753 Licensing and Control of Pet AnimalsCITY OF YELM ORDINACE NO. 753 AN ORDINANCE of the City of Yelm, Washington, relating to the public health, safety, and welfare and providing for the licensing and control of pet animals within the City; authorizing fees/charges for Animal Control activities, and criminal sanctions and enforcement, and repealing and replacing Yelm Municipal Code Title 6, Chapter 6.04 and 6.08 in their entirety and Ordinances related to those two Chapters. WHEREAS, the City of Yelm recognizes a need to update existing Animal Control regulations enacted over the years; and WHEREAS, the City of Yelm has determined that the regulation and control of animals within the City is necessary for the safety of residents and to promote harmony between neighbors; follows: NOW, THEREFORE, be it ordained by the City Council of the City of Yelm, as Section 1. REPEALED. Yelm Municipal Code, Title 6, Chapter 6.04, Impounding Stray Livestock and 6.08, Animal Regulations and the corresponding ordinances upon which they were enacted and/or amended are repealed in their entirety to include: A. Ordinance No. 18, (05/1927). An ordinance prohibiting livestock from running at large and authorizing the care and sale of stray animals to the police chief. B. Ordinance No. 356, (06/1989). An ordinance providing for the licensing and control of animals within the City and providing for fees, penalties, criminal sanctions and enforcement. C. Ordinance No. 463, (05/1993). An ordinance providing for setting licensing fees and violation sentencing guideline fees by resolution of the Yelm City Council. D. Ordinance No. 515, (08/1994). An ordinance requiring impounded dogs to have an Identifying micro-chip implanted prior to release. E. Ordinance No. 536, (12/1994). An ordinance creating a Licensing Fee Exemption for Service Dogs. Section 2. ADOPTION BY REFERENCE. Yelm Municipal Code, Title 6, Chapters 6.04 Impounding Stray Livestock, 6.08 Animal Regulations, and 6.09 Interference With Officer are hereby adopted by reference as if set forth in full. City of Yelm Ordinance No. 573 Page 1 of 2 ab/legal/2002/573 Section 3. REPEALER. All ordinances or part of ordinances inconsistent with the provision of this ordinance are hereby repealed. Section 4. SEVERABILITY. If any provisions of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance or the application of the provisions to other persons or circumstances is not affected. Section 5. EFFECTIVE DATE. This ordinance shall take effect five days after its passage, approval and publication. PASSED and APPROVED by the Yelm City Council, and approved by the Mayor of the City oflYelm, Washington, at a regular meeting thereof this 8t" day of May, 2002.
