185 Contract For Jail ServicesRESOLUTION NO. 185 Town of YeLn, Washington AUTHORIZATION TO ENTLR CONTRAC`T' FOR JAIL SERVICES A RESOLUTION far the public health and safety, author- izing the execution of a new Contract for Jail Services be entered by the Mayor and Clerk of the Town of YeLn, and with the City of Olympia, Washington. WHEREAS the Town of Yelm has heretofore contracted with the City of Olympia for the provision of jail services necessary for the execution of lawfully imposed sentences of the municipal court of the Town of YeLn; and WHEREAS the Town of Yelm has no such jail facilities of its own, and is needful of such contracted-for jail services; and WI-)EREAS, the said contract for jail services between the Town of YeLn and the City of Olympia has by its terms expired; NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of YeLn hereby grants its approval of, and directs the Mayor and Clerk of YeLn to execute in the Town's behalf, the proposed contract for jail ser- vices annexed hereto as Exhibit "A" hereof and by this reference incor- porated herein as though here fully set forth. Ron Lawton, Mayor Attest : ~ ~ • ~~1.-tJ~a~- Approved as to Form and Substance: C'~' •,/~ Attorney EXHIBIT A " AGREEMENT FOR JAIL SERVICES THIS AGREEMENT is made and entered into this 1~~ day of ~-~ ~" , 1987, by and between the City of Olympia, Washington, a municipal corporation, hereinafter referred to as "Olympia", and the Town of Yelm, hereinafter referred to as "Yelm". WHEREAS, Yelm does not have jail confinement facilities for the housing of prisoners either arrested or serving sentences under Yelm's jurisdiction. WHEREAS, Olympia does have such facilities and is agreeable to house and confine prisoners belonging to Yelm, IT IS HEREBY AGREED BETWEEN THE PARTIES AS FOLLOWS: 1. Yelm agrees to pay Olympia for each prisoner lodged in the Olympia City Jail by agents of Yelm for investigation in the amount of Nineteen Dollars and Fifty Cents ($19.50) per day or any part thereof. If the charge is one coming under Olympia's criminal jurisdiction, the Nineteen Dollars and Fifty Cents ($19.50) per day or any part of a day charge shall be paid until a warrant is issued by the City of Olympia. If the charge is one coming under Yelm's jurisdiction, the Nineteen Dollars and Fifty Cents ($19.50) per day or any part thereof shall be paid until the person is removed by Yelm. 2. For any person sentenced to the Olympia Jail by authority of Yelm or its agents, Olympia shall receive Nineteen Dollars and Fifty Cents ($19.50) per day or any part thereof from Page 1 Yelm. Each prisoner shall be accompanied by a sentencing or ~I~ disposition slip signed by the committing authority and Olympia agrees to carry out the terms thereof. .. 3. The day shall be computed as starting at 12:00 o'clock midnight. 4. Olympia agrees to provide safekeeping and subsistence for all prisoners of the same type and kind furnished other prisoners according to jail rules and regulations. 5. Yelm agrees to provide adequate copies of booking dockets and other necessary forms for administrative purposes. It is expressly agreed and understood that all prisoners shall be subject to and abide by the rules and regulations set out by Olympia. 6. Olympia agrees to photograph and fingerprint without cost all prisoners at the request of Yelm. 7. Yelm agrees to provide transportation to and from the Olympia City Jail for any necessary purpose. 8. Yelm prisoners shall be provided with such medical and dental treatment as may be necessary to conserve their health. Yelm will bear the expense of dental, medical and hospital treatment. Olympia shall first obtain authorization from Yelm before incurring any expense for these services unless an emergency is involved. In an emergency, when treatment is clearly necessary to conserve the prisoner's health, Olympia may proceed with the necessary treatment without authority. But in any case, Olympia must notify Yelm immediately and furnish full information. Page 2 ~ ~ All such costs and expenses shall be billed directly to Yelm. 9. Olympia shall render itemized monthly statements to Yelm and Yelm agrees to pay promptly. 10. In the event of the death of a prisoner, Yelm shall be notified immediately and Olympia shall follow Yelm's instructions with regard to disposition of the body. Yelm shall be responsible for notification of relatives and all costs involved. 11. It is understood and agreed between the parties hereto that Yelm will hold Olympia harmless from all claims, demands, actions or causes of action of any nature arising from any false arrest or false imprisonment suit instituted by any person confined in the Olympia Jail by reason of any arrest Yelm or its delegated authority makes under the terms of this Agreement. Yelm further agrees to reimburse Olympia for all expenses including legal fees necessitated by any person bringing each suit. 12. Termination of this Agreement may be effected by either of the parties involved by written notice to the other party ninety (9B) days prior to the termination date. 13.
