720 Readopting Ord 684CITY OF YELM ORDINANCE NO. 720 AN ORDINANCE OF THE CITY OF YELM, WASHINGTON, READOPTING ORDINANCE NO. 684 ESTABLISHING GUIDELINES AND RATES FOR THE SALE OF RECLAIMED WATER A NEW PRODUCT PRODUCED AT CITY FACILITIES. WHEREAS, on December 8, 1999, the City Council passed Ordinance No. 684 to encourage the use of reclaimed water while assuring the health and safety of the citizens of Yelm and the protection of its environment, and WHEREAS, Ordinance 648 created a policy for the sale and use of this reclaimed water, set rates for the sale of this new product and recognized the advantages of utilizing reclaimed water to reduce the need for additional potable water, and was adopted only after a study producing findings demonstrated that the policies and rates established by Ordinance 648 were in the best interests of the City and there was no intent by the Council to avoid a possible requirement of voter approval of future rate adjustments, and WHEREAS, Initiative Measure 722 declared ordinances relating to taxes and fees adopted between July 2, 1999 and December 31, 1999 to be void and of no effect. Therefore, it is necessary to readopt the provisions of this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON, as follows: Section 1. Ordinance No. 684, a copy of which is attached hereto, is hereby readopted in its entirety. Section 2. Severability. If any section, subsection, paragraph, sentence, clause, or phrase of this ordinance is declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining parts of this ordinance.
