764 Amend Yelm Comprehensive PlanORDINANCE NO. 764
AN ORDINANCE OF THE CITY OF YELM, WASHINGTON, AMENDING
the Yelm Comprehensive Plan.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Adoption:
In accordance with the requirements of Chapter 37.70A Revised Code of
Washington, the Yelm City Council does hereby adopt the amended Yelm
Comprehensive Plan.
Section 2. Findings of Fact.
The findings and assumptions supporting the Yelm Comprehensive Plan are as
follows:
I. GENERAL FINDINGS
A. The Growth Management Act (GMA), Chapter 36.70A RCW, requires
certain Counties and the Cities located within those Counties adopt
Comprehensive Plans which are guided by the GMA's goals and which
meet the GMA's requirements. Thurston County and the City of Yelm are
required to Plan pursuant to the GMA.
B. THE GMA requires Cities within it's jurisdiction to adopt Comprehensive
Plans which contain certain elements, including protecting critical areas
and surface water and ground water resources; a utilities element and
capital facilities element; a land use element designating the proposed
general distribution and general location and extent of the uses of land.
C. The amendments to the Comprehensive Plan adopted by this Ordinance
were prepared, considered, and adopted in compliance with the GMA and
the County-wide Planning Policies.
D. The City of Yelm Planning Commission held a duly advertised public
hearing on the proposed amendments on June 17, 2002. After receiving
public testimony and deliberating on the propos changes to the
Comprehensive Plan, the Planning Commission recommended
unanimously that the City Council adopt the proposed amendments.
E. The City of Yelm Responsible Official issued an addendum to the Final
Environmental Impact Statement for the City of Yelm Comprehensive Plan
and Joint Plan with Thurston County. This addendum fulfils the City's
responsibility for environmental review pursuant to the State
Environmental Policy Act, Chapter 58.17 RCW.
F. This Ordinance amends the existing 1995 Yelm Comprehensive Plan.
G. The measures adopted by this Ordinance comply with the GMA and other
governing laws and are reasonably related to the public health, safety, and
welfare.
H. The Growth Management Act at Section 36.70.130 (1) requires that each
City planning under the act take action to review and, if needed, revise its
Comprehensive Land Use Plan and Development Regulations to ensure
compliance with the GMA.
II. FINDINGS RELATING TO THE ENVIRONMENTAL CHAPTER UPDATE
A. The GMA requires that Cities planning under the act adopt regulations to
protect critical areas, including water resources.
B. The proposed amendments to the Environmental Chapter of the
Comprehensive Plan creates sub-categories for water resources,
including: aquifer recharge areas; wellhead protection areas; wetlands
and streams; shorelines; and frequently flooded areas.
C. The amendments provide a more detailed description for each of the
natural resources, with specific goals and policies that pertain to each
resource.
D. The amendments add Noise and Air Quality as elements of the
environment and specific goals and policies.
E. Best available science was employed in the amendments to the goals and
polices of the Environmental Chapter and the amendments future require
the inclusion of best available science in the adoption of development
regulations to protect the functions and values of critical areas.
III. FINDINGS RELATING TO THE WATER PLAN UPDATE
A. The GMA requires Cities planning under the act to include utilities as a
mandatory element in its Comprehensive Plan.
B. The City of Yelm Comprehensive Water Plan is a guidance document that
helps ensure a safe and efficient public water system, and helps
determine current and future water system needs.
C. The Washington State Department of Health requires that the
Comprehensive Water Plan be updated every six years.
D. The Comprehensive Water Plan update reviews the need for new water
sources, provides options regarding the ground water source under the
influence of surface water determination at well 3A, analyzes the
distribution system and identifies necessary system improvements to meet
the future six and 20 year growth requirements.
E. The Comprehensive Water Plan includes an updated financial analysis.
F. The updated Comprehensive Water Plan, pursuant to federal and state
requirements, addresses the need to ensure that the water source and
distribution system will continue to provide safe, clean drinking water. A
wellhead protection plan and cross connection control plan are methods of
protecting the source and distribution system.
G. Reclaimed water is included in the updated Comprehensive Water Plan.
IV. FINDINGS RELATING TO THE REDEISIGATION OF FIVE (5) LOTS FROM
INDUSTRIAL (I) TO MODERATE DENSITY RESIDENTIAL (R-6)
A. The Yelm Chamber of Commerce, City of Yelm, Thurston County
Economic Development Council, and the Port of Olympia completed a
Market and Development Assessment for the Yelm Industrial Area in
2001.
B. The assessment included a land use analysis of the industrial zoned
properties in the City of Yelm and its Urban Growth Area.
C. The assessment concluded that there is a significant amount of residential
encroachment into the industrial area. The five parcels being
redesignated are in the city limits, are predominately residential and are
surrounded by residential uses or zoning.
D. The assessment concluded that the five parcels are highly unlikely to
redevelop as industrial.
E. It is appropriate that the five parcels be redesignated from Industrial (I) to
Moderate Density Residential (R-6).
Section 3. Severability.
If any provision of this Ordinance or its application to any person or circumstance
is held invalid, the remainder of the ordinance or the application of the provisions
to other persons or circumstances is not affected.
Section 4. Effective Date.
This Ordinance shall be in full force and effect from and after its passage,
approval, and publication as provided by law.
