801 Amend Ord 682CITY OF YELM ORDINANCE NO. 801 AN ORDINANCE OF THE CITY OF YELM, WASHINGTON, AMENDING Ordinance No. 682 as readopted by Ordinance No. 718; WHEREAS, In 1999, the City of Yelm adopted stormwater management and maintenance ordinances related to stormwater drainage and discharge and; WHEREAS, Both the Federal Clean Water act of 1987 and the 1987 Puget Sound Water Quality Management Plan establish the requirements for local governments to develop and implement stormwater management programs; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Adoption: In accordance with the requirements of Chapter 35.43.042 Revised Code of Washington, the Yelm City Council does hereby adopt amendments to the Yelm stormwater System, Title 13 Yelm Municipal Code. Section 2. 13.10.010 "Impervious Surface" is hereby added to read as follows: "Impervious Surface" as defined by the current adopted City of Yelm stormwater manual along with structures. Section 3. 13.10.050 is hereby amended to read as follows: Subject to the rate adjustments provided in YMC 13.10.060, the storm and surface water utility charges shall be levied upon the basis of a flat monthly "base" rate for all developed single family residential parcels, duplexes, multiple-family parcels and condominiums; and for all other parcels a sliding rate shall be determined by measuring the amount of impervious surface area on each parcel and dividing that figure by the total area of parcel to determine the percent of impervious surface and therefore the rate category. The monthly charge shall be that amount resulting from multiplying the service charge for the City of Yelm Ordinance 801 Page 1 of 3 rate category applicable to the parcel by the total area e#-the--qar-eet of the impervious surface of the parcel. The rate categories, the parameters of impervious surface for said rate categories and the monthly service charge applicable to each category shall be as follows: Rate Category % Impervious Monthly Service Charge Per Unit/Gross Acre 1. Single family N/A $2.50 per unit or duplex 2. Multliple - N/A $1.25 per unit family 3. Condominium N/A $2.50 per unit 4. Commercial/ 0-32% of site $4.00 base rate and $1.00 per Industrial-light impervious acre 5. Commercial / 33-66% of site $4.00 base rate and $1.20 per Industrial -light impervious acre 6. Commercial / 67-100% site $4.00 base rate and $1.40 per Industrial - impervious acre heavy The rates set forth in this section shall be effective for all stormwater utility billings rendered on or after the effective date of this chapter. Saving Clause. Ordinances repealed and amended by this ordinance, shall remain in force and effect until the effective date of this ordinance. Section 6. Severability.
