897 Chapter 13.04 Utility CITY OF YELM ORDINANCE NO. 897 AN ORDINANCE OF THE CITY OF YELM REPEALING, REPLACING AND AMENDING CERTAIN ORDINANCES AND SECTIONS OF CHAPTER 13.04 OF THE YELM MUNICIPAL CODE RELATED TO CONSUMER DEPOSITS, DELINQUENCY FEES AND RECONNECT FEES FOR THE WATER UTILITY. WHEREAS, the administrative cost of maintaining consumer deposits from new residents and residents moving out of the area is greater than the deposit itself; and WHEREAS, the delinquency fee of $5.00 and the reconnect fee of $20.00 is no longer effective in receiving a timely payment on monthly utility payments and reduang the total number of disconnections for non-payment; and WHEREAS, it is the intent of the City to maintain efficient use of personnel's time and citizen tax payer dollars and provide a written policy to provide guidance and consistent application, NOW, THEREFORE, The City Council of the City of Yelm do ordain as follows: Section 1. Amend certain sections of the Yelm Municipal Code by repealing, replacing and adopting changes to the consumer deposits, delinquency fees and reconnect fees. 13.04.230 AMEND - Unauthorized turn-on 13.04.230 Should the owner or occupant of any premises turn on the water or suffer or cause the same to be turned on after it has been shut off at the curb cock by the water department, water service may again be turned off by the water department and a s~a~ge penalry of $60.00 shall be accessed. Thereafter, , a reconnect fee of $~-9:A8 $50.00 shall be assessed before restoration of service can be made. 13.04.270 REPEAL and REPLACE - Service 13.04.270 1A/~+er nnnc~ ~mere~ c~h~ll he r rer! m~Le ~ ~c~h rJen~c~i+ ~~iiFh +he ni+~i nremie~ee~ c~ ier! hi i~ in nn n~co ch~ll c~ ~nh rlor.nch hc locc ~h~n Qnn nn Anv hc ro~~ irnerl Fr~ ~he n ie~4r~mer ~#er ~II nl~imc ~hc n'#~i m~~i h~~ic ~n~inc4 ~hc e#ise Water consumers shall be required to complete an Application for Utilitx Service and provide photo identification with the City Clerk/Treasurer's office to start service for water at the address listed on their application. 13.04.280 AMEND - Billing and Payments 13.04.280 Monthly statements of charges for water service shall be due and payable at the office of the City Clerk/Treasurer or at such other place or places designated by him/her on or before the fifteenth of the month and are deemed delinquent thereafter. . . Statements shall cover service charges for the period shown thereon and the water consumption charges from the meter reading for the period from last meter read. Statements shall be forwarded to the customer as soon as practicable after each service period. 13.04.290 AMEND Nonpayment of Charges 13.04.290 A. Water service terminated for nonpayment shall not be restored to the nonpaying occupant until all delinquent charges, together with a service fee of $~99 50.00 for restoring services, are paid. The city will not refuse to turn on a discontinued service to a new tenant in any building due to the nonpayment of a prior tenant. Upon completion of a utility service application and proof of identification, the new service shall be restored. Restoration of service shall in no way comprise the existing debt or the responsibility of the owner for payment. Effective Date. This Ordinance shall take effect January 1, 2009.
