493 NSP CERTIFICATE OF COMPLIANCECity of Yelm Resolution No. 493 CERTIFICATION OF COMPLIANCE FOR NEIGHBORHOOD STABILIZATION PLAN WHEREAS, City of Yelm is applying to the state Department of Community, Trade and Economic Development for Neighborhood Stabilization Funds to meet the congressionally identified needs of abandoned and foreclosed homes in the Yelm area; WHEREAS, it is necessary that certain conditions be met as part of the application requirements; WHEREAS, Shelly Badger, City Administrator, is authorized to submit this application to the State of Washington on behalf of City of Yelm; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Yelm, Washington that on March 24, 2009, authorized submission of this administrative plan to the state Department of Community, Trade and Economic Development to request $640,505 to provide down payment assistance and home buyer counseling to help stabilize families and neighborhoods and certifies that, if funded, it: I. Will comply with the acquisition and relocation requirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended (42 U.S.C. 4601), and implementing regulations at 49 CFR part 24, except as those provisions are modified by the Notice for the NSP program published by HUD. 2. Will comply with section 3 of the Housing and Urban Development Act of 1968 and other applicable state and federal laws; 3. Will comply with Title III of Division B of the Housing and Economic Recovery Act of 2008 by using, as defined in the NSP Notice, all of its grant funds within 18 months of receipt of the grant; 4. Will not use assessments against properties owned and occupied by low- and moderate-income persons or charge user tees to recover the capital costs of CDBG-funded public improvements from low- and moderate- income owner-occupants; ~. Has adopted and enforces a policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in nonviolent civil rights demonstrations; and has adopted (or will adopt) and implement a policy of enforcing applicable state and local laws against physically barring entrance to or exit from a facility or location which is the subject of such nonviolent civil rights de-nonstration within its jurisdiction, in accordance with Section 104(1) of the Title I of the Housing and Community Development Act or 1974, as amended. Will conduct and administer its program in conformance with Title VI of the Civil Rights Act of 1964 and the Fair Housing Act, and will affirmatively further fair housing, (Title VIII of Civil Rights Act of 1968); and Shelly Badger is the City Administrator and authorized representative to act in all official matters in connection with this application and City of Yelm's participation in the Washington State Department of Community, Trade and Economic Development Neighborhood Stabilization Plan program.
