J LA'1'ECUMERS AGREEMENT
This amendment is in reference to a Latecomers Agreement
elated and executed to become effective the 24th day of September,
198G, by and between the City of Yeim, a municipal corporation of
the State of Washington, hereinafter referred to as "Yelm" and
Frederick Ko1.ilis II, hereinafter for convenience only referred
to as "Ucvelcrl>cr."
WHEREAS, the Developer hereby agrees and authorizes Yelm to
share with M. U. Edwards in the recapture and latecomer Lees of
the above Resolution to the extent of 1/2 of said recoveries on
latecomer hook-ups on property now owned by the Moose Lodge
extending from a point south of State Highway 51U and adjoining
the Yelm High School property. This amendment and agreement
between Frederick Kolilis II and M. U. Edwards, covers these
Irropert.ies ern ly anci hers no bearing on any recapture agreements
due Mr. Kolilis on line extensions north of State Highway 51U.
NOW, TI[EREFURE, Developer Kolilis and M. D. Edwards jointly
agree and direct YeLn to pay any future recapture benefits due
from latecomer hook-ups on the Moose Lodge property and/or ttreir
assigns, 5U? to developer Kolilis and 50o to M. U. Edwards under
ttre city's I~esolutiorr No. 175.
Exhibit A, the map subject of Resolution 175, currently
shows beneficial recapture to the Developer on a parcel of prop-
erty immediately north of State Highway 51U on the east belonging
to Dr. Hendrickson and Ur. Brown, owners of the veterinary cli-
nic. Ueve~loper Kolilis acknowledges that this property is not
subject to recapture under his Agreement Resolution No. 175, as
M. D. Edwards will be extending the city's water main easterly

along the property owned by the clinic and any recapture benefits
