NEIGHBORHOOD STABILIZATION PLAN
YELM DOWN-PAYMENT ASSISTANCE PROGRAM
GRIEVANCE PROCEDURE
WHEREAS, City of Yelm has applied to the state Department of Commerce
for Neighborhood Stabilization Funds to meet the congressionally identified needs
of abandoned and foreclosed homes in the Yelm area;
WHEREAS, Resolution 493 designates Shelly Badger, City Administrator,
as the authorized agent regarding the Neighborhood Stabilization Program;
WHEREAS, a grievance procedure for this program will help provide
resolution to any problems incurred;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Yelm, Washington that commencing on October 27, 2009, a grievance procedure
for the resolution of problems and complaints regarding the use of Neighborhood
Stabilization Plan funds is as follows:
1. The City of Yelm and any subrecipient agency, or agency contracted to
administer the program, will address any complaints or grievances. Complaints or
grievances should be directed to the City of Yelm, 105 Yelm Ave. W., Yelm
Washington 98597 or call the City Administrator's office at 360-458-8405 within ten
(10) working days of the time the problem occurred. Informal resolution will be the
first effort toward conciliation. This approach is encouraged by the City and may
lead to an amicable and beneficial result without need for further action.
2. If the initial decision is not satisfactory to the grievant, the grievant has five (5)
working days after the initial decision is issued in which to appeal in writing to the
City Administrator located at Yelm City Hall 105 Yelm Ave. W. Yelm, Washington
98597. The City Administrator will review the matter on the basis of documentation
presented, statements made during an appointed interview, and any investigation
that may result concerning the matter and at the discretion of the City
Administrator.
3. If the problem remains unresolved after the City Administrator's decision is
rendered, a letter of grievance may be submitted in writing to the Yelm City Council
at Yelm City Hall. Copies of the letter must be submitted to the City Clerk and any
sub-grantee at the same time. The action and decision of the Council is final and
binding.
4. The petitioner will receive written notification of the Council's decision explaining
the conclusions and actions taken with respect to the matter in question. Written
notification will suffice as formal response to the grievance.
However, in all cases, whenever possible an approach based on conciliation and
information sharing will be used to resolve all grievances. The respondents in all
cases shall be the City, the sub-grantee agency, or the City Council rather than
any individual. The respondents may be represented by the appropriate
designated director or manager. The filing or pendency of a grievance shall not
delay or interfere with the implementation of a program or project action during the
processing of a grievance.
A "grievance" is defined as a formal written statement by a person or agent that the
City or its sub-grantee has violated an express term of the NSP program or project
and that by reason of such violation; the grievant's rights have been adversely
affected. All other matters and disputes of any nature are beyond the scope of
these procedures.
A "day" is defined as a day in which the central administrative office of the
appropriate respondent is open for business.
Anyone wishing to initiate this grievance procedure should contact the Yelm City
Administrator during normal office hours, Monday through Friday, excluding
holidays.
