Town of Yelm, Washington
CONSENT TO ASSIGNMENT OF CABLE FRANCHISE
This is a resolution consenting and acquiescing in
the assignment of that certain cable television franchise
affecting such services and their provision within the Town
of Yelm.
WHEREAS, Cable TV Puget Sound, Inc., a wholly-owned sub-
sidiary of Tribune Publishing Co., is franchised to provide
cable te]evision service in the Town of Yelm; and
WHEREAS, Viacom Cablevision has acquired the aforesaid
Cable TV Puget Sound; and
WHEREAS, Section 16 of the Franchise Ordinance, which
is Ordinance No. 251 (1981), provides that the said franchise
be personal to the original grantee and that the same shall
not be sold, transferred, leased, assigned, or otherwise dis-
posed of without the prior written consent of the Town; and
WHEREAS, Viacom Cablevision has established its ability
to operate the said franchise and provide services thereunder
in a manner beneficial to the citizens of the Town of Yetm,
and desires the Town of Yelm therefore to approve the afore-
said assignment of said television cable franchise; and
WHEREAS, Viacom Cablevision has further demonstrated its
good faith and public-spirit by agreeing to amend the stated
compensation to the Town of Yelm for the operation of the
said cable franchise to provide for the payment of three per
cent (3~) of revenues from basic cable service to customers
within the geopolitical boundaries of the Town, exclusive
of bad debt and installation fees;
NOW, THEREFORE, BE IT RESOLVED that the Town Council of
the Town of Yelm hereby grants its approval to permit the
assignment of alt applicable cable television franchise oblig-
gations and rights to Viacom Cablevision International, Inc.
PASSED this 25th day of March 1987, effec-
tive immediately.
