The meeting was called to order at 7:30 pm by Mayor Wolf, all present joined in the flag salute. Council present: Bob Gallagher, Martha Parsons, Amos Lawton and Velma Curry. Absent: Don Miller. Guests: Denise Hendrickson, Dean Hooper and Mary Lou Clemens. SW Yelm Annexation representatives Dennis Su, Bud Welcome, Paul Liao and Anthony Bontrager. Tom Skillings, Skillings and Connolly, Rodney Orosko, Nisqually Valley News and Jim Blundell, Owens Davies Mackie. Staff: Shelly Badger, Ken Garmann, Glenn Dunnam and Agnes Colombo. Mayor Wolf explained that Don Miller had undergone bypass surgery the previous day and was expected to be released on Saturday. 94-202 2. MOTION BY BOB GALLAGHER, SECONDED BY AMOS LAWTON APPROVING THE AGENDA. CARRIED. 94-203 3. MOTION BY MARTHA PARSONS, SECONDED BY BOB GALLAGHER APPROVING THE SEPTEMBER 28, 1994 COUNCIL MINUTES AS WRITTEN. CARRIED. 94-204 4. MOTION BY AMOS LAWTON, SECONDED BY MARTHA PARSONS APPROVING VOUCHERS #17273-17368, TOTALLING $108,361.58. CARRIED. 5. Conceptual Plan Briefing - Shelly Badger explained that the next briefing is scheduled for 10/26/94 at 6:45 pm, and encouraged all interested parties to attend and to pick up a draft copy at city hall. 6. Vacant. 7. Public Comment/Questions. Dennis Su introduced Bud Welcome and Paul Liao. Bud Welcome stated that he was comfortable with the SW Yelm Conceptual Master Plan, except for the provisions applying commercial restrictions. He felt that commercial restrictions could create difficulties in obtaining funding and should not exceed five years. Paul Liao explained that work had been in progress for 4 1/2 years on the annexation and public hearing process and expressed concerns about the end results. He stated that while most of the contents of the Conceptual Master Plan were acceptable, restrictions on commercial development were not CITY COUNCIL MINUTES OCTOBER 12, 1994 PAGE 1 . ~; y, 3a ~~~~ .~~ and that commercial restrictions should not go beyond a five year period. Mr. Liao also expressed concern about flexibility in developing the club house area and about obtaining financing with so many restrictions attached to the project. 8. Vacant. 9. Old Business a. SW Yelm Conceptual Master Plan. Shelly Badger explained that she believed the proponents had expressed legitimate concerns about commercial restrictions, and that research had shown a good ration of commercial to be 10~. Yelm is below this ratio at this time. The Planning Commission's concerns of the possibility of unrestricted commercial development resulting in an old/new town situation were discussed and considered. Additional concerns expressed were that delays in reaching an agreement could negatively impact Yelm's water reuse project. Gene Borges supported removal of commercial development restrictions after a five year period and explained that a five year window should allow existing businesses time to prepare for competition. He also stressed that agreements with the SW Yelm proponents must be signed and delivered to regulatory agencies on the 20th for the water reuse project to proceed. Mayor Wolf requested the opinion of John Huddleston as a Yelm Chamber of Commerce representative and local businessman. Mr. Huddleston explained that a real concern was the building of a destination shopping point without residential development in place to support the businesses. He allowed that new plats, as well as commercial development, would be dependent upon sewer service and that this requirement provided some safeguards. He felt that many local people support the Thurston Highlands project and added that he found the 5 year restriction acceptable but would still like to see some housing buildout requirement as a show of good faith. He acknowledged that there was really no choice but to move ahead. Mr. Liao explained that he believed that the dollars already spent on the project demonstrated the proponents' commitment to the project and community. 