RESOLUTION N0.384
WHEREAS Cable TV Puget Sound, Inc. dba TCI of Washington ("TCI-WA")
currently holds a franchise to make use of city streets and rights-of--way for the purposes
of construction, operation, maintenance and reconstruction of a Cable Communication
System in the City of Yelm, (the "City"), granted by Ordinance No. 251 (the
"Franchise"), on April 14, 1981, for a term of fifteen years, expiring April 14, 1996; and
WHEREAS the Franchise was extended to April 14, 1997, and extended again
to April 14, 1999; and
WHEREAS the amount of time required to conclude negotiations will extend
beyond April 14, 1999; and
WHEREAS following negotiations, there will be opportunities for public
review and comment upon the proposed new franchise proposal and a presentation to the
City Council; and
WHEREAS the rights of all parties will remain unchanged during an extension
of the Franchise, and neither party waives any right which it enjoys under law as a result
of agreeing to this extension.
NOW, THEREFORE, be it resolved by the City Council of the City of Yelm,
Washington that:
The franchise agreement between Cable TV Puget Sound, Inc. dba TCI of
Washington and the City of Yelm be extended to the sooner of April 14, 2000 or
completion of franchise renewal negotiations.
