366 Tap-In Restrictions:. RESOLUTION 3 6 6 Tap-In Restrictions for Wetland, Prime Agriculture and Important Farmland Properties WHEREAS, the City of Yelm has a service area which includes land parcels that are within Designated Wetland Areas as determined by USFWS NWI (United States Fish & Wildlife Service & National Wetland Inventory Maps), and within Prime Agriculture Land and Important Farmland, as of the RD (Rural Development) funding obligation date, July 30, 1997; and WHEREAS, RD financing has been arranged to construct improvements within the City of Yelm service area; and WHEREAS, RD has established policies to restrict utility service where proposed improvements would be placed in Designated Wetland Areas, Prime Agriculture Land, and Important Farmland, THEREFORE, IT IS HEREBY RESOLVED by the City of Yelm that 1. For purposes of complying with the RD requirements, (a) the Yelm Comprehensive Plan map, "Critical Areas (Comprehensive Plan Map #5), depicting the NWI wetlands and hydric soils be adopted as the wetlands map and (b) the Soil Conservation Service's "Soil Survey of Thurston County, maps 24 and 25 be adopted as maps showing Prime Agriculture and Important Farmlands; 2. That Tap-In Restrictions will be enforced to deny future sewer connections to the system, when verification is not made by applicants, that planned improvements to properties requesting connection to the system, will be constructed outside the Designated Wetland Areas, Prime Agriculture Land, and Important Farmland; provided however, a. That an exclusion to these Tap-In Restrictions will be granted for (1) all road and utility crossings set forth in the (a) Yelm Comprehensive Transportation Plan (August 1992), (b) Yelm Water Reuse Project (July 1995),, (c) Yelm Comprehensive Water Plan (August 1992), and (d) the Private Utility Planning for Yelm Area (for electricity, gas, telephone, cable), as excerpted in Appendix G to the Yelm Comprehensive Plan (February 1995), and (2) all property within the Thurston Highlands Southwest Yelm Conceptual Master Plan, approved October 12, 1994 and b. That administration of this policy shall provide for an application for waiver to the Tap-In Restrictions, which will be reviewed by the City of Yelm on a case-by-case basis.
