Present: J.W. Foster, Joe Baker, Mike McGowan, Ken Garmann and Russ Hendrickson. Bob Isom and Tracey Wood were excused. 3. Agenda Approval 12-12 MOTION BY JOE BAKER APPROVING THE AGENDA AS PRESENTED. CARRIED. 4. Special Presentations - None scheduled. 5. Public Comment. No comments from public. 6. Consent Agenda Minutes - Payables - Checks #57572 - #57623 Totaling $140,944.70. 12-13 MOTION BY RUSS HENDRICKSON APPROVING THE CONSENT AGENDA AS PRESENTED. CARRIED. 7. Public Hearing - none scheduled 8. New Business - a. Mayor Pro Tempore Election Yelm Municipal Code 2.06.010 states the Mayor Pro Tempore shall be appointed from among their membership by a majority of the city council members at the first meeting of the newly elected council at the beginning of each biennium. 12-14 MOTION BY MIKE MCGOWAN NOMINATING BOB ISOM AS MAYOR PRO TEMPORE FOR 2012-2013. CARRIED. b. Resolution No. 530 Compliance Policy related to Tax Exempt Bonds as part of City of Yelm Financial Policies Janine Schnepf explained that Federal tax law requires the filing of an IRS (8038-G) following the issuance of bonds and during the life of the bond issue. The form includes questions about whether the city has adopted written policies. The policy defines how the finances and records are monitored after the issuance of the bonds. 12-15 MOTION BY JOE BAKER APPROVING RESOLUTION NO. 530 POST ISSUANCE COMPLIANCE POLICY RELATED TO TAX-EXEMPT BONDS AS PART OF THE CITY OF YELM FINANCIAL POLICIES. Ordinance No. 955, Issuance and Sale of $2,275,000 Limited Tax General Obligation Bond for Purchases of Timberland Library Space and other Capital Improvements for Public Use. Shelly Badger gave a brief explanation of the Limited Tax General Obligation Bond (LTGO) to purchase a portion of the building at 210 Prairie Park Street that currently houses the Timberland Regional Library and to finance other property acquisition and capital improvements. Jim Nelson, Vice President and Senior Municipal Underwriter gave a detail presentation to council. The City of Yelm has achieved an "A" rating grade for the City's General Fund. The City is timing the sale of the Limited Tax General Obligation (LTGO) and Refunding Bonds at a perfect time for historically low interest rates. Mr. Nelson combined the current refunding of 2000 Limited Tax General Obligation (LTGO) (Public Works office, storage area, and police impound area) along with the new LTGO for a combined net borrowing cost of 2.93%, which over the 20 year term would save the City $23,938. Ordinance No. 955 provides for the issuance and sale of the LTGO in the amount of $2,275,000. 12-16 MOTION BY J.W. FOSTER ADOPTING ORDINANCE NO. 955, AUTHORIZING THE ISSUANCE AND SALE OF LIMITED TAX GENERAL OBLIGATION BONDS IN THE PRINCIPAL AMOUNT OF 2,275,000 TO PURCHASE THE YELM TIMBERLAND LIBRARY PORTION OF THE BUILDING LOCATED AT 210 PRAIRIE PARK ST. AND TO FINANCE OTHER PROPERTY ACQUISITION AND CAPITAL IMPROVEMENTS. CARRIED. d. Yelm Animal Alliance Service Provider Agreement Shelly Badger stated the City entered into an arrangement in 2010 with Yelm Animal Alliance for the fostering and adoption of unclaimed dogs from the Yelm animal shelter. In 2010, they provided these services for 32 dogs and in 2011, 39 dogs. The agreement provides an annual administrative fee of $500.00 and $50.00 per dog fostered and/or adopted by the Yelm Animal Alliance. The 2012 Budget includes funding for this service. 12-17 MOTION BY JOE BAKER APPROVING THE SERVICE PROVIDER AGREEMENT BETWEEN THE CITY OF YELM AND YELM ANIMAL ALLIANCE (YYA) FOR DOG FOSTERING AND ADOPTION SERVICES. CARRIED. 9. Old Business — None scheduled 10. Mayor and Council Initiatives Councilmember Foster attended his first Nisqually River Council meeting, where he received a warm welcome. Councilmember McGowan reminded everyone of the Salmon Run Apartments Ground Breaking Ceremony on Thursday, March 1, 2012, at 10:30 am. Mr. McGowan would like to further discuss recognition of the Page 2 of 3 Agenda Item 6. a. Page 3 of 3 staff members that went above and beyond their regular duties during the ice storm in January. Councilmember Garmann attended his first Thurston County Law and Justice meeting. Councilmember Hendrickson attended the Medic One meeting. Mayor Harding attended the Thurston County Economic Development Council (TCEDC) meeting where Yelm Faith Harvest, a nonprofit business, was nominated as one of three finalist to be recognized as a Thurston County business. TCEDC will hold an awards ceremony and will announce the winner later. Announced the Salmon Run Apartments Ground Breaking Ceremony this Thursday, Dollars for Scholars on Saturday and Study Session tomorrow. 11. EXECUTIVE SESSION - NONE SCHEDULED 12.
