351 Identifying Sewer And Water Capacity ~~ CITY OF YELM RESOLUTION 351 WHEREAS, the City of Yelm wishes to identify the means of identifying sewer and water capacity for purposes of sewer and water concurrency determinations and to clarify its policy with regard to sewer capacity, sewer hook-up, water capacity, and water hook-up, especially as it relates to the processing and issuing of subdivision, binding site plan, and short plat approvals; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Yelm that commencing November 13, 1996, the following terms will apply to all requests for sewer and water hook-up. A. State law requires the City of Yel.m to determine the adequacy and availability of public services in considering development proposals for approval. concurrency is a requirement of any approval. This resolution sets forth how such determination will be made. B. At the time of~application for preliminary subdivision approval, binding site plan approval, or short plat approval, the City will make a determination as to the availability of Equivalent Residential Units (ERUs) in the sewer system and City water system. (f the City finds that sufficient ERUs are available, the City will commit upon approval to providing sewer and water service to that subdivision, binding site plan, or short plat, subject to the expiration provisions in paragraph C. C. Except as provided in paragraphs D, E, and F below, for all projects for which a complete application is submitted on or after November 13, 1996, the ERU sewer and water reservation granted pursuant to paragraph B shall expire at the earlier of the following dates: (1) failure to file for a building permit for a residence or authorized structure on an approved lot within 24 months of final short plat or site plan approval creating the lot (applies to each lot within the approved project), or (2) upon securing a building permit, the expiration of the authority to construct pursuant to the building permit without completing the authorized structure. D. For all lots created prior to September 11, 1993; requests for sewer~and water shall be on a first come, first served basis.. E. For projects vested between September 11, 1993 and November 13, 1996: (1) sewer rights shall be determined pursuant to Resolution 296, adopted September 11, 1993 and (2) water rights shall be on a first come, first served basis. F. For projects reviewed under master plan approval requirements. or projects participating in sewer and/or water local improvement districts or latecomer reimbursement agreements, the vesting requirements of this ,,' = resolution shall apply unless specifically modified in writing, in which case the writing shall supercede. G. The Public Works Department shall maintain a listing of: The total permit capacity of all City sewer and water facilities pursuant to currently sewered subdivision., binding site plan, and short plat approvals. 2. The total number of ERUs committed to the correction of existing deficiencies. 3. The tots( number of ERUs available for new development. 4. The total number of ERUs committed to preliminary, but not final; subdivision, binding site plan, and, short plat approval. 5. The total number of ERUs committed to new final subdivisions, binding site plans, and short plats vested under paragraph C, D, or F above. E. The Public Works Department shall maintain the above sewer and water ERU availability list and shall update the list no less than monthly. The Public Works Departmenf shall make the list available to the public upon request. F. The City will not commit to subdivision, binding site plan, or short plat approval beyond 85% of permitted sewer or water capacity, nor any individual hook-up (either residential or commercial) beyond 95% of permitted sewer or water capacity, without an engineer's report certifying that the City sewer and/or water systems are in fact operating within designed limits and the new hook-ups authorized will not cause the system to exceed permitted limits.
