ORDINANCE NO. 920
AN ORDINANCE of the City Council of the City of Yelm,
Washington amending Chapter 13.04 Yelm Municipal Code
relating to decommissioned wells and water rates.
WHEREAS, the City of Yelm ("City") is anon-charter Code city located in Thurston
County, Washington; and
WHEREAS, section 90.44.105 RCW allows for the consolidation of water rights
associated with exempt wells that have been decommissioned with water rights of the
water system which will serve the property previously served by the decommissioned
well; and
WHEREAS, in order to consolidate water from a decommissioned well, the rights to the
water must be transferred to the City and regulations must be in place to ensure that
another exempt well is not constructed on the property previously served by the
decommissioned well; and
WHEREAS, this has been a requirement of the City through the development review
process, but has never been codified; and
WHEREAS, the City Council desires to codify this requirement in order to clarify future
requests for the consolidation of water rights from decommissioned wells; and
WHEREAS, Ordinance 905, which amended water rates established at Section
13.04.250 YMC, inadvertently removed the senior citizen water rate from the rate
schedule; and
WHEREAS, the City has continued to apply the senior rate and desires to maintain the
senior rate;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON,
DOES ORDAIN AS FOLLOWS:
Section 1. Anew section is added to Chapter 13.04 Yelm Municipal Code as follows:
13 04.025 Use of municipal water.
A It shall be unlawful for anv person to construct a well within the Citv of Yelm's
Retail Water Service Area. except that a well may be constructed for the purpose
of:
1. Providing potable water to a sinale dwellina unit on a lot leaally created

prior to 1992 when the nearest water and sewer mains are located over
200 feet from the closest propertv line: or
2 Providina potable water to any development when the well and water
~vstem is approved by the City of Yelm as a satellite water system.
B Upon connection to the Citv of Yelm water system. all existina wells servina the
property connectina to the water system shall be abandoned and
decommissioned pursuant to Chapter 18.104 Revised Code of Washinaton.
C. The Citv shall have the riaht to consolidate water riahts for exempt wells
abandoned pursuant to subsection B of this Section accordina to Section
90 44 105 Revised Code of Washinaton.
D It shall be unlawful for any person to construct a new well on any property which
contained a well previously decommissioned pursuant to subsection B of this
Section.
Section 2. Section 13.04.250 YMC is amended as follows:
13.04.250 Water consumption rates.
A. Monthly Base Rate Charges. The monthly base rate charges based upon meter
size for all consumers will be:

Monthly base rate charges shall be increased by sixteen percent (16%) January
1, 2011, and eight and one quarter percent (8.25%) January 1 of 2012, 2013,
2014, and 2015.
B. Monthly Consumption Charges. The monthly consumption charges for all
commercial, residential and irrigation meters will be:

Monthly consumption charges shall be shall be increased by sixteen percent
(16%) January 1, 2011, and eight and one quarter percent (8.25%) January 1 of
2012, 2013, 2014, and 2015.
C. Automatic Fire Sprinkler Systems. All buildings with an automatic fire sprinkler
system connected to the city water distribution shall pay the ready-to-serve
charge based on the pipe size as substituted for equal meter size in the rate
schedule. No water shall be used through such connections or sprinkler system
except for actual fire control. If the consumer is found using water through
unmetered special fire or sprinkler service connection for other than fire
protection, then each such connection shall be equipped with aconventional-type
meter at the expense of the property owner.
D. Outside City Corporate Limits. Charges for the use of water outside the corporate
limits of the city shall be the meter rate identified in the "outside" schedule.
E. Temporary Water Service. Temporary water service for construction of any
building, street, utility or similar project shall be provided at the rate identified in
the rate schedule in subsection A or B of this section dependent upon location of
project. A construction meter shall be required and application shall be made at
the office of the public works director identifying location and reason for use of
water. A deposit of $69A-~8 800 00 for each construction meter shall be
collected. Upon completion of the project, return of construction meter and
charges for consumed water is paid for, return of deposit shall be made to
consumer.
Section 3. Effective Date.
This Ordinance shall be in full force and effect five (5) days after passage and
publication as provided by law.
