226 Replaces Resolution No. 126 and 177CITY OF YELM RESOLUTION NO. 226 (REPLACES RESOLUTION NO. 126 and 177) WHEREAS, orderly and proper growth of commercial and industrial areas within the City of Yelm is essential to the public health, safety and welfare; and WHEREAS, the City of Yelm desires to insure that future commercial and industrial developments incorporate proper design practices as the same relate to engineering factors including surface drainage and runoff, waste disposal, traffic control and other relevant safety and health factors; NOW, THEREFORE, BE IT RESOLVED BY TILE COUNCIL OF 'THE CITY OF YELM, WASHINGTON, AS FOLLOWS: SECTION 1. From and after the date of passage of this Resolution, all applications for building permits for industrial and commercial facilities shall be reviewed by the Public Works Department oP the City of Yelm who shall evaluate the same to determine compliance with design criteria and engineering factors set forth in Section 2 of this Resolution. No building permit shall be hereafter issued for any industrial or commercial facility until application for the same has been reviewed by the Public Works llepartment and the Public Works Department shall have issued their recommendation or report relative thereto, as provided in Section 6 of this Resolution. SECTION 2. The Public Works Department shall review each such application for building permit for industrial and commercial facilities to determine that the same incorporate proper design practices relating to the following engineering factors: (a) surface drainage and runoff (b) waste disposal (c) traffic control (d) •all other relevant safety and health factors SECTION 3. The Building Official of the City of Yelm shall transmit to the Public Works Department two (2) copies of each application for building permits for industrial and commercial facilities, and two (2) copies of all plans accompanying each such application. SECTION 4. The Public Works Department shall in turn transmit to the Planning Commission or Sub-Committee thereof a copy of each application for building permits for industrial and commercial facilities, and a copy of all plans accompanying each such application for their recommendation. SECTION 5. The Public Works Department may require any applicant to submit such additional information in the form of additions to or clarifications of plans previously submitted, details of design criteria or calculations, traffic counts, or other such information as may be necessary to effectuate the objectives of this Resolution. SECTION 6. Within fifteen (15) days of the receipt of each such application, the Public Works Department shall submit its writtc;n recommendation, after receiving the recommendation of ttie Planning Committee or Sub-Committee thereof, to the City Building Official and shall send copies thereof to the applicant and to the City Clerk. CITY OF YELM RESOLUTION N0. 226 Pnr.-~ The City Building Official .may hereafter issue any building permit for industrial or commercial facilities: (a) the application for which the Public Works Department has recommended approval; and (b) the application for which the Public Works Department has recommended approval subject to conditions, which conditions have been accepted by the applicant. Each such application for building permit which the Public Works Department has: (a) recommended approval subject to conditions, which conditions have not been accepted by the applicant; and (b) recommended denial shall automatically be scheduled for consideration by the City Council at its next regularly scheduled Council meeting, unless said application was received by the Public Works Department less than fifteen (15) days prior thereto, in which event the same shall come on for consideration at the next subsequent Council meeting thereafter.
