719 Readopting Ord 683CITY OF YELM ORDINANCE NO. 719 AN ORDINANCE OF THE C[TY OF YELM, WASHINGTON, READOPTING ORDINANCE NO. 683 PROVIDING FOR A SEWER SERVICE RATE INCREASE IN ORDER TO ACCOMMODATE OPERATING AND MAINTENANCE COST INCREASES AND DEBT REPAYMENT COSTS. WHEREAS, on November 23, 1999, the City Council passed Ordinance No. 683 for the purpose of providing adequate revenue to maintain and operate the City's Waste Water/Reuse Treatment Facilities and to meet the City's legal obligation to repay bond holders, and WHEREAS, the amount of this charge was adopted only after a study of rates demonstrated that that periodic rate increases are necessary to meet the costs of providing services and meeting debt repayment costs, and WHEREAS, there was no intent by the Council to avoid a possible requirement of voter approval of future rate adjustments, and WHEREAS, Initiative Measure 722 declared ordinances relating to taxes and fees adopted between July 2, 1999 and December 31, 1999 to be void and of no effect. Therefore, it is necessary to readopt the provisions of this Ordinance. NOW, THEREFORE, follows: BE [T ORDAINED BY THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON, as Section 1. Ordinance No. 683, a copy of which is attached, is hereby readopted in its entirety. Section 2. Severability. If any section, subsection, paragraph, sentence, clause, or phrase of this ordinance is declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining parts of this ordinance.
