08-28-07 Minutes YELM CITY COUNCIL REGULAR MEETING TUESDAY, AUGUST 28, 2007 MINUTES 1. Call to Order— Mayor Harding called the Meeting to Order at 7:30 pm. 2. Roll Call — Present: Don Miller, Joe Baker, Bob Isom, Mike McGowan, Pat Fetterly, John Thompson and Russ Hendrickson. 3. Agenda Approval 07-76 MOTION BY BOB ISOM APPROVING THE AGENDA AS PRESENTED. CARRIED. 4. Special Presentations-Seniors Appreciation Week Mayor Harding read the Seniors Appreciation Week Proclamation declaring September 9-15, 2007 to be Seniors Appreciation Week and encouraging Yelm citizens to recognize those efforts of citizens who work to enhance the well- being of the older citizens in our community. 5. Public Comment. There was no public comment 6. Consent Agenda a. Minutes: August 14, 2007 Regular Meeting and August 22, 2007 Study Session b. Payables: Checks 32009-32212, Totaling $627,537.57 C. Payroll: August 2007 Preliminary d. July 2007 Month End Financial Report 07-77 MOTION BY PAT FETTERLY APPROVING CONSENT AGENDA ITEMS AS PRESENTED. CARRIED. 7. Public Hearings-Yelm Municipal Code a. YMC Sign Code Update Chapter 15.24. Mayor Harding opened the Public Hearing at 7:35 pm for comments on the update to the Sign Code, Chapter 15.24 and asked for a staff report. Grant Beck reviewed the staff report for Ordinance 881 indicating that Community Development staff and the Mayor have been working with the Chamber of Commerce to address concerns by business owners to amend the sign code. Some of the recommendations have already been incorporated into the Code but need further explanation; others have been implemented to address specific concerns. Being no response for a call to comment, the hearing was closed at 7:37 pm. b. YMC Enforcement of Development Regulations. Add New Chapter 1.16. Mayor Harding opened the Public Hearing at 7:37 pm for comments on the Enforcement of Development Regulations adding a Chapter 1.16 to the Yelm Municipal Code. Grant Beck reported that land use violation enforcement is currently a criminal penalty. The proposed chapter would establish a clear process for enforcing land use regulations including imposing civil penalties and optional appeal process to the Hearing Examiner rather than criminal penalties heard by the Court. Councilmember Thompson asked staff to contact those citizens by letter that had sent in written comments for the hearing. ORDINANCE NO. 881 Sign Code Update, Chapter 15.24 Yelm Municipal Code. 07-78 MOTION BY BOB ISOM ADOPTING ORDINANCE 881 SIGN CODE UPDATE, CHAPTER 15.24 YELM MUNICIPAL CODE. CARRIED b. ORDINANCE NO. 874 Repealing and Replace Enforcement Provision with New Chapter— Enforcement of Development Regulation, Chapter 1. 16. 07-79 MOTION BY PAT FETTERLY ADOPTING ORDINANCE NO. 874 REPEALING AND REPLACING ENFORCEMENT PROVISION WITH NEW CHAPTER 1.16 ENFORCEMENT DEVELOPMENT REGULATIONS. CARRIED. 9. Old Business a. Family Investment Initiative Interlocal Agreement. Shelly Badger presented the Memorandum of Agreement prepared by the local jurisdictions as directed by Council to address concerns including; accountability, effectiveness and efficient administration of proposed local sales tax funded program for prevention and intervention strategies to prevent crime. Councilmembers were concerned about the 20 year term of the agreement, no option to opt out after a period of years and supporting a proposal, with too many unknowns. Also stating the recommended limits to the percent of administration costs allowed. Shelly responded that the agreement was a framework to address these concerns and was a vehicle to move the measure forward to a vote on the November ballot. 07-80 MOTION BY MIKE MCGOWAN AUTHORIZING MAYOR HARDING TO SIGN THE FAMILY INVESTMENT INITIATIVE INTERLOCAL AGREEMENT. 2 OPPOSED, 1 ABSTAIN WITHOUT REASON. CARRIED. 10. Mayor and City Council Reports Councilmember Miller attended Chamber of Commerce meeting. Councilmember Baker attended Intercity Transit meeting discussed change of route for Yelm to include the library and Wal-Mart Park and Ride station. Mayor Harding noted that Stevens Street was opened to traffic today and reminded everyone present of the Patriot's Day Parade, September 8, 9:30 am lineup. 11. Executive Session — none scheduled 12. Correspondence provided for review included; AWC call for nominations to Ecosystem Coordinating Board Puget Sound Partnership, Thurston County Community Recycle Days Event Flyer and Comcast Channel line-up changes. 13.
