A RESOLUTION DETERMINiNG THAT THE YELM COMPREHENSIVE PLAN IS
CONSISTENT WITH THE POLICIES OF THE GROWTH MANAGEMENT ACT WITH THE
EXCEPTION OF THE USE OF BEST AVAILABLE SGIENCE IN THE REGULATION OF
CRITlCAL AREAS AND ESTABLISHING A SCHEDULE TO UPDATE THE CRITICAL
AREAS CODE.
WHEREAS, The City of Yelm is required to plan under RCW 36.70A.040; and
WHEREAS, Every seven years, Section 36.70A.13~ (1) RCW requires Ye1m to take
legislative action to review and, if needed, revise its Comprehensive P1an and
development regulations, including its policies and regulations designating and
protecting critical areas to comply with the requirements in the Growth Management
Act, Chapter 36.70A RCW; and
WHEREAS, Ye1m adopted a public participation program that included public review of
the staff analysis, including a 60 day comment period, an open house, and a public
hearing; and
WHEREAS, Yelm has followed its public participation program as follows:
• The staff analysis was published on December 15, 2004, on the City web site
and emailed to all persons indicating interest in the consistency review
process.
• An open public comment period from December 15, 2004, to March 9, 2005.
• A public meeting with the Planning Commission on January 24, 2005.
• Response to comments from the public meeting published on February 18,
2005, on the City web site and via email to a11 interested parties.
• A public hearing before the Planning Commission on February 28, 2005.
WHEREAS, on December 15, 2004, the Community Development Department
published an analysis of critical areas and the development regulations that protect
critical areas currently in effect in Yelm for consistency with the requirements of Chapter
36.70A RCW. Based on this analysis, the Department concluded amendments are
needed to comply with Chapter 36.70A RCW; and
WHEREAS, The Yelm Planning Commission reviewed the anafysis and held an open
house on January 24, 2005, and a public hearing on February 28, 2005, to receive
public comments on the staff analysis. Based on its review of the requirements of
Chapter 36.70A RCW, the analysis, and public comments rec~ived, the Planning
Commission accepted the analysis and forwarded recommended findings on review and
proposed revisions to the City Council; and

WHEREAS, The City Council held a public meeting on March 9, 2005, and accepted
public comments on the recommended findings on review; and
WHEREAS, The analysis published by the Community Development Department on
December 15, 2004, included a review of the Comprehensive Plan and development
regulations currently in effect in Yelm for consistency with the requirements of Chapter
36.70A RCW. Based on this analysis, the Community Development Department found
the comprehensive plan and development regulations currently in effect comply with
Chapter 36.7QA RCW. On January 24, 2005, the Community Development Department
forwarded its analysis and findings to the Planning Commission for review at a public
open house; and
WHEREAS, The Planning Commission reviewed the analysis and comments received
at the open house and held a public hearing on February 28, 2005, to receive public
comments on the analysis and findings. Based on its review of the requirements of
Chapter 36.70A RCW, the analysis and findings prepared by the Community
Development Department, and the public comments received, the Planning
Commission accepted the analysis and forwarded recommended findings on review to
the City Councif on February 28, 2005; and
WHEREAS, The City Council held a public meeting on March 9, 2005, to receive public
comments on the recommended findings on review.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM, WASHIIVGTON
DO RESOLVE AS FOLLOWS:
A. The Comprehensive Pfan and development regulations need revisions relating to
the protection of critical areas and the use of best available science. The
Community Development Department is currently updating the Critical Areas
Code in compliance with the requirements of the Growth Management Act to
utitize best available science. The schedule for consideration of an updated
Critical Areas Code has been established as foflows:
Open House with Planning Commission March 21, 2005
Planning Commission Hearing April 18, 20Q5
City Council Hearing' May 25, 2005
B. The Comprehensive Plan and development regulations currently in effect in Yelm
comply with the requirements of Chapter 36.70A RCW, except as noted in
Section A.
