Mayor Harding called the meeting to order at 6:00 p.m.
Roll Call. Present: J.W. Foster, Mike McGowan, Tracey Wood, Ken Garmann and Russ
Hendrickson. Excused; Joe Baker and Bob Isom

Public Comment —
Rose Eills, Olympia, representing National Organization Reform of Marijuana Laws
NORMALThurston, addressed the Council requesting support for non -arrest of adult
marijuana possession. Asking council to consider adopting formal policy for "lowest
enforcement policy" for adult marijuana possession and work with normalthurston.org for
development of that policy. Sited her analysis study on the cost of these types of arrest and
the frequency in Yelm. Stated that she provided information to council via email.

PRESENTED. CARRIED.

New Business —
a. Contract Award to Railworks Track Systems, Yelm Roy Prairie Line Brush Mowing.
Tim Peterson addressed Council to request approval of contract with Railworks Systems in
Chehalis to mow brush on the Shortline Rail from First Street to Roy. Last mowed in 2006 by
City of Tacoma through and interlocal agreement. City of Tacoma was unable to do this year
so it went out to bid. Bid opening on July 27th' Railworks was one responding bid at $225 per
hour for machine and operator. Budgeted in Shortline Rail fund not to exceed $19,500.
Overgrown scotch broom and alder trees impede rail and trail.
12-55 MOTION BY TRACEY WOOD AUTHORIZING MAYOR HARDING TO EXECUTE THE
CONTRACT WITH RAILWORKS TRACK SYSTEMS, INC. TO MOW BRUSH ALONG THE
YELM ROY PRAIRIE LINE. CARRIED.
b. Federal CDBG entitlement Interlocal Agreement with Thurston County and the City of
Yelm.
Memorandum of Understanding for Governance, Decision Making and Administration
of the CDBG between Thurston County and the Cities of Yelm, Rainier, Tenino and
Town of Bucoda.
Shelly Badger stated this item was added to the agenda and submitted to Council for review.
Thurston County was notified by Federal Dept of Housing and Urban Development (HUD) that
Thurston County meets the qualification for entitlement for Community Development Block
Grant under the urban county definition based on percentage of population in low or moderate
income. Thurston County is eligible to receive annual allocation of federal funds from HUD for
eligible projects for the years 2013-2015. In July, the cities of Lacey and Tumwater joined in
an interlocal agreement making them a party to the entitlement. The Mayor's of the cities in
South County: Yelm, Rainier, Tenino and Town of Bucoda have been reviewing the

advantages of entering into a interlocal agreement with Thurston County for application for
one of the guaranteed annual allocations. Additionally, they drafted a MOU between all five
parties, defining governance and administration of the agreement. Mayor Harding has worked
with the other mayors to coordinate the agreement. Entering into the entitlement, would
exclude the cities from State competitive HUD funds. Three year agreement involving three
groups; Lacey, Tumwater and Thurston County that includes Yelm, Rainier, Tenino and Town
of Bucoda. The advantage to be an entitlement community, you can plan project with the
opportunity to apply for the funding within your interlocal agreement.
City would manage their project, County would administer funds to the cities. Discussion
followed regarding the administration of the funds, the order of projects and application
process.

AGREEMENT BETWEEN THURSTON COUNTY AND THE CITY OF YELM TO
PARTICIPATE IN THE FEDERAL COMMUNITY DEVELOPMENT BLOCK GRANT
ENTITLEMENT PROGRAM. CARRIED.
12-57 MOTION TO APPROVE THE MEMORANDUM OF UNDERSTANDING FOR
GOVERNANCE, DECISION MAKING AND ADMINISTRATION OF THE COMMUNITY
DEVELOPMENT BLOCK GRANT PROGRAM BETWEEN THURSTON COUNTY AND THE
CITIES OF YELM, RAINIER, TENINO AND THE TOWN OF BUCODA. CARRIED.

10. Mayor and Council Initiatives
Councilmember Foster attended the Thurston County Solid Waste Advisory Committee
public presentation in Yelm (SWAC), regarding the plastic bag issue. Noted that community
interest was low with low attendance. He received additional information to bring to study
session.
Councilmember McGowan attended debrief of the Thurston County HOME Consortium
retreat.
Councilmember Hendrickson attended Medic One meeting where they approved the 2013
budget and discussed plan to participate in TRPC study with no obligation.
