1. The meeting was called to order at 7:30 pm by Mayor Wolf, all
present joined in the flag salute.
Council present: Bob Gallagher, Martha Parsons, Amos Lawton
and Velma Curry. Absent: Don Miller. Guests: Gay Newby,
Rodney Orosko, Nisqually Valley News, Faith Hagenhofer, Dean
Hooper and E.J. Curry. Staff: Shelly Badger, Ken Garmann,
Ty Peterson, Glenn Dunnam and Agnes Colombo.

THE AGENDA WITH MOVEMENT OF ITEM 9 TO 2.a. AND CORRECTING
ITEM 7 TO READ RESOLUTION 321. CARRIED.
94-170 a.MOTION BY MARTHA PARSONS, SECONDED BY BOB GALLAGHER THAT
VELMA CURRY'S APPLICATION FOR THE VACANT COUNCIL POSITION BE
ACCEPTED. CARRIED.
94-171 3. MOTION BY MARTHA PARSONS, SECONDED BY AMOS LAWTON APPROVING
AUGUST 10, 1994 COUNCIL MINUTES AS PRINTED. CARRIED.
94-172 4. MOTION BY SOS GALLAGHER, SECONDED BY AMOS LAWTON APPROVING
THE AUGUST 1994 PAYROLL. CARRIED.
94-173 5. MOTION BY BOB GALLAGHER, SECONDED BY MARTHA PARSONS APPROVING
PAYMENT OF VOUCHER 17166 TOTALLING $405,679.06. CARRIED.
6. Faith Hagenhofer expressed her willingness to continue
serving on the Thurston Council on Cultural Diversity and
Human Resources. Faith explained that the Council deals
primarily with issues presented by Thurston Co. residents and
will be holding an educational forum in the fall.
Recent activities included sending members to assess Pierce
County's proposed program for mandatory employee cultural
diversity training. She indicated her willingness to take
any issues the City would like input on to the Council and
requested guidance on reporting to the City Council.
Mayor Wolf thanked Ms. Hagenhofer for her service and
suggested that as the Cultural Diversity Council minutes
are sent to the City, reporting on an irregular basis or as
items of interest arise would be optimal.
7. Resolution No. 321. Staff explained that this is a standard
resolution that would be replacing one that had expired.

8. Public Hearing - (ANX8089) Canal Rd. Annexation. (Staff
Report: dated August 9, 1994.) Mayor Wolf opened the
public hearing at 7:43 p.m. No objections to participants or
conflicts of interest were identified. Ty Peterson explained
that the original petition was received over a year ago and
that due to irregular boundaries, the applicant had been
directed to pursue annexation of the entire area back to
existing city limits. This attempt was not successful. The
Planning Department and Yelm Planning Commission recommend
approval, with the area between Canal Rd and the city limits
being zoned Industrial and the remaining area be zoned
Residential Agricultural 1-5. Shelly Badger: additional
recommendation that water rights be transferred to the City.
Applicants Comments: Craig Steepe, representing the
applicants, indicated that the attempts to include the area
needed to square the boundaries had been unsuccessful and
requested that Council consider the work involved over the
last year and a half.
Being no response to call for public or Council comments the
public hearing was closed at 7:54 p.m.
94-175 MOTION BY BOB GALLAGHER, SECONDED BY AMOS LAWTON THAT THE
CANAL ROAD ANNEXATION BE APPROVED AS RECOMMENDED BY THE
PLANNING DEPARTMENT AND PLANNING COMMISSION AND THAT WATER
RIGHTS TRANSFER TO THE CITY BE REQUIRED. CARRIED.
9. Executive Session - cancelled, see 2a
10. Public Comments:
Dean Hooper requested additional information on the kinds of
issues the Thurston Council on Cultural Diversity examined.
Faith Hagenhofer responded that the council had looked into
an accusation of use of an illegal substance at an Olympia
park and economical differences in regard to the North
Thurston School District.
11. New Business:
a. Parkview Final Plat. (Staff Report dated August 15,
1994.) Ken Garmann introduced project proponent David Frick
and explained that project and punch list items had been
completed and that the Planning Commission recommended
approval of the final plat.

12. Old Business:
a. Open Space Ordinance No. 516. (Memorandum dated August 24,
'1994) Jim Blundell explained that consideration of two

recent Washington State Supreme Court decisions had prompted
modifications to the ordinance. Copies of the revised
ordinance had been distributed to Council. Mr. Blundell
explained the changes including: allowing the developer to
choose between dedication and fee-in-lieu; allowing level of
service to be satisfied by a combination of dedications,
fees-in-lieu, and grants/gifts as provided in the
Comprehensive Plan; requiring use of funds within the same
park service area as development; and requiring that funds be
expended in five years.
94-177 MOTION BY BOB GALLAGHER, SECONDED BY AMOS LAWTON ADOPTING THE
PARKS AND OPEN SPACE ORDINANCE NO. 516. CARRIED.
b. Long Term Care. Council was provided with a report on the
cost and coverage available and requested to contact Agnes
Colombo with any questions for the provider.
13. Reports:
a. Planning: Tom Gorman has agreed to be the Yelm Planning
Commission Chair and Joe Huddleston the Vice-Chair; the SW
Yelm Conceptual Plan has been approved and is scheduled for
a work session at 6:00 and public hearing at the September
14, City Council meeting; Ed Pitts and Adam Rivas have been
appointed to fill the existing vacancies on the Planning
Commission.
b. Library - Kristin Blalack was ill and unable to attend.
Mayor Wolf read her report.
c. Council Liaison Reports:
1) City Hall -Mayor Wolf read Dale Sylvester's letter of
resignation and requested a letter of acceptance and
thanks be sent to him.
2) Court - 7/94 report showed 73 criminal citations and
106 infractions.
3) Public Works: Crystal Springs Estates Plat has been
signed and sent for recording; working on the 1995
budget; targeting businesses along Yelm Ave. for lot
cleanup, property owners will be asked for assistance;
situation with septic system malfunctioning floats is
being corrected.
4) Police - additional skateboard park contributions
received: $2,700/Thurston County; $250/Thurston Co.
Sheriff's Dept.; $500/United Way. $3,650 away from goal
to begin Phase I of the project.
Public Hearings will be scheduled for the 9/14/94 meeting
to consider the rezone of half a block to CBD or C-1 and
for a similar use determination for the parking lot and
skateboard park.
The library has requested a meting with staff to discuss
the locations of the parking lot and skateboard park and
to~ determine the amount of land remaining for future
library use.

Chief Dunnam distributed copies of a draft ordinance
exempting Yelm from RCW 9.41.050, Section 405, Subsection
(4), which would, with certain applicable exclusions,
require firearms to be unloaded and enclosed in an opaque
case or secure wrapper when being transported. Council
approval to prepare and submit a formal ordinance
exempting Yelm from this subsection was requested and
received.
d. Mayor - meetings attended: 3/12 Thurston Regional
Planning Council; 8/13 Vision; 8/14 Prairie Rod Show; 8/16
Heartwalk and Yelm Telephone Co; 8/17 Mayor's Forum; 8/18
Chamber; 8/19 Nisqually River Council; 8/20 city picnic;
8/22 Skatter Creek rest stop (Scholarship Committee).
Applicants are being sought to fill a vacancy on the Parks
Advisory Board.
Upcoming events: Nisqually Basin Land Trust's Festival of
Waters on 9/11, flyer posted at Yelm City Hall.
e. Council - Martha Parsons asked about overgrown
shrubbery/grass next to Bill Trull's business. Staff
explained that the owner has been contacted.
