280 Annexation Request No. 8073CITY OF YELM RESOLUTION NO. 280 ANNEXATION REQUEST NO. 8073 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YELM SETTING FORTH THE DECISION OF THE COUNCIL REGARDING A NOTICE OF INTENT TO CIRCULATE A PETITION TO ANNEX CERTAIN TERRITORY TO THE CITY OF YELM. WHEREAS, the Yelm City Council has received the attached notice of intent to commence annexation proceedings, WHEREAS, pursuant to the procedures established by Revised Code of Washington 35A.14.120 and Yelm Municipal Code Chapter 17.64, the City Council has met with the initiating parties, WHEREAS, the Council has duly considered said request to initiate annexation, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM DOES RESOLVE, AS FOLLOWS: Section 1 - Decision. That the Council hereby [ accepts] the proposal. to initiate annexation and [ does ] grant the initiating parties permission to circulate a final petition to annex. Section 2 - Comprehensive Plan and Zoning. That the Council [will] require the simultaneous adoption of proposed zoning and comprehensive plan use designations for the area to be annexed. (If zoning and plan designations are required such requirement must be clearly indicated in the final petition.) * Portions planned for C-3 zone will be rezoned, at no cost, following adoption of C-3 zone. Section 3 - Assumption of City Indebtedness. That the Council [ will ] require the assumption of a proportionate share of existing city indebtedness by the area to be annexed. (If assumption of debt is required such requirement must be clearly indicated in the final petition.) Section 4 - Local Improvement District. That the Council [ will not ] require simultaneous formation of or consent to be included within a local improvement district. Section 5 - Water and Sewer District. That the Council [will not] require that the area to be annexed be included within an existing sewer and/or water district. CITY OF YELM PAGE 1 RESOLUTION N0. 280 Section 6 - Expiration. Any permission granted by this resolution to circulate a final annexation petition shall expire and be null and void on that date which is exactly - 1 year(s) after adoption of this resolution. Therefore, any final petition along with the required fee and such accompanying information as is requiied by the City to evaluate the proposal in accordance with Chapter 2.66 of the Yelm Municipal Code must be presented to the City Clerk prior to such date.
