533 Fire Impact WaivedCity of Yelm Resolution No. 533 A RESOLUTION of the City of Yelm establishing an updated Fire Impact Fee pursuant to Section 15.40.020 Yelm Municipal Code WHEREAS, Section 15.40.020 (13)(6) Yelm Municipal Code establishes an impact fee related to fire protection services; and WHEREAS, at the time the City began collecting the Fire Impact Fee, the City contracted for fire protection services with the Yelm Fire District; and WHEREAS, in 2008 the City of Yelm and the Yelm Fire District entered into a contract for the purchase of a fire engine that was identified in the adopted Capital Facilities Plan as being needed to maintain fire protection levels of service for property owners in Yelm; and WHEREAS, the final payment for the fire engine was made and the engine was entirely funded through fire impact fees collected from new development in the City of Yelm; and WHEREAS, the Yelm Fire District and the City of Yelm became part of a Regional Fire Authority in 2010 with all property owners, both inside the City of Yelm and in unincorporated Thurston County, paying for fire protection services through a direct and equal property tax; and WHEREAS, Thurston County has the same authority as the City of Yelm to collect impact fees for a Regional Fire Authority but has not adopted fire impact fees for new development within unincorporated Thurston County; and WHEREAS, the Regional Fire Authority has not updated its Capital Facilities Plan to reflect the new organization and capital needs associated with operating as a single entity with a single and equal tax levy; and WHEREAS, as a Regional Authority, it is equitable for all new development within the Authority, whether inside the City limits or within the unincorporated County, to pay for the capital needs of growth; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON DO RESOLVE AS FOLLOWS: 1. A fire impact fee as authorized pursuant to Section 15.40.020 (13)(6) YMC will not be collected by the City of Yelm for any building permit issued by the City after the date of this resolution. 2. The City Council will revisit the collection of a fire impact fee if Thurston County authorizes the collection of a fire impact fee for development in the unincorporated areas of the SE Thurston Regional Fire Authority and the Fire Authority updates its Capital Facilities Plan accordingly.
