820 License and Tax of Bus ActivitiesCITY OF YELM ORDINANCE NO. 820 AN ORDINANCE of the City of Yelm, Washington, relating to the regulation, licensing and taxation of business activities in the City of Yelm, and repealing and replacing Yelm Municipal Code Chapter 5.04 General Provisions, and 5.08 Definitions, and declaring an effective date. WHEREAS, Yelm Municipal Code Chapter 5.04, combines licensing and taxation regulations for both businesses and utilities into one chapter, and Chapter 5.08 Definitions, relate to business and utility licensing and taxation; and WHEREAS, it is the intent of the City to meet legislative requirements established in Engrossed House Bill 2030 as passed by the legislature and signed by the governor in April of 2003; and WHEREAS, the state has mandated that cities must adopt either the core or model ordinance by December 31, 2004; and WHEREAS, companion ordinances to model ordinance being adopted and containing applicable general and administrative provisions must also be adopted; NOW, THEREFORE, be it ordained by the City Council of the City of Yelm, as follows: Section 1. REPEALER. Yelm Municipal Code, Title 5, Chapter 5.04, General Provisions and codified corresponding ordinances enacting the provisions of Chapter 5.04 as enacted or amended are repealed in their entirety including: A. Ordinance No. 234, (11/1979), relating to the conduct of various businesses and occupations and providing for a tax and/or license fee upon certain income derived from the conduct said businesses. B. Ordinance No. 342, (12/1987), amending Ordinance 234 and the rates applicable to business licensing and the application of credits. C. Ordinance No. 800, (3/2004), amending Ordinance 342, by increasing the business license fees. Section 2. REPEALER. Yelm Municipal Code, Title 5, Chapter 5.08, Definitions and codified corresponding ordinances enacting the provisions of Chapter 5.08 as enacted or amended are hereby repealed in their entirety to include: A. Ordinance No. 238 (2/1980) providing definitions relating to the conduct of various businesses and occupations as related to the levying a tax or license fee upon certain income derived from the conduct of said businesses. Section 3. ADOPTION BY REFERENCE. Yelm Municipal Code, Title 5, Chapters 5.02 Business Licenses Generally, 5.04, Administrative Provisions, and 5.06 Business and Occupation Tax (Mode11 Ordinance are hereby adopted by reference as if set forth in full. Section 4. SAVINGS CLAUSE. Ordinances 5.04 and 5.08 which are repealed by this ordinance shall remain in force and effect until the effective date of this ordinance. Section 5. SEVERABILITY. If any section, subsection, paragraph, sentence, clause, or phrase of this ordinance is declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining parts of this ordinance. Section 6. EFFECTIVE DATE. This ordinance shall take effect five days after its adoption and publication.
