AN ORDINANCE ANNEXING CERTAIN TERRITORY KNOWN AS CANAL PARK TO
THE CITY OF YELM, WASHINGTON AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the record owner of the property described below is the CITY OF YELM.
WHEREAS, the City Council by majority vote may annex territory outside its limits for any
municipal purpose, if the territory is owned by the City (RCW 35A.14.300)
~x~'R.EAS, the City of Yelp; Cor-iprehensive pian designates the annexed territory as parks/open
space. The municipal purpose for the annexed territory is intended as a future City Park.
WHEREAS, the City Council finds that such annexation is in the best interest of the City and
conforms with annexation policies of the City as set forth in the Comprehensive Plan and Yelm
Municipal Code Chapter 2.66.
NOW, THEREFORE, THE CITY COUNCIL, OF YELM DOES ORDAIN AS FOLLOWS:
Section 1. The following described territory is hereby annexed to and made a part of
the City of Yelm:
Parcel #64300500501
That portion of Lot 5 and 6, Tract 5, McKenna Irrigated Tracts, according to the plat
thereof recorded in Volume 9 of plats, page 43, records of Thurston County, described as:
Beginning at a point on the northwesterly right-of--way line of SR 507, Yelm to Roy, that
is North 13 °42', West 151.58 feet from Highway Engineer's Station 104 + 50.8 on the
center line survey of said highway; thence North 13 °42' West 443.95 feet; thence South
52°4G' ~x7PCt 1QQ5.~ feet, to the soutl~~~est:,rly line vfsaid Lot 5; thence South 40° i4`
East, along said southwesterly line, 411.3 feet, to a point 140 feet northwesterly, when
measured at right angles, from the centerline of said highway; thence northeasterly to the
point of beginning. Situate in Thurston County, state of Washington. Together with that
portion of Canal Road abutting above parcel.

That portion of Lots 5 and 6, Tract 5, McKenna Irrigated Tracts, according to the plan
thereof recorded in Volume 9 of Plats, page 43, records of Thurston County, lying within
a strip of land 215 feet wide, begin 140 feet on the northwesterly side and being 75 feet on
the southeasterly side of the line survey of SR 507, Yelm To Roy. Together with that
portion of Canal Road abutting above parcel.

The specific details concerning all of which may be found on Sheet 3 of the certain plan
entitled SR 507, Yelm to Roy, now of record and on file in the Office of the Secretary of
Transportation at Olympia, Washington, bearing date of approval October 13, 1954.
Subject to all existing encumbrances, including easements, restrictions, and reservations, if
any.
Section 2. The City Clerk shall record a copy of this Ordinance in the Office of the
County Auditor and file a certified copy with the Board of County Commissioners.
Section 3. This Ordinance shall become effective on the 5th day of November, 1996,
being a date not less than five days following publication.
