Call to Order. Mayor Rivas called the meeting to order at 7:30 p.m.

APPROVING THE AGENDA WITH THE ADDITION OF PUBLIC
STATEMENT FOLLOWING ITEM 4. CARRIED.

Special Presentations - None Scheduled
Councilmember Isom stated that the Finish Line Committee's report was
the result of hard work by a group of private citizens, not acting on behalf
of the City. He does not believe their efforts are for personal financial
gain, and that the committee acted honorably, and with the best
intentions. He also believes that the individuals opposing the action
believe they are acting in the best interests of the community.
Councilmembers have not stated a position because they cannot and
should not take a public stand on issues not before them as a legislative
body. And that if and when a proposal is brought before council, it will
be considered openly and honestly. He has received offensive letters
questioning his integrity and honesty from individuals who do not know
who he is or what his intentions are.
He closed saying that this is the last time he will be discussing this issue
until it is before the council as a whole.
Councilmember's added comments concerning letters threatening
boycotting businesses, meetings presenting only on side of an issue and
comments made and received in correspondence.

Public Comment - Mayor Rivas allowed 15 minutes for public
comment.
Brett Jackson, 105th Way, expressed safety concerns about management
of a road project on Clark Road and 105th and requested that the City

consider paving the road to the Baker Hill Water Tower, estimating the
cost of 1,000 feet at $12,000. Mayor Rivas requested that staff research
the issues and contact Mr. Jackson.
Keith Parker, Van Trump Ave., expressed concern about access to his
driveway. Mayor Rivas requested that staff research the issue and
contact Mr . Jackson.
Danielle Graham, 93rd Ave SE, commented on how proud she is of our
community .
Roberta Longmire expressed disappointment that Councilmembers didn't
attend a meeting at Yelm High School and distributed information from
the meeting. Council accepted Mrs. Longmire's information packets.
Edward Wiltsie, Reichel Rd, spoke about NASCAR and water issues.

Public Hearing(s)
Sewer/Reclaimed Water Rate Increase. Mayor Rivas opened the public
hearing at 8 p.m. calling for a staff report. Stephanie Ray reported that
every utility customer had received an informational flyer, enclosed with
the August utility bill, that provided proposed rate increases and
effective dates; and locations, times, and dates for 1) the open house
discussion forum on the proposed increases, and 2) tonight's public
hearing. Three people attended the open house held on August 9 at Yelm
Public Works.
Mayor Rivas called for comments/questions. Staff addressed questions
about the number of utility customers.
Councilmember Isom commended Ms. Ray for the way she conducted
the open house.

Executive Session - None Scheduled
12.
Correspondence reviewed at the meeting included award of a $1,000
A WC grant for sewer pump-station surge protectors and an 'A' rating on
Yelm's annual loss control inspection.

Being no additional questions/comments Mayor Rivas closed the public
hearing at 8:04 p.m.
Ordinance No. 810 setting sewer/reclaimed water rates for 2004-2009.

ADOPTING ORDINANCE NO. 810 SETTING
SEWERlRECLAIMED WATER RATES FOR 2004-2009.
CARRIED.
New Business
Ordinance No. 813 Closing the 1993 General Obligation Bond Fund and
transferring remaining funds to the Current Fund Reserve Line. Mayor
Rivas called for the staff report. Staff reported that council approved
early retirement of the 1993 GO Bond as part of the 2004 Budget. The
bond has been paid and this ordin8nce allows the fund to be closed with
any remaining funds being transferred to the General Fund Reserve line.
MOTION BY DON MILLER, SECONDED BY PAT FETTERLY
ADOPTING ORDINANCE 810 AUTHORIZING CLOSURE OF
FUND 202 WITH FUNDS GOING TO THE CURRENT FUND
RESERVE LINE. CARRIED.
Old Business
Ordinflnce No. 812 Amending the City ofYelm Sign Code. Mayor Rivas
called for the staff report. Tami Merriman reported that Grant Beck met
with chamber members and interested business people concerning the
changes. A correction to Section 6 was noted.
Areas of discussion included home occupation signs, illuminated signs,
and who bears the burden for claiming nonconforming status for a sign.

ORDINANCE NO. 812 AMENDING THE CITY OF YELM SIGN
CODE. CARRIED. ABSTAINED: PAT FETTERLY.
Mayor and Council Reports and Initiatives and Board/Commission
Business
Councilmember Baker attended the SW AC meeting where tire disposal
issues were discussed.
Councilmember Isom attended a TRPC meeting held at the Timberland
Regional Library Services Center. The committee worked on a draft
diversity statement. He will be serving on the budget committee.
Councilmember Fetterly attended the Nisqually River Council meeting.
Mayor Rivas announced that Councilmember Fetterly won the 'Spud
Race' at the Thurston County Fair with her potato car entry.
