01-08-08 Minutes YELM CITY COUNCIL REGULAR MEETING TUESDAY, JANUARY 8, 2008 MINUTES 1. Call to Order -Mayor Harding called the Meeting to Order at 7:30 pm. 2. Roll Call -Present: Don Miller, Joe Baker, Bob Isom, Mike McGowan, Pat Fetterly, Mike McGowan and Russ Hendrickson. 3. Agenda Approval 8-001 MOTION BY JOE BAKER APPROVING THE AGENDA AS PRESENTED. CARRIED. 4. Special Presentation -None scheduled. 5. Public Comment- Mayor Harding called for public comment. No public comment. 6. Consent Agenda a. Minutes: December 11, 2007 Regular Meeting b. Payables -Checks 33241-33344 Totaling $452,783.34 c. Payroll - d. Financial Report -December Month End Report 8-002 MOTION BY PAT FETTERLY APPROVING CONSENT AGENDA ITEMS AS PRESENTED. CARRIED. 7. a. Public Hearing -Resolution No. 475, Establishing a Fire Impact Fee was continued from the December 11, 2007 Council meeting. The Mayor opened the public hearing at 7:33 pm to hear comments on the proposed Fire Impact Fee Increase. Hearing no public comment, the public hearing was closed at 7:34 pm. 8-003 MOTION BY BOB ISOM APPROVING RESOLUTION NO. 475, FIRE IMPACT FEE NEW RATE. MOTION CARRIED. 8. New Business a. Resolution No. 480, Check approval (December 12-January 7) Tanya Robacker stated that Resolution No. 480 was created to make payment to vendors as required before year end for some critical claims in the amount of $56,556.76 for checks 33185-33187. 8-004 MOTION BY BOB ISOM APPROVING RESOLUTION NO. 480, APPROVING CHECKS 33185-33187 IN THE AMOUNT OF $56,556.76. MOTION CARRIED. b. Dimensional Communication, Inc. Contract Award for AudioNisual Services for Public Safety Building. Stephanie Ray stated that on November 26, 2007 the City submitted an "Invitation to Bid" for the audio visual portion of the public safety building project in the amount of $81,887.00. This portion of the project includes the communication component for the building such as speakers, microphones, LCD displays, wired podium, and computer interfacing. The invitation was sent to six companies (via the City's small works roster process) that specialize in completing audio, visual, and communication projects similar to the requirements for the public safety building project. lam/city counci112008 Page 1 of 3 8-005 MOTION BY PAT FETTERLY AUTHORING MAYOR HARDING TO AWARD THE CONTRACT FOR AUDIONISUAL SERVICES FOR THE PUBLIC SAFETY BUILDING IN THE AMOUNT OF $81,887.00. MOTION CARRIED. c. Gray & Osborne Engineering Contract for Coates Road design. Stephanie Ray explained that Gray & Osborne, Inc of Seattle has been contacted to complete a Consultant Agreement for the survey and design work for the Coates Road Improvement Project. On November 16, 2007, the Washington State Improvement Board awarded the City of Yelm a $550,000.00 grant from the small City Arterial Funding Program (SCAP). The Transportation Improvement Board requires that design and construction costs for engineering services not exceed 25% of the estimated construction cost. This proposed contract is within the overall estimated project cost. 8-006 MOTION BY JOHN THOMPSON AUTHORIZING MAYOR HARDING TO SIGN A CONTRACT WITH GRAY & OSBORNE ENGINEERING IN THE AMOUNT OF $93,114.00 FOR THE SURVEY AND DESIGN WORK FOR THE COATES ROAD IMPROVEMENT PROJECT. MOTION CARRIED. 9. Old Business a. Ordinance No. 888 Business and Occupation Ordinance Update. Tanya Robacker stated that Ordinance No. 888 amended Chapter 5.04 of the Yelm Municipal Code relating to the Business and Occupation tax regulation and licensing of business activities in the City of Yelm. 8-007 MOTION BY PAT FETTERLY JOHN THOMPSON ADOPTING ORDINANCE NO. 888 AMENDING CHAPTER 5.04 OF THE YELM MUNICIPAL CODE. MOTION CARRIED. b. Ordinance No. 889 Business and Occupation Administrative Provisions. Tanya Robacker stated that Ordinance No. 889 did not change the rates but only the wording regarding the Business and Occupation. The state has mandated that cities must adopt allocation and apportionment provisions to 8-008 comply with RCW 35.102.130 by January 2008. MOTION BY MIKE MCGOWAN ADOPTING ORDINANCE NO. 889 AMENDING CHAPTER 5.04 OF THE YELM MUNICIPAL CODE RELATING TO ALLOCATION AND APPORTIONMENT PROVISIONS IN THE ADMINISTRATIVE PROVISION FOR BUSINESS AND OCCUPATION TAXATION AND LICENSING OF BUSINESSES IN THE CITY OF YELM. MOTION CARRIED. 10. Mayor and City Council Reports Councilmember Miller attended SE Thurston Fire/EMS Board meeting and will attend a Chamber meeting. Miller stated that the Nisqually Valley News reported incorrectly when they stated that Thurston Fire/EMS hired a public relations firm. This action will be taken after the bid process. Councilmember Baker was on vacation and was unable to attend any meetings. Councilmember Isom did not attend any meetings due to the holidays. lam/city council/2008 Page 2 of 3 Councilmember McGowan attended the Thurston County HOME Consortium meeting more social services and funding for projects in Yelm. McGowan will update Council at the next meeting. Councilmember Fetterly stated the Yelm Emergency Operations Board meeting was cancelled. Councilmember Thompson stated the Transportation Policy Board meeting had been moved to next week. A report will be given at the next meeting. Councilmember Hendrickson stated all his meetings had been cancelled. Mayor Harding attended the Nisqually Tribe Two Percent Committee and the committee decided to allocate funds at Christmas time to the Thurston County Food Bank and to help flood victims. 11. Executive Sessions -Property Acquisition The Mayor adjourned to executive session at 7:54 pm for 15 minutes to discuss property acquisition. 8-009 At 8:12 pm the regular meeting reconvened. MOTION BY BOB ISOM TO MOVE FORWARD IN THE PROPERTY ACQUISITION AND APPROVE AND DISBURSE THE FUNDS NEEDED TO ACQUIRE THE DISCUSSED PROPERTY. MOTION CARRIED. 12. Correspondence -Provided for review included; Letter dated December 20, 2007, from Comcast Cable with the additions to the channel line-up on or shortly after January 23, 2008 and a letter received from Girl Scouts of Western Washington dated November 13, 2007 asking permission to sell the Girl Scout cookies from February 29-March 16, 2008. The council consensus is to allow the Girl Scouts to sell cookies in the City of Yelm. 13.
