Call to Order. Mayor Rivas called the meeting to order at 7:30 p.m.

Special Presentations - None scheduled
5.
Public Comment - Mayor Rivas invited public comment.
Gary Campbell, 93rd Ave. and Nichole Woolsey, Donovan Ct.,
questioned progress on the fire suppression services contract. Mayor
Rivas responded that negotiations have been ongoing for the past six-
months and that Councilmember Fetterly represents elected officials on
the negotiating committee. Shelly Badger reported that at Monday's
meeting everything went well and that a draft contract should be ready
for council for the November 23 meeting, with final contracts ready for
approval at the December 8 meeting. Council was asked if a contingency
plan existed in case negotiations fail. Councilmember Fetterly responded
that there is no reason to believe there will be any problems.
Rebecca Galbreath, Crystal Springs St., wanted to comment on Wal-
Mart. Mayor Rivas responded that if and when an application is
submitted it will trigger a full process including public comment, but that
until an application is received to be fair to both sides, and to protect the
city from a possible liability exposure, council will not be accepting
comments for or against. If an application is submitted, council will
consider scheduling a public forum with both sides represented. In the
meantime, any written comments submitted will be held in a city file.

Public Hearing(s) - 2005 Revenue Sources (Ad ValoremIProperty Taxes)
Mayor Rivas opened the public hearing at 7:42 p.m. announcing the time
and purpose of the hearing and called for a staff report. Staff reported that
this is an annual event. The maximum permitted 1 % increase to the
current year's collection, nets the city $7,401 in additional revenue for
2005. An Additional $51,472 comes to the City for new construction and
improvements. As figures are available yet for state assessed utility
values, $2,500 has been added for possible increases. The total combined
collection for 2005 is $801,438.
Mayor Rivas called for questions from council and the public. A question
concerning the estimated 2005 tax rate per thousand dollars of assessed
value was referred to staff for follow-up. In response to a question about
recertifying if utility values were higher, staff responded that it was
unlikely as utility decreased the past two years.
Being no additional comment, Mayor Rivas closed the public hearing at
7:46 p.m.
Ordinance 818 Setting the Ad Valorem Tax Collection for 2005.
MOTION BY BOB ISOM, SECONDED BY RON HARDING
ADOPTING ORDINANCE 818 SETTING THE AD VALOREM
TAX COLLECTION FOR 2005 AT $801,438. CARRIED.
Property Tax Certification to the Thurston County Board of
Commissioners. .
MOTION BY PAT FETTERLY, SECONDED BY ROB HARDING
APPROVING 5801,438 AS THE 2005 TIlE PROPERTY TAX
CERTIFICATION TO SUBMIT TO THURSTON COUNTY.
CARRIED.
New Business
Final Plat Approval, Yelm Terra Subdivision, SUB-04-0157. Tami
Merriman reported that the Hearing Examiner approved the preliminary
plat in March. Conditions set at that time include an assigned savings
account with the City for striping on 3rd Street and for playground
equipment in open spaces. Street lights for 10Sth Way have been ordered
and paid for and are awaiting (PSE) installation. Some conditions have
already been met.

Resolution 449 - Local Improvement District Segregation transferring 10
Equivalent Residential Units (ERU) to Yelm Terra. Approval will
transfer ten of the 15 Burnett Rd. ERUs to the Yelm Terra development.

Mayor and Council Reports and Initiatives and Board/Commission
Business
Councilmember Baker reported on 8,'ride-along with Officer Turner.
Councilmember Isom attended a Thurston Regional Planning Council
meeting and reported that the Port of Olympia is planning to end its
membership. Discussion concerned impacts of that move and possible
ways to point out the importance of membership to the port.
Councilmember Harding attended an InterCity Transit meeting where
planned service changes for 2005 were discussed. There are no changes
for Yelm. Public hearings are being planned for February to receive
citizen input. He also attended the City Economic Development
Committee meeting; staff will be developing plans.

Correspondence reviewed included A WC sponsored training sessions
and the Governor's Economic Development Forum.
