A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YELM,
WASHINGTON, STATING THE CITY COUNCIL'S SUPPORT FOR THE
PROPOSITION ON THE AUGUST 18, 2009, BALLOT WHICH, IF
APPROVED, WOULD CREATE AND ESTABLISH A REGIONAL FIRE
PROTECTION SERVICE AUTHORITY, ENCOMPASSING THE AREA
OF THE CITY OF YELM, YELM FIRE DISTR[CT #2 AND THURSTON
COUNTY FIRE DISTRICT #4 (RAINIER} -
WHEREAS, over the past few years, local municipalities have experienced
increased demands for fire and emergency medical services; and
WHEREAS, the result of these demands create a challenging task to provide an
adequate level of municipal services for its citizens; and
WHEREAS, this consolidation of resources, through the establishment of a
regional fire protection service authority, provides a mechanism for the participating
agencies to maximize their abilities to provide fire protection services; and
WHEREAS, state law was recently amended to increase the advantages of
municipalities and other governmental entities to join together to form a regional fire
protection service authority, whereby their services would be consolidated and the '
participating jurisdictions would benefit from increased efficiencies; and
WHEREAS, in order to provide the most effective fire protection services, Yelm

Fire District #2 and Thurston County Fire District #4 (Rainier) established S.E. Thurston
Fire & EMS, which authorized the establishment of a Regional Fire Authority Planning
Committee to evaluate regional fire protection needs and the parameters of the !
Regional Fire Protection Service Authority (the "Authority"); and

WHEREAS, the Regional Fire Protection Authority Planning Committee
developed its Plan for the "Authority", copies of which are on file with the City Clerk for
i
the City of Yelm and Board Secretary for Yelm Fire District #2 and Thurston County Fire

District #4 (Rainier); and
i
WHEREAS, in accordance with said Plan and with chapter 52.26 RCW, it
is appropriate to place before the voters of the proposed "Authority" a proposition for the
creation of the Regional Fire Protection Service Authority and the approval of the Plan, i

all in accordance with state law; and j
WHEREAS, it is the City Council's position to endorse and support that
I
ballot measure expressed at a meeting at which members of the public are given
i
opportunity to voice opposing views pursuant to RCW 42.17.130; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM,
WASHINGTON, HEREBY RESOLVES as follows:
Section 1. FINDINGS AND DESCRIPTION OF PROPOSITION. ~
The City Council of the City of Yelm, Washington, hereby finds that it is in the
best interests of the City to submit to the qualified electors of the City, at the primary
election to be held on August 18, 2009, a proposition regarding the creation of the
Regional Fire Protection Service Authority {the "Authority"), pursuant to chapter 52.26
RCW, and the approval of the Plan for the Authority. If approved by the voters in
accordance with RCW 52.26.060, this proposition would: (1} create a regional fire
protection service authority (the "Authority"), as defined in RCW 52.26.020, whose
boundaries are coextensive with Yelm Fire District #2 and Thurston County Fire District

#4 (Rainier); and (2) approve the "Plan" prepared by the Regional Fire Protection
Authority Planning Committee. The governing body of the "Authority" shall have such
rights to modify the details of the "Plan" from time to time as provided by law and the

provisions of the "Plan".

Section 2. BALLOT TITLE AND PROPOSITION
i
The Director of Records and Elections of Thurston County, Washington, as ex
i
officio supervisor of the elections, are hereby requested to submit to the qualified
electors of the City, at the primary election to be held on August 18, 2009, a proposition
in the following form, which has been prepared by the Ye1m City Attorney and Thurston
i
County Prosecuting Attorney pursuant to RCW 29A.36.071:

PROTECTION SERVICES AUTHORITY
The Regions[ Fire Protection Authority Planning Committee has submitted to the
Ci#y of Yetm, Yelm Fire District #2 and Thurston County Fire District #4 a Regional
Fire Service Protection Authority Plan to create and fund a Regional Fire Protection
Service Authority under RCW 52.26. If this Plan is approved, it will create a
regional authority for fire protection and emergency medical services funded by a !
regular property tax, not to exceed $1.50 per one thousand dollars of assessed
value.

Section 3. DESIGNATION OF INDIVIDUAL

For purposes of receiving notice of any matters related to the ballot title, as provided in
RCW29A.36.080, the City Council hereby designates the City Administrator as the ~
I
individual to whom the Director of Elections shall provide such notice.
Section 4. COPIES FILED WITH THE THURSTON COUNTY AUDITOR f

The City Clerk, or his/her designee, is hereby authorized and directed, na later than
I
May 26, 2009, to provide the County Auditor a certified copy of this resolution and to
pertorm such other duties as are necessary or required by law to the end that the
proposition described in this resolution appear on the ballot at the August 18, 2009
election. All ac#ions taken prior to the effective date of this resolution and in furtherance j
of this objective are herby ratified and confirmed. ~
Section 5. IMPLEMENTATION
The City Administrator is authorized to implement such administrative procedures
as may be necessary to carry out the directives of this legislation, including modifying
the text of the "Plan" and the text of the Ballot Measure and any other text, language
and/or descriptions relative thereto. ~
