10-13-04 MINUTES YELM CITY COUNCIL MEETING MINUTES REGULAR MEETING WEDNESDAY, OCTOBER 13, 2004 1. Call to Order. Mayor Rivas called the meeting to order at 7:30 p.m. 2. Roll Call. Present: Joe Baker, Bob Isom, Ron Harding and Pat Fetterly Excused: Don Miller 3. Agenda Approval 04-86 MOTION BY BOB ISOM, SECONDED BY PAT FETTERLY APPROVING THE AGENDA. CARRIED. 4. Special Presentations- none 5. Public Comment. Joe and Cece Zenker provided information and photos of their retaining wall and fence they constructed and the stop work order they received from the city. They felt they are being treated unfairly relative to the other properties in their neighborhood. Mayor Rivas responded that he will review the findings with staff and follow up with the Zenkers and the Home Owners Association to educate the homeowners in this area. Robert Dyrseth, Thurston County felt compelled to express his displeasure with code enforcement officer's unprofessional treatment of the sign code issue with Bob's Auto Repair and other businesses. He stated that the photos he provided were intended for Council. Mayor Rivas stated that those who signed cards to speak about Wal-Mart would not be heard tonight until the application process allowed. Grant Beck clarified the process indicating that neither the Site Plan Review nor the SEPA has occurred. 6. Consent Agenda a. Council Minutes - September 22, 2004 Regular Meeting, September 23, 2004 Study Session. b. Payables: Checks 23562-23698, totaling $215,969.05 1) Manual Checks: 23562-23601, totaling $10,975.29 2) Claims Checks: 23602-23698 totaling $204,993.76 c. Final Payroll Checks: September 2004, totaling $192,614.96 d. Park Use Requests: YCP, Mid day Lions, Patriot Day Event Community Event, Saturday, 09-10-2005 all day. (set up 09-09-05) e. Public Hearings -None Scheduled 8. New Business. 8.a. Reclaimed Water Project - Bid Award for Water Line. Stephanie Ray reviewed the staff report on the reclaimed water line as part of the water comprehensive plan to include a reclaim water line to the Yelm High School. The bid information was provided on the bids received. . 04-88 MOTION BY BOB ISOM, SECONDED BY JOE BAKER AUTHORIZING STAFF TO AWARD THE RECLAIMED WATER LINE BID TO WOOD & SON EARTHWORK & UTILITY IN THE AMOUNT OF $269,473,73. CARRIED. 8.b. Reclaimed Water Project - Bid Award for Water Tower. Stephanie Ray reviewed the staff report on the Reclaimed Water"Tank construction bids. Additional funds are needed to complete the tank based on the actual engineering and construction costs for the tank. The bids were reviewed and it was determined that the cost increase was due to the rise in the steel prices recently. Brian Matthews from Skillings Connelly verified that the cost have increased about 42% since the original estimates. Transfer would come from the growth in the Water Fund Reserve while maintaining 2005 budget revenue, expenditure and reserve requirements. 04-89 MOTION BY RON HARDING, SECONDED BY BOB ISOM AUTHORIZING MAYOR RIVAS TO DIRECT STAFF TO PREPARE AN ORDINANCE TRANSFERRING $136,000 FROM 401 WATER FUND TO 431 WATER PROJECT CONSTRUCTION FUND TO COMPLETE THE WATER AND RECLAIMED WATER PROJECTS. CARRIED. 04-90 MOTION BY RON HARDING, SECONDED BY PAT FETTERLY AUTHORIZING STAFF TO AWARD THE RECLAIMED WATER TANK BID TO T. BAILEY, INC. IN THE AMOUNT OF $636,059. CARRIED. 8. c. Ordinance 817 - I ncreasing the 2004 Operating Transfer for the Current (001) to the Five Corners Debt Repayment Fund (112) by $8,350. Janine Schnepf reviewed City Clerk's staff report requesting transfer funds from General Fund to Five Corners Debt Repayment Fund to cover December 2004 debt payment obligation. Funds transfer needed to cover 2004 reduced beginning net cash from year end 2003 estimates. 04-91 MOTION BY PAT FETTERLY, SECONDED BY RON HARDING ADOPTING ORDINANCE NO. 817 AUTHORIZING A $8,350 INCREASE IN THE CURRENT FUND (001) TO THE FIVE CORNERS DEBT REPAYMENT (112) TRANSFER. 9. a. OLD BUSINESS 1.0. Mayor and Council Reports and Initiatives and Board/Commission Business Councilmember Baker attended Solid Waste Advisory Commission meeting and provided information on current recycling issues and location for disposal: including motor oil, pesticides and fluorescent bulbs. Reported TPB WSDOT received funding for overpass over 1-5 to bridge gap on Western Trail. Encouraged council to visit their website for more information and to view their updated safety plan. Councilmember Fetterly reported she is unable to attend Nisqually River Council Task Force meeting 10-15-04. 11 . Executive Session- None 12. Correspondence was available. 13. Adjourn.
