359 Surplus Dump TruckCITY OF YELM RESOLUTION NO. 359 WHEREAS, Yelm City Council has declared the currently owned dump truck as surplus in Motion No. 97-41 on February 26, 1997, as amended by Motion 97-45 (eliminating the year of the vehicle) on March 12, 1997; and WHEREAS, City Council Motion 97-41 also authorized use of proceeds from the surplus truck to offset the cost of a replacement truck; and WHEREAS, funding does not allow for the purchase of a new truck and City staff has expended considerable time and efforts to determine the availability of a serviceable used replacement truck from and through numerous sources including but not limited to a local auction, used vehicle dealers, other governmental agencies, and local businesses; and WHEREAS, telephone/direct bidding requirements for purchases between $7,500 and $15,000 have been established and approved by the City Council in Resolution 331 (7/95) as authorized by RCW 35.23.352(9); and efforts have been made to .secure telephone or written quotations from at least three different vendors insofar as possible pursuant to RCW 39.04.190, without success; and WHEREAS, the City Council makes the following FINDINGS: 1. That all reasonably possible steps have been taken to determine the availability of a serviceable replacement truck as required by the City within the funding capabilities of the City at this time, as previously described in this resolution, including but not limited to the City's described efforts to secure telephone or written quotations from at least three different vendors. 2. For the reasons described herein the purchase of the equipment; namely, a used dump truck as described in this resolution, is subject to special market conditions; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON 1. The City having satisfied the requirements of RCW 35.23.352(8) and 39.04.190 will proceed to acquire a used dump truck through negotiations with a private seller, with a total cost including purchase price and taxes not exceeding $15,000. 2. Additionally, the City Council having found that special market conditions exist with regard to the contemplated purchase of a used dump truck, the purchasing requirements of RCW 35.23.352 are hereby waived pursuant to RCW 35.23.352(9).