94-205 MOTION BY MARTHA PARSONS, SECONDED BY BOB GALLAGHER THAT THE SOUTHWEST YELM CONCEPTUAL MASTER PLAN BE APPROVED WITH THE FOLLOWING CHANGES TO THE OCTOBER 12, 1994 STAFF MEMORANDUM. ITEMS 1, 2, 3, 4 - AS WRITTEN, ITEM 5 - ADDITION/LAST SENTENCE: SUCH AGREEMENT SHALL BE SIGNED AND EXECUTED BY OCTOBER 17, 1994, AND SUCH LETTERS OF CREDIT, OR A CASHIER'S CHECK FOR THE FULL AMOUNT OF EACH PARTY'S OBLIGATION UNDER SUCH AGREEMENT, BE DELIVERED TO THE CITY BY THE CLOSE OF BUSINESS ON OCTOBER 19, 1994. ITEM 6 - AS WRITTEN. ITEM 7 - P/1, S/1, TOTAL SQUARE FOOTAGE CHANGED TO 330,000; NEW 7 B - CITY COUNCIL MINUTES OCTOBER 12, 1994 PAGE 2 ~~~~ ~. THE REMAINING 315,000 SQ FT OF COMMERCIAL FLOOR SPACE BE ALLOWED AFTER CONSTRUCTION OF 1,250 DWELLING UNITS (25% OF TOTAL DWELLING UNITS ALLOWED) IN THE ENTIRE MASTER PLAN AREA, OR 5 YEARS FROM DATE OF FINAL MASTER PLAN APPROVAL, WHICHEVER IS EARLIER. THE REMAINDER OF ITEM 7 IS DELETED. ITEM 8 - UNCHANGED PORTION: COMMERCIAL DEVELOPMENT WITHIN THE FIVE (5) ACRE COMMERCIAL DESIGNATION NEAR THE CLUBHOUSE IN THE THURSTON HIGHLANDS ASSOCIATES OWNERSHIP SHALL BE CHANGED PORTION: DEVELOPED ACCORDING TO THE CITY'S COMMERCIAL ZONING CODE. LAST SENTENCE OF ITEM 8 TO BE DELETED. ITEM 9 - UNCHANGED TO THE COLON, THEN INSERT NEW: "COMMERCIAL (330,000 SF, SEE PARAGRAPH 4.E.1 AS MODIFIED BY THE CITY COUNCIL}". THE ACREAGE FOR PHASE 17 SHALL BE INCREASED FROM 15 ACRES TO 30 ACRES. ITEM 10 - NEW PARAGRAPH 4.D.2 OF CONCLUSIONS AMENDED BY ADDING: SUCH RECIPROCAL EASEMENT SHALL BE SIGNED AND EXECUTED BY ALL PARTIES BY OCTOBER 29, 1994. CARRIED. 9. b. Ordinance No. 528 94-206 MOTION BY BOB GALLAGHER, SECONDED SY AMOS LAWTON ADOPTING ORDINANCE NO. 528 (ANX8116) GORDER/CRYSTAL SPRINGS ROAD. CARRIED. 10. Reports a. Planning - The Planning Commission is working on development guidelines. b. Parks - Councilmember Curry reported on the Park Board meeting. Christmas in the Park preparations have begun, and assistance was requested for Wednesday, 10/19, to help check tree lights. Mayor Wolf announced that she had appointed Jan Brunk to the Park Board. The first meeting of the Canal Road Park group was held on 10/10. c. Police - Chief Dunnam reported that the department stays busy and requested that $5, 000, that will not be spent in '94, be used to provide clerical assistance for the Chief Administrative Officer. Chief Dunnam announced that no budget increases are anticipated for °95. 94-207 MOTION BY VELMA CURRY, SECONDED BY MARTHA PARSONS APPROVING TRANSFER OF $5,000 FROM PD LINE ITEM TO ADMIN TO COVER COSTS OF TEMPORARY, PART-TIME CLERICAL ASSISTANCE FOR THE CHIEF ADMINISTRATIVE OFFICER. CARRIED. Public Works - Ken Garmann reported that sewer problems at three sites were expected to be resolved, and that based on past experience, Yelm had Experienced a minimal number of alarm call outs. A letter thanking Tim Peterson for taking the time to supervise young people working off assigned community service hours was noted. .~,,. Mayor - Attended: presentation of sandstone monument to Tumwater from Tenino; would like Yelm to acknowledge our sister city relationship with Lacey and express our appreciation to Lacey for assistance received. Other meetings: Extension School Leadership Class tour of city hall; Leadership Thurston Co., bus tour; Heart Walk, good turnout with 19 participants, thanks to Councilmember Parsons for being team leader; meeting with the Chief Executive Officer and Marketing Director of Capital Medical Center. Anyone able to attend the Hands On Children' s Museum function was asked to contact Agnes to RSVP; Council concurred with having Ed Bergh, YHS teacher, contacted for recommendations for young people who might be interested in providing input to Council. g. Council h. Court report for July and August was reviewed. Case calendar showed the number of citations/infractions: July 179; August 133.
