346 Fuel Yelm Community SchoolsCITY OF YELM RESOLUTION NO. 346 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON, APPROVING ENTERING INTO AN INTERLOCAL AGREEMENT WITH YELM COMMUNITY SCHOOLS FOR THE PURCHASE OF FUEL. WHEREAS, the Interlocal Cooperation Act (Ch. 39.34 RCW) contains authorization for public agencies to contract with one another to perform any governmental activity or service which each agency is authorized by law to perform individually; and WHEREAS, it is in the public interest for the City to reduce fuel costs to the City; and WHEREAS, Yelm Community Schools has also agreed to entering into such an agreement with the City; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON, DOES HEREBY RESOLVE That the agreement between the City of Yelm and Yelm Community Schools, identified as Attachment A to Resolution 331, is annexed hereto and incorporated as though fully set forth herein. Bennick, City Clerk Resolution 346 Page 1 ac /wp51 /reso1 /res346 I Inter -Local Cooperation Agreement THIS AGREEMENT is between the City of Yelm, and Yelm Community Schools, both municipal corporations of the State of Washington. The purpose of this agreement is to provide for the purchase of gasoline and diesel fuel. The City agrees to pay to Yelm Community Schools two (2) cents per gallon over and above the school district's actual purchase price for fuel used. The City further agrees to accept full responsibility for any fuel purchase cards issued to the City. Yelm Community Schools agrees to provide billing services for the City's fuel purchases. Bills received by the City on or before the 2nd Monday of each month shall be paid on the 2nd Friday of each month. Yelm Community Schools also agrees to act as agent for the City and to include the City's purchasing requirements in its own bid call and to observe statutory requirements applicable to such purchases. This Agreement shall run for a term of two (2) consecutive years commencing with the 1st day of July 1996, and terminating on the 30th day of June 1998. Upon the expiration of the said two year term, this agreement shall automatically be renewed and extended for additional terms of two (2) years each. Termination without cause may be initiated by either party at the end of any two year contractual period, provided that notice of termination is given to the other party not less than 180 days prior to the end of any such contractual period.
