296 Sewer Capacity And Sewer Hook-upCITY OF YELM RESOLUTION NO. 2 9 6 WHEREAS, the City of Ye1m wishes to clarify and communicate to the public its policy with regard to sewer capacity and sewer hook-up, especially as it relates to the processing and issuing of subdivision and plat applications; NOW, THEREFORE, BE IT RESOLVED,. by the City Council of the City of Y~Irn that commencing September 23; 1993 ,the following will be the Sewer Hook-up and Capacity Policy of the City of Yelni. A. It is the policy of the City of Yelm to accept subdivision and plat applications, but until appeals pending on proposed sewer outfalls have been resolved, the City cannot and will not guarantee the availability of City sewer service to those, subdivisions and plats. B. At the time of preliminary subdivision or plat approval, the Gity will make a determination as to the availability of Equivalent Residential Units (ERUs1 in the sewer system. If the City finds that sufficient ERUs are available, the City will commit to providing sewer service to that sub- division or plat, subject to the expiration provisions in paragraph C. C. -After twelve months from final approval of such subdivision or plat, any building permit issued for sewer hook-up and any accom- panyingright to sewer hook-up that vests with such building permit, will expire if construction is not commenced within twelve months of final approval and hook-up is not completed within twenty-four. months of final approval, In the event that a building permit for sewer hook-up and any accompanying vested right expire, subsequent building permits for sewer hook-up to that subdivision or plat will only be available on a first in time, first in right basis. D, The Public Works Department shatl maintain a listing of: 1, The total permit capacity of all City sewer facilities pursuant to currently severed subdivision and plat approvals. 2. The total number of ERUs committed to the correction of 8xisting deficiencies. ~ ~~ 3. The total number of ERUs available for new development. 4. The total number of ERUs committed to preliminary, but not final, subdivision and plat approval.. 5. The total number of ERUs committed to new final subdivisions and plats within twelve months of final approval. - 6. The total number of ERUs available. for general use under the City's Current sewer program, to be assigned on a first in time, first in right basis. - E. The Public Works Department shall maintain the above sewer ERU availability list and shall update the list no less than monthly. The Public Works Qepartment shall make the list available to. the public upon request: 1=. The City will nat commit to subdivision or plat approval beyond 85% of permitted sewer capacity without an engineer's report certifying that the subdivision or plat is operating as designed and new hook-up will not exceed permitted limits.
