A F2ESULU'fION OF 't'II[: C11'Y COUNCIL OF 7'HE CITY OF YELM
CONFIRMING APPOINTMENT OF TILE CITY ATTORNEY AND ESTABLISHING
'I'IFE DUTIES AND RESPONSIF3ILITIES OF THE CITY ATTORNEY.
WHEREAS, the Yelm City Council recognizes that current needs require
employing a City Attorney, and
WIiEREAS, pursuant to Yelm Municipal Code Section 2.20.20 the Mayor is
auttrorized to appoint a city attorney; and
WHEREAS, the Mayor has appointed Todd Stamm to hold such office,
NOW THEREFORE be it hereby resolved by the City Council of Yelm,
Washington, as follows:
That the Council hereby confirms the appointment of Todd Stamm as City
Attorney,
That with respect to the business of the City the City Attorney shall
serve as legal advisor to the Mayor, the City Council, all departments
of the City, all appointed officers of the City, all duly-established
committees and employees of the City.
That the City Attorney shall represent the City in all litigation in
all courts in which the City is a party or directly interested.
That the City Attorney shall prosecute all violations of City
ordinances;
That the City Attorney may assign any and all duties, including
representation of the City in adversarial proceedings, to other
counsel retained by contract with the City of Yelm,
That the City Attorney shall coordinate any such contractual legal
services and shall serve as liaison between the City and such legal
counsel, and
That the City Attorney shall perform such other duties as are
appropriate as mutually agreed t>y the Mayor, City Admfrristrator and
City Attorney, or as directed by the City Council.
Further, that pursuant to RCM 36.16.938 and RCW 35.21.205, the City
will insure only that official employed by the City as City Attorney
and will provide no insurance with respect to other counsel referenced
above.
Provided further that this resolution shall not affect or amend any
existing contract or other agreement of the City with respect to legal
services or representation.
