOT so Yelm Ave. improvements should begin soon. Delwynn Greene questioned the alignment at Vancil Road and Yelm Ave. Shelly Badger explained that this was the best approach possible at this time and that additional changes would take place when improvements were made on the south side of Yelm Ave. b. Library Report - Mayor Wolf explained Kristin Blalack's absence and told Councilmembers that library activity continues to increase, December '94 activity showed a 12$ increase over December '93. 'I i Councilmember Miller believed that the City is approaching the time when it should be looking towards larger City Hall facilities and possibly turning the existing facility over to the library. CITY COUNCIL JANUARY 26, 1994 PAGE 2 ®DO~~ c. Council Liaison Reports: 1) City Hall - Dana has returned to work following her recen marriage. Daisy is back and has worked up to 145 hrs. p/month. 2) Court - Councilmember Miller plans to attend tomorrow. 3) Police - Councilmember Lawton reported that the Polic Department continues to be busy. Chief Dunnam reported that the City's staff car was broken into and the cellular phone stolen, recovery and repair have taken place. The PD is working on an abatement with a 30 day eviction notice and are trying to coordinate civil and criminal procedures. 4) Public Works - Councilmember Lawton reported that Public Works continues to be incredibly busy and doing an excellent job. Information is being gathered for an examination and comparison of the City's water rates. 5) Sewer - Shelly Badger reported that the Preconstruction meeting was held on Monday 1/24/94 for Contract III, the on-site STEP tanks and for Contract IV, Yelm Ave. collection lines from 103rd to Creek and from Cullens to 93rd. Shelly Badger told Councilmembers that the Dept. of Ecology issued NPDES discharge permit,~allowing discharge of treated wastewater into the canal and river, had been received and that Treatment Plant is receiving gray water from McDonalds and Mill Pond School at this time. Staff is continuing~to pursue funding for wastewater reuse and for a consulting engineer who will soon be needed for the project. d. Mayor's Report - Mayor Wolf began by expressing her thanks ~v Chief Dunnam and Tim Peterson for their assistance at Mond evening's meeting. Mayor Wolf attended the Thurston Region .Planning Council and reported the Yelm School District had also joined TRPC. Additional meetings attended include STOP the Violence; . the Lion's Club where she spoke about development; Mayor's Forum on 1/19/94, Margaret and Liz Clapp were thanked for providing space in the conference room at Prairie Park Motel; Port of Olympia; Nisqually River Council where Mayor Wolf is replacing Diane Oberquell as chair; Town Meeting on 1/24/94; and the Water Rate Committee meeting. Mayor Wolf read a letter from Owens Davies Mackie requesting Yelm's consent to permit the firm to represent Rainier. While no conflict is expected, if a conflict did arise they would not represent Rainier in the area of conflict or withdraw entirely if necessary. Mayor Wolf explained that this consideration was one of the reasons the City was so pleased with Owens Davies Mackie as Yelm's attorneys and that Yelm would approve~~the agreement. e. Council Report - Councilmember Gallagher reported that he had attended the Transportation Advisory Committee meeting with other new members and bylaws were discussed. Next meeting on 2/16/94. Councilmember Forrester reported that she had met with the Make Yelm Attractive Committee where work' is in progress on landscaping a~ CITY COUNCIL PAGE 3 JANUARY 26, 1994 ~~~~ ~.~ signage requirements and that during a visit to the Senior Center she had been asked to pass along their thanks for Yelm's contribution. Councilmember Forrester thanked Mayor Wolf for her professional demeanor and stated that she was proud to serve with Mayor Wolf. f. Court Report - volume for 12/93 showed 158 tickets received, with 58 criminal and 100 infractions processed. g. Chief Dunnam reported on the status of DWI bills. The Applewick Bill is scheduled for next month. The Smith/Quigly Bill would establish three classifications: Level 1 DWI......Mandatory two days in jail Level 2 DWI......Mandatory seven days in jail Level 3 DWI......(third time offender) Class C Felony, becomes the state's responsibility In response to a citizen's inquiry, Chief Dunnam reported that tickets are being printed for the Spaghetti Feed/Skateboard Park Fundraiser. Tickets should go on sale next week at $3 per ticket. Staff was requested to post WSU Cooperative Extension Classes at the library and city hall. Delwynn Greene requested that the street lighting situation on Yelm Avenue, in front of the School District Administration Office, be checked as the trees block the light. In response to a citizen's inquiry, Chief Dunnam explained that Yelm does have an emergency plan and that it was being reviewed by the state for approval at this time. Possible means of material distribution include the phone book, weekly tips in the newspaper and through the schools. Chief Dunnam indicated that ham radio operators had not been included in the plan as the airways would already be busy with emergency communications. He agreed to look into and put together information on which local radio stations local residents should tune to for updates during an emergency. Correspondence was reviewed.
