357 Cable TV Puget Sound, Inc.CITY OF YELM RESOLUTION~NO. 357 WHEREAS, the City of Yelm (the "City"), entered into a franchise agreement, Ordinance No. 251 (the "Franchise"), with Cable TV Puget Sound, Inc, dba Viacom Cable, on April 14, 1981, for a term of fifteen years, expiring April 14, 1996, and WHEREAS, the Franchise was extended to April 14, 1997, and WHEREAS, on July 31, 1996 Tele-Communications, Inc.'s domestic cable television subsidiary TCI Communications, Inc. ("TCIC") closed a transaction whereby it purchased all of the stock of Viacom International, Inc., ultimate parent of Cable TV Puget Sound, Inc., and WHEREAS, Cable TV Puget Sound, Inc., dba TCI of Washington has requested an extension to the existing Franchise for two (2) years to allow adequate time to understand the needs of Yelm and to develop business operation for the newly acquired systems, and WHEREAS, the rights of all parties will remain unchanged during an extension of the Franchise, and neither party waives any right which it enjoys under law as a result of agreeing to this extension. NOW, THEREFORE, be it resolved by the City Council of the City of Yelm, Washington that: The franchise agreement between Cable TV Puget Sound, Inc. dba TCI of Washington and the City of Yelm be extended to April 14, 1999.
