626 Amend Sign Code ORDINANCE 626 AN ORDINANCE OF THE CITY OF YELM, WASHINGTON, AMENDING ORDINANCE 576, Title 15, Chapter 15.24, Signs. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Chapter 15.24, shall be amended to include the following: 15.24.195 Off-Site Banners. This procedural statement outlines the guidelines for the use and coordination of banner cables for non-profit organization event advertising. Banner locations shall be utilized for the purpose of hanging banners advertising community events designed for the general public interest. 1. Banner installations shall be allowed at four (4) designated public areas as approved by the City. 2. Written requests for the use of the banner locations shall be submitted to the Public Works Department, using the attached form. The request shall include pertinent information such as the nature of the event being advertised, the length of time the banner is to be hung, a description of the banner, who will install the banner, a contact person responsible for the banner and phone number of that person in case of emergency, etc. 3. Banners shall be used to advertise community interest events, and not for the advertising of the organization or its products. No requests shall be approved for banners advertising the following type of events: A) Religious events B) Political events C) Commercial product sales or events 4. Scheduling for installation of banners shall be on a first come, first serve, basis. Applicants are limited to four (4) events per year. Requests must be received three (3) weeks prior to the date the banners will be installed. No banner will be scheduled without a written request. The banners shall be hung for a maximum time of two (2) weeks. The time limit shall begin on a Monday and end at the time the banner is removed on a Monday. Shorter periods of one (1) week will be allowed with the same beginning and ending days. 5. Public Works staff will schedule the banner for the requested time providing there has not been prior written application for the same date. If prior application has been made, staff will notify the new applicant of the prior approval no later than seven (7) working days of receiving their request. 6. Installation and removal of the banners shall be the sole responsibility of the applicant. Arrangements by the applicant must be made for the installation and removal of the banner with one of the following approved sources: A) Puget Sound Energy B) T.C.I. Cablevision C) Others as approved by Public Works Department. 7. It is recommended that applicants coordinate installation and removal of their banner with that of other applicants, for ease of installation and removal by the installer. 8. Banners shall be 24 to 30 feet in width (maximum size 30 feet) and 3 %2 feet in height for all locations and shall have the approved message on both sides of the banner. Up to and including ten percent (10%) of the sign area, per side, may include advertisement of the sign sponsor(s). 9. Grommets must be placed along the top edges of the banner and one at each bottom end. The minimum grommet size shall be '/z inch (inside measurement) and the grommets shall be placed a maximum of two (2) feet apart. Air holes must be placed in the banner (minimum size of air holes should be comparable to the diameter of a three (3) pound coffee can or minimum six (6) inches in diameter and spaced two (2) to four (4) feet apart.) 10. Mounting hardware shall be supplied by the applicant. This will include a minimum of a 5/16 inch link or comparable for each grommet, plus two (2) nylon type cords of adequate length for both bottom ends, for use as tie downs. 11. Use of the banner cables is subject to availability of banner cables, availability of an approved installer and condition of banner cables. If weather conditions pose a danger to installation personnel, banners will not be hung until it is safe to do so. 12. If the request is approved, the applicant should take the banner (including all hardware) to the installer a minimum of three (3) days prior to installation or by the schedule agreed upon by that installer. 13. City staff may request that the applicant repair or remove their banner at any time that the banner may pose a danger to public safety due to banner deterioration, storms, high winds, etc. If the applicant fails to respond to such a request within five (5) days, staff shall remove the banner or cause it to be removed, and will bill the organization for the cost of removal. Section 2. Severability. If any provisions of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance or the application of the provisions to other persons or circumstances is not affected. Section 3. Effective Date. This ordinance shall be in full force and effective from and after its passage, approval and publication as provided by law.
