-_ MIDDLE ROAD ANNEXATION AND ZONING
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YELM EXPRESSING
THE INTENT OF THE COUNCIL WITH RESPECT TO THE ANNEXATION PETITION
PRESENTED FOR PROPERTY ADJACENT TO RAILWAY AND MIDDLE ROADS.
WHEREAS, Season's Development Company and others have petitioned
for annexation of property as described in amended Yelm
resolution #240,
WHEREAS, said petition includes the signatures of the record
owners of over 60% of the value of the described area,
WHEREAS, the Council finds that this proposal forms a set o.f
logical properties for road and utility service
WHEREAS, this property lies within the proposed urban growth area
of the City of Yelm, and
WHEREAS, the Planning Commission has held public hearings and
recommends that those properties abutting Middle Road should be
zoned as single family residential (R-1) and the those properties
abutting Railway Road (lots 11 through 15) should be zoned as
Residential Agriculture Five-Acre (RA-5.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM DOES
RESOLVE, AS FOLLOWS:
Section 1 It is the intent of the City of Yelm to annex that
property depicted upon the attached map and including all
adjacent public rights-of-way.
Section 2. That the Thurston County Boundary Review Board shall
be notifed of said intent. Upon receipt of approval of the Board
it is the intent of the Council to adopt an ordinance implement-
ing the above express intent and to zone said property as
recommended by the Planning Commission.
Section 3. That the 're lm Comprehensive Plan Map shall be amended
to designate the first listed parcels as "single-family
res ident is 1 . "
Section 4_ That consistent with the policies of the City of
Yelm, all pending or subsequent development proposals within said
area, including that preliminary plat known as Prairie Creek
shall not be considered "vested" pursuant to RCW 58.17.033 until
such time as this annexation is final.. Accordingly, such
applications shall be not be considered "complete" and shall be
subject to any changes in City standards, regulations, codes or
ordinances during the intervening period.
