199 Noncharter Code CityRESOLUTION NO. 199 A RESOLUTION TO ADOPT CLASSIFICATION OF NONCNARTER CODE CITY WHEREAS, the Legislature of the State of Washington has pro- vided in Title 35A RCW f_or the formation of an conversion by muni- cipalities to the classification of Noncharter Code City; and 4~THEREAS, the Town of Yelm, Thurston County, Washington, is currently classified as a chartered Fourth Class Town; and WHEREAS, the Town Council of the Town of Yelm has determined it to be in the best interests of the Town to become a Noncharter Code City; and WHEREAS, the Town Council of Yelm has determined that, upon attainment of Code City status, the present Mayor-Council plan of government should continue in effect, and the number of council positions should remain unchanged; Now, therefore, BE IT RESOLVED by the Town Council of the Town of Yelm, State of P~ashinaton, as follows: 1) The classification of the Municipality of Yelm should be changed from that of Fourth Class Town to that of Noncharter Code City, subject to completion of such conversion process according to the terms of RCW 35A, and it is the intent of the Council to effect such change; and 2) The Mayor-Council form of municipal government currently in effect and governing the Municipality of Yelm should be continued in full force and effect, notwithstanding the aforesaid change to Noncharter Code City status, and it is the intent of the Council to retain the same; and 3) The number of council positions currently in effect should be continued unchanged, notwithstanding the aforesaid change to Non- charter Code City status, and it is the intent of the Council to effect no change in such number of positions; and Page One of Two 4) Within ten (10) days after passage of this Resolution, the Clerk of the Town of Yelm shall cause the same to be published once zn a newspaper approved for such municipal legal publications. At the next regular meeting of the Town Council at least ninety (90) days next succeeding such publication and subject to the pro- visions of RCW 35A, it is the intention of the Council to carrv out the aforesaid intent by the adoption of an appzopriate ordin- ance.
