RESOLUTION NO. 189
A RESOLUTION relating to the public health, safety, and
welfare; declaring an emergency; authorizing or activating a
local plan or program to address such emergency; authorizing and
directing the use of local resources to address such emergency;
authorizing the execution of contracts and expenditure of funds
for such purpose or purposes; and declaring an effective date.
WHEREAS, the Police and Building Departments of the Town
of Yelm have reported to the Mayor and Town Council of the Town
of Yelm that recurrent apparent arson fires within the Town have
and now are threatening the safety, security, and economic well-
being of local merchants and citizens; and
WHEREAS, extensive damage has already occurred in this
municipality by reason of such fires; and
WHEREAS, the person or persons responsible for such fires
have not yet been identified and apprehended, but remain at large;
and
WHEREAS, further property damage, loss of business, even
injury or loss of life may occur unless such fires be curtailed;
and
WHEREAS, there is an emergency which necessitates activ-
ation and/or formulation of a Yelm Emergency Preparedness Plan and
utilization of emergency powers granted pursuant to RCW 35.33.081;
and
WHEREAS, the Council Members of the Town of Yelm have here-
tofore been contacted by telephone, discussed this emergency and
their response, and cast their votes thereupon; and
WHEREAS, the Town Council, as a body, now wishes to formal-
ize and confirm its earlier action; now therefore,
BE IT RESOLVED BY THE COUNCIL OF THE TOWN (7F YELM, as
follows:
Section 1. Declaration of Emergency. An emergency exists, due
to past and threatened arson Tres within the Town of Yelm, which
threatens the health and safety of persons and property.

government, each within its purview, and the Mayor, are each hereby
authorized to enter into contracts and incur obligations necessary

to combat such emergency, to protect the health and safety of
,- persons and property, to provide emergency assistance to any
victims of such disasters, and to apply for any applicable or
arguably-applicable grants and assistance to address and abate
such emergency.
Section 3. Emergency Procedures. Each department is authorized
to exercise the powers vested under Sections 1 and 2 of this res-
olution, in the light of the exigencies of an extreme emergency
situation, without regard to time-consuming procedures and form-
alities prescribed by law (excepting only mandatory constitutional
requirements, which shall be observed).
Section 4. Effective Date. This Resolution shall be effective
from and after the 23rd day of May, 1988, when the Council
members considered this matter and voted in principal thereon.
