RESOLI: TION NO. 136
WHEREAS, orderly growth and de~~elopment of the Town of
Yelm is essential to the public health, safety and welfare of the citizens
of the town; and
WHEREAS, the Council of the Town of Yelm desires to provide
orderly procedures for determination of the impact upon the environment
of all proposed actions affecting the same;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF
. THE TOWN OF YELM, AS FOLLOWS:
Section 1. The provisions contained in this Resolution shall
not apply to the cnnstruction of any single family residence or natural
appurtenances thereto, including by way of illustration, but not limiting
thereto, garages, fences and driveways; nor shall the construction of
-~c`;' any such single family residence or appurtenance thereto within the Town
of Yelm require the preparation of a "detailed statement" as said term is
defined in Revised Code of Washington, Section 43.21 C. 030 (c) .
• Section 2. From and after the date of this Resolution, all
applications for building permits other than such permits for prolects
~' set forth in Section 1 of this Resolution shall in addition to any other requirements
imposed by any other ordinance or resolution of the Town of Yelm, be
sub)ect to the following procedure:
. (a) Each applicant for such building permit shall prepare
and submit to the Building Inspector of the Town of Yelm, on forms furnished
' by said Building Inspector, an Environmental Assessment Statement.
(b) Prior to issuance of any such building permit, the Bu[lding
Inspector shall immediately upon receipt thereof, refer each such En~~ironmental
Assessment Statement to the Town of Yelm Planning Commission for its
review and recommendation. Within twenty (20) days of its receipt of
each such Environmental Assessment Statement, the Town of Yelm Planning
Commission shall forward to the Building Inspector its recommendation
relative to the protect contemplated by such Environmental Assessment
Statement, which recommendation shall state:
(i) That said protect is deemed not to be a major
action significantly affecting the quality of the
environment; or
(if) That said protect is deemed to be a major action
significantly affecting the quality of the environment; or
(iii) That no recommendation relative to the effect of
the protect upon the environment can be made, setting
forth in detail the reasons therefor; e.g. , lack of
sufficient data, etc.
(c) Any Environmental Assessment Statement upon which
no recommendation shall have been made by the Town of Yelm Planning
Commission within twenty (20) days of its receipt thereof as provided
in subsection (b) of this section, shall be automatically referred to the
Town Council for action and shall be deemed to be so referred without
recommendation of the Town of Yelm Planning Commission.
(d) For any protect which is deemed not to be a major action
significantly affecting the quality of the environment, as determined pursuant
to the provisions of subsection (b) or subsection (c) of this section, the

Building Inspector shall forthwith issue a building permit therefor upon
applicant's compliance with all other applicable ordinances of the Town
which are subject to administration by the Building Inspector.
(e) For any project determined to be a major action significantly
affecting the quality of the environment, the Building Inspector shall,
prior to the issuance of a building permit therefor, cause the preparation
of an Environmental Impact Statement, which Environmental Impact Statement
shall upon completion thereof, be referred to the Town Council for determination
in connection therewith.
Section 3. From and after the date of this Resolution, all
applications for variances, conditional use permits, changes in land use
classification, and proposed platting, subdtvision or dedication of land,
except such platting, subdivision and dedication which is exempt from
compliance with the provisions of Resolution Number 136 of the Town of
~ Yelm, shall, in addition to any other requirements imposed by any other
ordinance or resolution of the Town of Yelm, be subject to the following
procedure:
(a) Each such applicant shall prepare and submit to the Town
offidal responsible for the initial review of such application, on forms
furnished by such offidal, an Environmental Assessment Statement.
(b) Each such Environmental Assessment Statement shall
be reviewed by the Town Council at its naxt regular meeting following
submission thereof. The Town Council shall thereafter determine, based
upon such Environmental Assessment Statement, and any additional information
which it may deem relevant, whether such application, if granted,.will
constitute a major action significantly affecting the quality of the environment.

(c) If the Town Council shall determine that any such application,
if granted, will not constitute a major action significantly affecting the
quality of the environment, then said applicatior. shall be processed pursuant
to the provisions o.' all other ordinances and resolutions c: the Tov,n of
Yelm applicable thereto.
(d) If the Town Council shay. determine that any such application,
if granted, will constitute a major action significantly affecting the quality
of the environment, then, prior to the further processing of said application,
the Town Council shall cause an Environmental Impact Statement to be
prepared, with the assistance of the Town Engineer and any other person,
corporation or agency the Town Council may deem appropriate. Following
preparation of any such Environmental Impact Statement, the same shall
be referred to the Town Council for determination in connection therewith.
Section 4. The provisions contained in this Resolution are
provided for compliance with Revised Code of Washington, Chapter 43.21 C,
and any amendments thereto, commonly known as the State Environmental
Policy Act of 1971. '
Section 5. This Resolution supersedes Town of Yelm Resolution
' No. 127.
